Petitioners.\n                                        Versus\n                            THE STATE OF BIHAR\n                                     -----------\n<\/pre>\n<p>2.     01.12.2010                 Having heard Mr. Ashutosh Kumar, learned<\/p>\n<p>                         counsel for the petitioners and Mr. Rashid Izhar, learned<\/p>\n<p>                         counsel for the informant as with regard to the prayer<\/p>\n<p>                         made in this application for modification \/ clarification of<\/p>\n<p>                         the earlier order dated 23.2.2010 in Cr. Misc. No. 1847 of<\/p>\n<p>                         2010, this Court is of the considered opinion that such<\/p>\n<p>                         prayer is wholly misconceived inasmuch as the petitioners<\/p>\n<p>                         themselves have not given the clear undertaking as was<\/p>\n<p>                         envisaged in the said order.\n<\/p>\n<p>                                   The petitioners were infact supposed to give<\/p>\n<p>                         their clear undertaking for being released on bail that<\/p>\n<p>                         whatsoever had been incorporated in Condition No. 2 of<\/p>\n<p>                         their agreement dated 18.10.2009, will be complied by<\/p>\n<p>                         them without fail. This Court does not understand the<\/p>\n<p>                         reservation of the petitioners or the objection of the<\/p>\n<p>                         informant as with regard to decision of Emarat-e-Sariya<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>inasmuch as the said part of the condition is only with<\/p>\n<p>regard to custody of the child. So far the agreement<\/p>\n<p>between the parties about fulfilment of depositing of the<\/p>\n<p>amount is concerned, it is unequivocal that whatever<\/p>\n<p>amount was sent by the informant in the name of his wife,<\/p>\n<p>the same had to be deposited in the name of child of the<\/p>\n<p>informant. Infact if computation of such amount had<\/p>\n<p>already been made by the police in course of investigation<\/p>\n<p>as is claimed have been done so by Mr. Rashid Izhar, the<\/p>\n<p>petitioner had to only deposit the same in the name of the<\/p>\n<p>child of the informant and file their undertaking before the<\/p>\n<p>court below for being enlarged on bail.\n<\/p>\n<p>          That being so, this Court would give one more<\/p>\n<p>indulgence to the petitioners to comply the order of this<\/p>\n<p>Court dated 23.2.2010, within a period of eight weeks<\/p>\n<p>from the date of receipt\/production of a copy of this order.<\/p>\n<p>          Let it be however made clear that this would be<\/p>\n<p>the last and final extension of time and if the petitioners<\/p>\n<p>for whatsoever reasons would not comply the order of this<\/p>\n<p>Court dated 23.2.2010 in letter and spirit, they would not<\/p>\n<p>be entitled for grant of anticipatory bail.<\/p>\n<p>          With    the   aforementioned        observation   and<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>          direction, this application is disposed of.<\/p>\n<p>                    Let a copy of this order be sent to the court<\/p>\n<p>          below through FAX if its cost is deposited by the<\/p>\n<p>          petitioners.\n<\/p>\n<\/p>\n<pre>Kanchan                        ( Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Hamid Akhtar Khan &amp;Amp; Ors vs The State Of Bihar on 1 December, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
