JUSTICE RAJIVE BHALLA<\/p>\n<p>Present: Mr. Ajay Chaudhary, DAG, Haryana<br \/>\n         for the appellants.\n<\/p>\n<p>RAJIVE BHALLA, J (Oral).\n<\/p>\n<p>         The State of Haryana, challenges judgments and decrees<\/p>\n<p>passed by the Civil Judge (Junior Division), Karnal, dated 03.10.2007 and<\/p>\n<p>the Additional District Judge, Karnal, dated 23.01.2008, decreeing the suit<\/p>\n<p>of the respondent and dismissing their appeal, respectively.<\/p>\n<p>         The plaintiff-respondent, while working as a Forest Guard was<\/p>\n<p>compulsorily retired from service on 10.07.1998. He was served with a<\/p>\n<p>charge-sheet under Rule 7 of the Punishment and Appeal Rules for the<\/p>\n<p>shortage of 424 trees. Eventually a recovery of Rs.3,24,025\/- was ordered.<\/p>\n<p>The plaintiff-respondent, filed a suit, challenging the enquiry proceedings<\/p>\n<p>as also the order of punishment. The learned trial Court, found as a matter<\/p>\n<p>of fact that the enquiry, though exparte was conducted in gross violation of<\/p>\n<p>the provisions of Rule 7 and consequently decreed the suit and quashed<\/p>\n<p>the order of punishment.\n<\/p>\n<p>         Aggrieved by the said judgment and decree, the appellants filed<\/p>\n<p>an appeal, which was dismissed by the first appellate Court on 23.01.2008.<\/p>\n<p>         Counsel for the appellants submits that as the respondent was<br \/>\n<span class=\"hidden_text\"> Regular Second Appeal No. 2702 of 2008                    -2-<\/span><\/p>\n<p>proceeded against ex-parte. The Enquiry Officer rightly held him guilty and<\/p>\n<p>the punishing authority thereafter was justified in directing recovery of<\/p>\n<p>Rs.3,24,025\/-.   It is submitted that minor infraction in the procedure<\/p>\n<p>adopted by the Enquiry Officer, should have been overlooked by the courts<\/p>\n<p>below and, therefore, the enquiry and the order of punishment should have<\/p>\n<p>been upheld.\n<\/p>\n<p>         I have heard counsel for the parties and perused the impugned<\/p>\n<p>judgments.\n<\/p>\n<p>         As held by the courts below, though the respondent was<\/p>\n<p>proceeded against ex-parte, the enquiry office proceeded without recording<\/p>\n<p>any evidence, summoning any witness in support of the documents<\/p>\n<p>appended with the charge-sheet, and without recording any reasons,<\/p>\n<p>submitted his report.   In order to place the above conclusions in their<\/p>\n<p>correct perspective, a relevant extract from the judgment of the first<\/p>\n<p>appellate Court would be appropriate:-\n<\/p>\n<blockquote><p>             &#8220;18. A combined reading of the statement of PW1 and DW2<\/p>\n<p>             would make it crystal clear that while conducting the enquiry<\/p>\n<p>             against the respondent under Rule 7, no witness as mentioned<\/p>\n<p>             in the list of witnesses appended with the charge sheet<\/p>\n<p>             examined not the prosecutor Karam Chand, who was<\/p>\n<p>             supposed to produce the documents, was called upon to<\/p>\n<p>             produce the same.   The enquiry report Ex.D13 is silent as to<\/p>\n<p>             which document was relied upon and who proved the same to<\/p>\n<p>             be genuine and authenticated as rightly observed by the<\/p>\n<p>             learned lower court, even if the respondent was proceeded<\/p>\n<p>             against ex-parte, it never mean that the formal proof of the<\/p>\n<p>             document was to be dispensed with. There is a settled<\/p>\n<p>             proposition of law that the procedure established by Rule 7<\/p>\n<p>             cannot be curtailed in any manner, either the delinquent was<br \/>\n<span class=\"hidden_text\"> Regular Second Appeal No. 2702 of 2008                            -3-<\/span><\/p>\n<p>            contesting the charges of he was ex-parte.\n<\/p><\/blockquote>\n<blockquote><p>            19. After concluding that the established procedure as<\/p>\n<p>            contemplated under Rule 7 was not followed, the contention<\/p>\n<p>            of learned Govt. Pleader for the appellants that since the order<\/p>\n<p>            passed was covered under the category of minor penalties,<\/p>\n<p>            there was no requirement to adopt the complete procedure as<\/p>\n<p>            contemplated under Rule 7. This contention of learned Govt.<\/p>\n<p>            Pleader for the appellants is unable to cut much ice in view of<\/p>\n<p>            the settled proposition of law and the observations made in the<\/p>\n<p>            case law titled as Dr.K.G.Tiwari v. State of Haryana 2003 (1)<\/p>\n<p>            Labour and Services Judicial Reports, page 229 (P&amp;H). It<\/p>\n<p>            is an Full Bench authoritative pronouncement of our Hon&#8217;ble<\/p>\n<p>            High Court and according to this, once a charge sheet has<\/p>\n<p>            been issued under Rule 7 of the imposition of a major penalty,<\/p>\n<p>            the    disciplinary   authority   cannot    inflict   even   a   minor<\/p>\n<p>            punishment without holding a complete departmental enquiry.&#8221;<\/p><\/blockquote>\n<p>          It is, therefore, apparent from the the above extract that the<\/p>\n<p>enquiry was conducted in flagrant violation of the rules. The learned courts<\/p>\n<p>below, therefore, had no option but to conclude that the enquiry as also the<\/p>\n<p>order of punishment were void.
