S.J. MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nmatters pertain to appointment to the post of Lecturers in Government<br \/>\nEngineering Colleges and Government Polytechnics.\n<\/p>\n<p>\tThe<br \/>\nappellants\/petitioners were appointed as adhoc Lecturers in<br \/>\nGovernment Engineering Colleges and Government Polytechnics over a<br \/>\nperiod of time from the year 1991 to 2002.  These appointments were<br \/>\ninitially made for 11 months with a rider that even prior thereto,<br \/>\ntheir services are liable to be terminated when regularly selected<br \/>\ncandidates through the process of selection by the Gujarat Public<br \/>\nService Commission [for short, GPSC] were available.  However, as<br \/>\nappointment of regularly selected candidates through the process of<br \/>\nselection by  GPSC were not made, the Lecturers appointed on adhoc<br \/>\nbasis were allowed to continue by extension of their adhoc<br \/>\nappointment, whereby their adhoc appointment continued over a period<br \/>\nranging from  8 years to 20 years.\n<\/p>\n<p>\tIn<br \/>\nMay\/June 2009, services of various Lecturers appointed on adhoc basis<br \/>\ncame to be terminated.  Many such Lecturers preferred writ petitions<br \/>\nfor continuation of their services till regular selection is made.<br \/>\nLearned Single Judge, by judgment and order dated 30.06.2009 disposed<br \/>\nof the writ petitions except two, viz. Special Civil Applications No.<br \/>\n5797 of 2009 and 5774 of 2009, directing the respondents to terminate<br \/>\nthe services of adhoc Lecturers and fill up the posts on regular<br \/>\nbasis.\n<\/p>\n<p>\tIn<br \/>\nthis background, LPAs have been preferred. The two writ petitions<br \/>\nwhich were not disposed of by the learned Single as stated above and<br \/>\nother writ petitions which were filed in the meantime, were all<br \/>\nordered to be heard together, and they are being disposed of by this<br \/>\ncommon order.\n<\/p>\n<p>\tIn<br \/>\nOctober 2009, a Civil Application being Civil Application No. 13093<br \/>\nof 2009 was filed on behalf of the State in the pending writ<br \/>\npetitions wherein two folded reliefs were sought for, viz:\n<\/p>\n<p>[i].\tExtension<br \/>\nof time for completing the process of section through GPSC, and,<\/p>\n<p>[ii].\tPermission<br \/>\nto fill up sanctioned posts by adhoc lecturers till GPSC selected<br \/>\ncandidates were available.\n<\/p>\n<p>\tLearned<br \/>\nSingle Judge allowed to continue the adhoc arrangement upto 31st<br \/>\nDecember 2010 and ordered to complete the process through GPSC.<br \/>\nSubsequently, time was sought for by the State Government and GPSC,<br \/>\nas large number of posts were required to be filled up.\n<\/p>\n<p>\tThe<br \/>\ncases were taken up on 24th March 2011. The matter was<br \/>\ndiscussed.  It was noticed that more than 2000 posts of Lecturers<br \/>\nwere vacant in various Government Engineering Colleges and Government<br \/>\nPolytechnics.  The State Government had taken steps for filling up<br \/>\nthe posts and the matter was pending with GPSC.\n<\/p>\n<p>\tIt<br \/>\nwas brought to the notice of the Court that in the absence of<br \/>\nlecturers, students were suffering in various Government Colleges and<br \/>\nPolytechnics.  In this background, after hearing the parties, the<br \/>\nfollowing order was passed by this Court on 24th March<br \/>\n2011:-\n<\/p>\n<p>&#8220;The<br \/>\nAppeal has been preferred against the judgment and order dated 8th<br \/>\nOctober 2009 passed by the learned Single Judge in Civil Application<br \/>\nNo.10773\/2009 in Special Civil Application No.5797\/2009. By the said<br \/>\norder the judgment and order dated 30th June 2009 passed<br \/>\nby the learned Single Judge in Special Civil Application No.5797\/2009<br \/>\nand cognate matters were further modified. The State Government was<br \/>\npermitted to fill up 908 posts of Lecturers in various Government<br \/>\nEngineering Colleges and Polytechnic Institutions for which the<br \/>\ndepartment had already undertaken the process for regular<br \/>\nappointment. The Court directed that appointment of 908 Lecturers of<br \/>\nEngineering Colleges and Polytechnics, who were appointed on<br \/>\nadhoc\/contractual basis and whose services were extended earlier by<br \/>\nway of one time measure as a special case, they should not be allowed<br \/>\nto continue after 31st December 2010.\n<\/p>\n<p>\tPursuant<br \/>\nto the said order, services of number of adhoc Lecturers have already<br \/>\nbeen terminated, who have preferred writ petitions and pending<br \/>\nconsideration. The writ petitions wherein interim direction was<br \/>\nissued, two of such writ petitions have been kept pending by the<br \/>\nlearned Single Judge. It is stated that the learned Single Judge is<br \/>\nmonitoring the cases to ensure that all adhoc Lecturers are removed<br \/>\nto accommodate the regular appointees.