  had obtained loan of Rs.8 lakhs from the<\/p>\n
 2nd respondent. Since the same has not been repaid<\/p>\n

   dispute before the Assistant Registrar of Cooperative<\/p>\n

Societies u\/s 70 of the Karnataka Cooperative Societies<\/p>\n
Act. The same came to be allowed by  S<\/p>\n
directing the petitioner to pay Rs.8,93, <\/p>\n
interest at 18%. Being aggrieved;.’petitiori.erVV ‘ S. <\/p>\n
preferred appeal before   <\/p>\n
Tribunal in Appeal  v_vhi.ch;  to be\u00bb<\/p>\n

\nthat  by the Karnataka
\nAppeilate  -setting aside the order passed
\nby the  of Cooperative Societies.<\/p>\n
 after \u00abremand, the first respondent has not<\/p>\n
‘Vaffordved~i ;’op’portunity to the petitioner and his<\/p>\n
‘s.L.ibrnissio’1i..that the amount paid by him on different<\/p>\n
 occasions running to several lakhs has not been taken<\/p>\n
A 5  by the second respondent. He has produced some<\/p>\n
 r\u00e9eceipts Annexures~B to D to show that he has paid<\/p>\n

substantial amount. He has also produced bill for<\/p>\n
having paid Rs.9 lakhs dated 30.11.1994 andxdaniother<\/p>\n
bili for Rs} Iakh dated 4.3.1995. But.m’the\u00e9\u00e9g’e-..\u00e9 <\/p>\n
payments have not been co_ns.idered’V  <\/p>\n
Hence the petitioner has prayed   <\/p>\n

4. The learnedCouxfiseiior  submits that
\nas per the?_:   the Karnataka
\nAppeliatei    1995 notices have
\nbeenhissuedvd\u00bbVtci:’:-theL4pe.ti’t–ioner by the A R CS but the
\nsame  claimed. Therefore, the ARCS<\/p>\n
 ‘th\u20ac=..__sa-me in the order sheet and held that<\/p>\n
‘ service'”isf.sufficient. Notwithstanding the same, one<\/p>\n
“more not’i.ce..5’was issued on 29.6.1999. The same was<\/p>\n
 served on’ the petitioner and in response. he engaged an<\/p>\n
A  adifocate. The learned advocate made a request for<\/p>\n
1  adjournment to file objections. Accordingly on several<\/p>\n

 not participated in the proceedings by<\/p>\n
 filing objections and also appearing in the case. Hence<\/p>\n
