Commissioner (CPIO) &amp; Shri\n                                Satish Binder, SO)\n\nDate of Hearing          :      11.12.2009\nDate of Decision         :      11.12.2009\nFACTS<\/pre>\n<p>      By his RTI application dated 17.6.2008, the appellant had<br \/>\nrequested for information on 11 paras regarding various faciets of the<br \/>\nfunctioning of the Local Audit Office at Chandigarh. The CPIO had<br \/>\nresponded to it vide letter dated 23.6.2008 wherein he had asked the<br \/>\nappellant to deposit a sum of Rs. 6580\/- towards the fee. The FAA had<br \/>\naffirmed the decision of CPIO vide order dated 21.10.2008.\n<\/p>\n<p>2.    The present appeal is directed against the orders of the CPIO\/AA.\n<\/p>\n<p>3.    Heard on 11.12.2009. Appellant present. The public authority is<br \/>\nrepresented by the officers named above. It is the submission of Shri<br \/>\nKang that he has no objection to provide para-wise information to the<br \/>\nappellant if the appellant deposits the prescribed fee. He also fairly<br \/>\nsubmits that earlier the fee was calculated @ Rs. 10 per page but because<br \/>\nof revised instructions of Chandigarh Administration, the fee is now to<br \/>\nbe calculated @ Rs. 2 per page and, hence, the total fee payable by the<br \/>\nappellant now is Rs. 1306\/- only.\n<\/p>\n<p>4.    On the other hand, the appellant would submit that response to<br \/>\nsome of the paras is to be provided in &#8216;yes&#8217; or &#8216;no&#8217; format but no such<br \/>\ninformation has been provided to him. He would also submit that the<br \/>\ninformation has been unfairly denied to him on some of the paras and,<br \/>\ntherefore, penal action should be taken against the CPIO.\n<\/p>\n<p>                              DECISION\n<\/p>\n<p>5.    It is noted that the CPIO has no objection to provide para-wise<br \/>\ninformation to the appellant. He can not be faulted simply because he<br \/>\n asked for payment of requisite fee. However, in the peculiar facts and<br \/>\ncircumstances of the case, it is ordered that requisite para-wise<br \/>\ninformation may be provided to the appellant, free of cost.\n<\/p>\n<p>6.