\n<\/p>\n<p>\tThe<br \/>\ncase was heard in detail and it came to the notice of the Court that<br \/>\neven after appointment of regular appointees, a large number of<br \/>\nteaching posts are lying vacant in different Degree and Diploma<br \/>\nEngineering Colleges. In absence of teaching staff, the students of<br \/>\nDegree and Diploma Engineering Colleges will suffer.\n<\/p>\n<p>\tFor<br \/>\nthe said reasons, this Court, vide order dated 18th<br \/>\nFebruary 2011 passed in Civil Application &#8211; For Stay<br \/>\nNo.1987\/2011, directed the respondent &#8211; State to provide the<br \/>\ndetails of number of posts as was occupied by adhoc teachers as on<br \/>\n1st December 2010 (subject wise), number of regular<br \/>\nvacancy as on 1st December 2010 (subject wise), including<br \/>\nthe posts occupied by adhoc teachers, number of persons appointed on<br \/>\nregular vacancies out of the last panel since 1st December<br \/>\n2008 (subject wise), number of vacancies of different posts (subject<br \/>\nwise) as on 18th February 2011, the time by which the<br \/>\nG.P.S.C. will finalise the common merit list and to obtain<br \/>\ninstructions whether any scheme can be framed by State Government to<br \/>\naccommodate the adhoc teachers against the remaining vacancies.\n<\/p>\n<p>\tPursuant<br \/>\nto the Courts&#8217; order, an affidavit has been filed on behalf of the<br \/>\nState from its Technical Education Department showing the details of<br \/>\nvacancies, etc. <\/p>\n<p>\tIt is<br \/>\ninformed that the State is facing difficulty in the appointment of<br \/>\nLecturers in Technical Colleges on account of recent amendment in the<br \/>\nRecruitment Rules, 2009. As per the said Rules, for the posts of<br \/>\nLecturer in Engineering or Technology Faculty, for the first time a<br \/>\npost-graduate degree with first class in the concerned branch of<br \/>\nengineering or a bachelor&#8217;s degree with first class in the concerned<br \/>\nbranch of engineering has been prescribed with valid GATE score.<br \/>\nFurther there is a requirement of score of 75 percentile.\n<\/p>\n<p>\tAs on<br \/>\ndate, the information of posts of Lecturers in Government Engineering<br \/>\nColleges and Government Polytechnics reflects total 3614 number of<br \/>\nsanctioned posts against which 1114 persons have been regularly<br \/>\nappointed. Altogether, 812 adhoc employees\/appointees are working at<br \/>\npresent and 1688 posts of Lecturers are still lying vacant as on 18th<br \/>\nFebruary 2011.\n<\/p>\n<p>\tLearned<br \/>\nGovernment Pleader appearing on behalf of the State submitted that<br \/>\nthere is no option, but in view of the impugned order passed by the<br \/>\nlearned Single Judge, they have taken steps to remove the adhoc<br \/>\nLecturers. It is accepted that if they are removed, there is no such<br \/>\nnumber of candidates at present in the merit list who can be<br \/>\nappointed against the vacancies including the vacancies as may be<br \/>\ncaused due to termination of services of the adhoc Lecturers.\n<\/p>\n<p>\tMr.D.G.Shukla,<br \/>\nlearned counsel appearing on behalf of the Gujarat Public Service<br \/>\nCommission submitted that for about 350 posts, interview has been<br \/>\ntaken and the list of candidates will be forwarded.\n<\/p>\n<p>\tTotal<br \/>\n2096 posts were advertised or the post advertised but could not be<br \/>\nfilled up because of non-availability of eligible candidates.\n<\/p>\n<p>\tFrom<br \/>\nthe stand taken by the parties and the record, it appears that out of<br \/>\n3614 sanctioned posts, steps were taken to fill-up about 2200 posts.<br \/>\nStill, there will be about 1400 number of sanctioned posts which will<br \/>\nremain vacant. If the adhoc Lecturers are removed immediately in view<br \/>\nof the order passed by the learned Single Judge, students of 16<br \/>\nEngineering Colleges (Degree level) and 26 Polytechnics (Diploma<br \/>\nlevel) will suffer, even if total posts are filled up as per present<br \/>\nadvertisement.\n<\/p>\n<p>\tIn<br \/>\nview of the aforesaid position and taking into consideration the<br \/>\ninterest of the students and the fact that the adhoc Lecturers are<br \/>\ncontinuing since 10 to 20 years, the following interim order is<br \/>\npassed for the present:-\n<\/p>\n<p>\tThe<br \/>\n\torder dated 8th October 2009 passed by the learned Single<br \/>\n\tJudge in Civil Application No.10773\/2009 in Special Civil<br \/>\n\tApplication No.5797\/2009 is stayed.\n<\/p>\n<p>\tThe<br \/>\n\trespondents are directed to fill up all posts which are already<br \/>\n\tadvertised, by regular appointment. We have noticed that a large<br \/>\n\tnumber of appointments have already been made but further<br \/>\n\tappointments are required to be made out of the recommendation as<br \/>\n\twill be made by GPSC.