      This   revision  petition   is   directed   against   a   concurrent<\/p>\n
verdict of guilty, conviction and sentence in a prosecution under<\/p>\n
Section   138   of   the   Negotiable   Instruments   Act.   The   cheque   is<\/p>\n
for   an   amount   of   Rs.1,00,000\/-.     It   bears   the   date   07\/12\/1998.\n<\/p>\n
After   indulgent   modification   of   the   sentence   by   the   appellate<\/p>\n
court, the petitioner now faces a sentence of S.I for a period of<\/p>\n
three  months and  there   is   a direction  to pay the   actual  cheque<\/p>\n
amount   of   Rs.1,00,000\/-   as   compensation   under   Section   357(3)<\/p>\n
Cr.P.C and in default to undergo S.I for a period of one month.\n<\/p>\n
      2.     The   signature   in   the   cheque   is   admitted.     Notice   of<\/p>\n
demand   though   duly   received   and   acknowledged   did   not   evoke<\/p>\n
any response. The accused did not adduce any defence evidence.\n<\/p>\n
      3.     The courts below concurrently came to the conclusion<\/p>\n
that   the   complainant   has   succeeded   in   establishing   all   the<\/p>\n
ingredients   of   the   offence   punishable   under   Section   138   of   the<\/p>\n
N.I   Act.     Accordingly   they   proceeded   to   pass   the   impugned<\/p>\n
concurrent judgments.\n<\/p>\n
      4.     Called   upon   to   explain   the   nature   of   the   challenge<\/p>\n

which   the   petitioner   wants   to   mount   against   the   impugned<\/p>\n
concurrent   judgments,   the   learned   counsel   for   the   petitioner<\/p>\n
only   prays   that   leniency   may   be   shown   on   the   question   of<\/p>\n
sentence.  Some further time may be granted to the petitioner to<\/p>\n
raise   and   pay   the   amount   of   compensation   and   thus   avoid   the<\/p>\n
default sentence.\n<\/p>\n
      5.     Having   gone   through   the   impugned   concurrent<\/p>\n
judgments, I reckon that as an informed and fair stand taken by<\/p>\n
the learned counsel for the petitioner.   The verdict of guilty and<\/p>\n
conviction   are   found   to   be   absolutely   justified   and<\/p>\n
unexceptionable.       In   the   absence   of   challenge   on   any   specific<\/p>\n
grounds,   it   is   not   necessary   for   me   to   advert   to   facts   in   any<\/p>\n
greater detail in this order.\n<\/p>\n
      6.     Coming   to   the   question   of   sentence,   I   have   already<\/p>\n
adverted to the principles governing imposition of sentence in a<\/p>\n
prosecution  under  Section  138  of  the  N.I.Act  in   the  decision  in<\/p>\n
Anilkumar   vs.Shammi  [2002(3)KLT   852].   In   the   facts   and<\/p>\n
circumstances   of   the   case,   I   find   no   compelling   reasons   which<\/p>\n
can persuade this court to insist on imposition of any deterrent<\/p>\n
substantive sentence of imprisonment. Leniency can be shown to<\/p>\n
the   petitioner   but  subject   only   to  the   compulsion   of  adequately<\/p>\n
and fairly compensating the victim  who has now been compelled<\/p>\n

to fight two rounds of legal battle and to wait from 1998 for the<\/p>\n
redressal  of his grievances.   The challenge  can succeed only  to<\/p>\n
the above extent.\n<\/p>\n
       7.     In the nature of the relief which I propose to grant, it<\/p>\n
is   not   necessary   to   wait   for   issue   and   return   of   notice   to   the<\/p>\n
respondent.\n<\/p>\n
       8.     In the result:\n<\/p>\n
       a)      This revision petition is allowed in part.\n<\/p>\n
       b)       The impugned verdict of guilty and conviction of the<\/p>\n
petitioner under Section 138 of the N.I.Act are upheld.\n<\/p>\n
       c)     But the sentence imposed is modified and reduced.  In<\/p>\n
supersession   of   the   sentence   imposed   on   the   petitioner   by   the<\/p>\n
courts below, he is sentenced to undergo imprisonment till rising<\/p>\n
of court.   He is further directed under Section 357(3) Cr.P.C to<\/p>\n
pay   an   amount   of   Rs.1,20,000\/-   (Rupees   one   lakh   twenty<\/p>\n
thousand   only)   as   compensation   and   in   default,   to   undergo   S.I<\/p>\n
for a period of three months.  If realised, the entire amount shall<\/p>\n
be released to the complainant as compensation.\n<\/p>\n
       9.     The petitioner is said to be undergoing imprisonment<\/p>\n
now   in   execution   of   the   sentence   imposed.     I   am   satisfied   that<\/p>\n
subject   to   appropriate   conditions,   the   petitioner   can   be   given<\/p>\n
further   time   to   make   the   payment   and   avoid   the   default<\/p>\n

sentence.     It   is   hence   directed  that   if   the   petitioner   executes   a<\/p>\n
bond   for   Rs.50,000\/-   (Rupees   fifty   thousand   only)   with   two<\/p>\n
solvent   sureties  each  for   the   like  sum   to  the   satisfaction  of   the<\/p>\n
learned   Magistrate   and   deposits   an   amount   of   Rs.25,000\/-\n<\/p>\n
(Rupees   twenty   five   thousand   only),   the   petitioner   shall   be<\/p>\n
released   from   custody   forthwith   on   condition   that   he   shall<\/p>\n
appear   and   his   sureties   shall   produce   him   before   the   learned<\/p>\n
Magistrate   on   or   before   01\/04\/2008   for   execution   of   the<\/p>\n
sentence.   By then, the petitioner can raise and pay the amount<\/p>\n
and avoid the default sentence.\n<\/p>\n
       Hand over copy of this order to the learned counsel for the<\/p>\n
petitioner.\n<\/p>\n
