Appeal<br \/>\nno.13\/2009 by which the appeal preferred against the order<br \/>\nAnnexure P\/5 was dismissed.\n<\/p>\n<p>          Both the Courts below recorded concurrent findings in the<br \/>\ncase and have found that the petitioner failed to make out a prima<br \/>\nfacies case, balance of convenience, irreprable loss in his favour<br \/>\nand rejected the application, filed by the plaintiff for issuance of<br \/>\ntemporary injunction during the pendency of the suit.\n<\/p>\n<p>          On 20.7.2010, while issuing notices in the petition, we<br \/>\ndirected that respondents shall maintain status quo as on today in<br \/>\nrespect of the disputed land          and shall not raise any further<br \/>\nconstruction over the land without seeking prior permission of this<br \/>\nCourt..\n<\/p>\n<p>          The learned counsel for the respondents submitted that the<br \/>\nconstruction is complete and in case any further construction is<br \/>\nraised, the respondents shall seek permission of the Court before<br \/>\nraising such construction.\n<\/p>\n<p>          In view of the aforesaid, this petition is finally disposed of<br \/>\nwith following directions:\n<\/p>\n<blockquote><p>             (I) The ad interim writ issued on 20.7.2010 to continue<br \/>\n                for a further period of six months from today.<\/p><\/blockquote>\n<pre>\n                         WP No.9004\/2010\n\nBal Kishan Agrawal                       Vinay Kumar Jain\n\n\n\n\n<\/pre>\n<blockquote><p>         (II) In the meantime, the trial Court shall make an<br \/>\n            endeavour to decide the suit expeditiously.<br \/>\n      No order as to cost..<\/p><\/blockquote>\n<pre>\n\n\n      (Krishn Kumar Lahoti)                  (J.K.Maheshwari)\n             Judge                               Judge\n\n\n\nJLL\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Balkishan Agarwal vs Vinay Kumar Jain on 18 August, 2010 WP No.9004\/2010 Bal Kishan Agrawal Vinay Kumar Jain 12.8.2010.
