QUERESHI for the complainant.\n \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tLearned<br \/>\nadvocate for the petitioner  submitted that the petitioners have no<br \/>\ncriminal antecedents. They are residents of Amritsar  in Punjab.<br \/>\nMain allegations in the complaint are against son of petitioner No.1,<br \/>\nSunil.  Petitioner No.1 is aged about 77 years.   In addition to the<br \/>\nabove, I have also perused the nature of allegations made in the FIR.<br \/>\n Primary thrust of the allegations is against Sunil who is stated to<br \/>\nhave purchased gray fabrics from various persons and disappeared<br \/>\nwithout making payment thereof.\n<\/p>\n<p>3.\tConsidering<br \/>\nthe above aspects, the petitioners, in the event of their arrest  in<br \/>\nconnection with C.R.No.I-37 of 2010 of  DCB Police Station, Surat<br \/>\nshall be released on bail upon their  furnishing  bond of Rs.50,000\/-<br \/>\n(Rupees Fifty Thousand) each  with one surety of like amount to the<br \/>\nsatisfaction of the lower Court and subject to the following<br \/>\nconditions that they :\n<\/p>\n<p>[A]\tshall<br \/>\ncooperate with the investigation and make themselves  available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[B]\tshall<br \/>\nremain present at concerned Police Station  on 18th<br \/>\nFebruary 2011  between 11:00 am to 2:00 pm:\n<\/p>\n<p>[C]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[D]\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[E]<br \/>\n\twill not leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately<\/p>\n<p>[F]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>[G]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the petitioners. The<br \/>\npetitioners  shall remain present before the learned Magistrate on<br \/>\nthe first date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law.
