it .. That on 27-7-04, when the Claimant was<\/p>\n
 evtiravelling as a pillion rider in motor cycle bearing<\/p>\n
registration No. KA\u00bbl9~R~6618 from Padavu High<\/p>\n
55,<\/p>\n
School side towards his residence via Nanthoor
\njunction, near Nanthoor circle, the rider of the motor
\ncycle lost control over the vehicle and caused the<\/p>\n
accident. As a result, the claimant fell <\/p>\n
sustained injuries. Hence, he filed a<\/p>\n
before the MACT, Mangalore,.<s'eckipng'_:' ; <\/p>\n
Rs.5,00,000\/–. The Tribunal".b}}'.A_'_inapugne*dV <\/p>\n
and award has awarded coinpensationplof <\/p>\n
with interest at 6% ..p.a. ,Aggr_i'evle'ei._ by the quantum of
\ncompensation awardledllbjfftlhe  the claimant is<\/p>\n

5.  t’r1ere:”isl =no*-.._dis__pute regarding occurrence of
\naccident’;.Vnegligence*and liability of the insurer of the<\/p>\n
 V\u20aclliCl’3~,–~\u00ab’th\u20ac only point that remains for my<\/p>\n
V   in the appeal is:\n<\/p>\n
 lp’;Whether the quantum of<\/p>\n
_ ‘.c~o_rn=pensation awarded by the Tribunal is<\/p>\n
.. just and proper or does it call for
\n‘enhancement?\n<\/p>\n
   After hearing the learned Counsel for the parties<\/p>\n
 and perusing the award of the Tribunal, I am of the<\/p>\n
view that the compensation awarded by the Tribunal is
\nnot just and proper, it is on the lower side and therefore
\nit is deserved to be enhanced.\n<\/p>\n
7. The claimant has sustained the following\n<\/p>\n
i) Multiple small abrasions over  H

  sustained by him are evident from the<\/p>\n

  and 15, case sheet — Ex.P.13, scanning report —<\/p>\n
 EXP. 14 and supported by oral evidence of the claimant<\/p>\n
and doctor examined as P.Ws.1 and 2 respectively.<\/p>\n

P.W.2 — Dr. Edward Nazarath, an Orthopaedic Surgeon
\nhas stated in his evidence that the claimant has
\nsustained injuries indicated in the wound certi\ufb01cate.<\/p>\n
He has treated the claimant for the injuries…a1id_.io~1ir:d,<\/p>\n
claimant complains of difficulty in <\/p>\n
limb and there is limitation of  at ‘4<\/p>\n

awarded-byll’the_::’Tribnr1al -towards pain and suffering is
\non the “lower   deserved to be enhanced by<\/p>\n
apniother Rs.V'(3r~,..i_”)V:C)VO\/ and I award Rs.30,000\/– under this<\/p>\n

\n ‘V 9;  .1–:9,000\/– awarded by the Tribunal towards<\/p>\n
rriedioai expenses is as per medical bills produced by<\/p>\n
 .. the elaimant for Rs.l7,097.22 ps., the same is just and<\/p>\n
proper and there is no scope for enhancement under<\/p>\n

10. Claimant was treated as inpatient from 27-7-04 to
\n01~\u00ab08~0\u00e9i for a period of 5 days in A.J. Hospital,
\nMangalore. Considering the same, a sum of Rs.\u00a3..3,000\/–
\nis awarded towards incidental \u20acXp\u20acI1S\u20acS_\u00a2”~3″sjl;illt\u00a7l’}_vV as<\/p>\n
conveyance, nourishment and attendant c1′:arge’sLj   A<\/p>\n
11. Claimant claims to have.–bee–n  a_i’Sa1.es ‘ ; <\/p>\n
Executive in Airtel Mobile   <\/p>\n
Rs.3,500\/– per month arid”‘~Rs.1.,”500,’.:lj’permfhonth ash<\/p>\n
allowance and he hasV_supp’o1’te’dllti1e same”by’ examining
\nhis employer as ‘salary certificate<\/p>\n
at Ex.P.1Q;  gfibufifaai  the allowance of<\/p>\n
Rs.:1″:,A5O0\/~.VV  ‘ has rightiy considered his
\nincomeiati  month and considering the<\/p>\n
period vof.l’r’es,t______and treatment as six months, has<\/p>\n
‘ ;V’awar.ded_’\u00ab.Rs.._21,OOO\/ — towards loss of income during<\/p>\n
‘Kla’id up’v-period and there is no scope for enhancement<\/p>\n
under \u00abthis head.\n<\/p>\n
   Considering nature of injuries, disability stated by<\/p>\n
 the doctor and Certain amount of discomfort and<\/p>\n
unhappiness which the has to undergo in his future<\/p>\n
life, Rs.10,000\/- awarded by the Tribunal towards loss
\nof amenities is on the lower side and it is deservedpto be
\nenhanced by another Rs.5,000\/– and  <\/p>\n
15,000\/– under this head.\n<\/p>\n
13. Claimant is aged about  4’i\\i’fu1.tiplier if<\/p>\n
applicable to his age g’_r0\u00abs.,ip    vbthe’<\/p>\n
claimant is assessed at e’  month. The
\ndoctor has assessevdftlepdVi.se\u00a7.b:i.lit3r.V,%\u00a3QSGAJ to right upper
\nlimb and 150\/’gto  stated by
\nthe doctor   caused to the
\nwhole future loss of income

15. Accordingly the appeal is allowed in part and the
\nJudgment and award of the Tribunal is modified to the<\/p>\n
extent stated herein above. The claimant is entitledi\u00e9for<\/p>\n
a total compensation of Rs.l,30,840\/ <\/p>\n