\n<\/p>\n<p>\tOn<br \/>\n\tsuch appointment of regular Lecturers, if so required, the adhoc<br \/>\n\tLecturers may have to be shifted from particular Degree\/Diploma<br \/>\n\tEngineering College to accommodate the regular appointees. In such<br \/>\n\tcase, the authorities will accommodate adhoc Lecturers against some<br \/>\n\tother posts for which no such advertisement has been issued, may be<br \/>\n\tin some other equivalent Degree\/Diploma Engineering College in any<br \/>\n\tdistrict.\n<\/p>\n<p>\tTill<br \/>\n\tthe posts are filled up by regular appointment, the adhoc Lecturers<br \/>\n\tbe not disturbed.\n<\/p>\n<p>\tThose<br \/>\n\tadhoc Lecturers whose services have been terminated in view of the<br \/>\n\torder passed by the learned Single Judge, if there is no allegation<br \/>\n\tor departmental proceedings pending against them, they be<br \/>\n\taccommodated on adhoc basis in one or other equivalent standard<br \/>\n\tDegree\/Diploma Engineering College in any of the district of the<br \/>\n\tState, against the posts which are not yet been advertised. If there<br \/>\n\tis no post to accommodate, in that case, their services may be<br \/>\n\tterminated.\n<\/p>\n<p>\tWe<br \/>\nmake it clear that the adhoc Lecturers have no right to continue<br \/>\nagainst any particular post. They will have to make a room as and<br \/>\nwhen the posts will be filled up on regular basis.\n<\/p>\n<p>\tCivil<br \/>\nApplication stands disposed of with the aforesaid observation and<br \/>\ndirection.\n<\/p>\n<p>\tPost<br \/>\nthe Appeal along with Special Civil Application Nos.5797\/2009 and<br \/>\n5774\/2009 on 27th April 2011.\n<\/p>\n<p>\tPendency<br \/>\nof this case shall not stand in the way of the State to frame any<br \/>\nscheme to relax the age and to select the qualified and experienced<br \/>\nadhoc Lecturers through any limited competitive examination.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.&#8221;\n<\/p>\n<p>\tSubsequently,<br \/>\nthis Court monitored the matter.Some selections have been made by<br \/>\nGPSC and they were allowed to recommend names of successful<br \/>\ncandidates to ensure that posts are filled up on regular basis.<br \/>\nThus, certain selections have been made, names have been recommended<br \/>\nand appointments have been made, but all posts could not be filled<br \/>\nup.  In this background, it was decided to allow GPSC to complete the<br \/>\nprocess in accordance with law to ensure that all posts are filled up<br \/>\non regular basis.\n<\/p>\n<p>\tOn<br \/>\nmerits, we do not find any justification to regularize any one or the<br \/>\nother adhoc lecturers against regular posts for two reasons, viz:\n<\/p>\n<p>[i].\tThey<br \/>\nwere not appointed after following the procedure for appointment.\n<\/p>\n<p>[ii].\tTheir<br \/>\ncontinuation in service for number of years do not cloth them with<br \/>\nany right to regularization as they were appointed with open eyes<br \/>\nthat their appointments were adhoc in nature till regular<br \/>\nappointments are made through GPSC.\n<\/p>\n<p>\tWe<br \/>\nhave noticed that many of the adhoc appointees have crossed the age<br \/>\nlimit and may not be eligible for consideration for appointment on<br \/>\nregular basis and therefore, they could not take part in the recent<br \/>\nselection.  Having noticed such situation, we have already given<br \/>\nliberty to the respondents to frame a scheme for them, if the State<br \/>\nso intends.\n<\/p>\n<p>\tWe<br \/>\nhave also noticed that pursuant to the directions issued by this<br \/>\nCourt, GPSC has completed the process of selection and has already<br \/>\nrecommended names of 1007 candidates.  However, even after such<br \/>\nrecommendation, 1106 posts are vacant for which again a fresh<br \/>\nselection process should start after requisition by the State.\n<\/p>\n<p>\tIn<br \/>\nthe circumstances, we direct the State Government to take steps to<br \/>\nfill up the remaining 1106 vacant posts, and any other vacancies that<br \/>\nmay have arisen, of lecturers in Government Engineering and<br \/>\npolytechnic colleges. The State shall forward its requisition to GPSC<br \/>\non an early date.  Till such regular appointments are made, the<br \/>\nrespondents shall continue the interim arrangement as ordered by this<br \/>\nCourt in its order dated 24th March 2011.\n<\/p>\n<p>\tIt is<br \/>\ninformed that names of some of the candidates are in the waiting<br \/>\nlist.  If that be so, GPSC will forward the names of such candidates<br \/>\nwho are in the waiting list to fill up the vacancies, preferably<br \/>\nwithin one month from the date of receipt of copy of this order.\n<\/p>\n<p>\tIn<br \/>\nthis background, we dispose of all the appeals, writ petitions and<br \/>\ncivil applications with the above observations and directions.
