Justice P.BHAVADASAN\n\n Dated :05\/01\/2010\n\n O R D E R\n<\/pre>\n<p>                      P.BHAVADASAN, J.\n<\/p>\n<p>                 &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>                     AS No.871 OF 1997-E\n<\/p>\n<p>                 &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                    Dated 5th January 2010<\/p>\n<p>                               Order<\/p>\n<p>     The defendant in OS No.257\/90, who suffered decree<\/p>\n<p>for money, based on promissory note, is the appellant. The<\/p>\n<p>parties and facts are hereinafter referred to, as they were<\/p>\n<p>available before the Court below.\n<\/p>\n<p>     2. The plaintiff laid the suit for a sum of Rs.30,000\/-,<\/p>\n<p>based on Ext.A1 promissory note dated 24.04.1987. As<\/p>\n<p>per   the  plaint   allegation,       the     defendant  borrowed<\/p>\n<p>Rs.30,000\/-, promising to repay it within a stipulated<\/p>\n<p>period. Pointing out that the amount was not paid, the suit<\/p>\n<p>was laid.\n<\/p>\n<p>     3. The defendant, as usual, took all possible<\/p>\n<p>contentions to resist the suit, including denial of execution<\/p>\n<p>of promissory note. He also raised the plea of material<\/p>\n<p>alteration. Based on the pleadings, necessary issues were<\/p>\n<p>raised by the Court below. Evidence consists of the<\/p>\n<p><span class=\"hidden_text\">AS 871\/97                        2<\/span><\/p>\n<p>testimonies of PWs 1 and 2 and Exts.A1 to A4 from the<\/p>\n<p>plaintiff&#8217;s side. From the side of defendants, Exts.B1 to<\/p>\n<p>B6 were marked and DW1 was examined. On the basis<\/p>\n<p>of the materials before it, the Court below held that the<\/p>\n<p>plaintiff has succeeded in establishing that the amount<\/p>\n<p>was actually paid to the defendant on the basis of a<\/p>\n<p>promissory note. The suit was accordingly decreed. The<\/p>\n<p>Judgment and the decree are assailed in this appeal.<\/p>\n<p>     4. The question which arises for consideration in this<\/p>\n<p>appeal is whether any interference by this Court is called<\/p>\n<p>for with the order of the Court below.\n<\/p>\n<p>     5. It is unnecessary to go into the facts of the case<\/p>\n<p>for the reason that money was paid on the basis of a<\/p>\n<p>promissory note. The defendant would say that the<\/p>\n<p>signature found on the promissory note does not belong<\/p>\n<p>to him.     The Court below perused and compared the<\/p>\n<p>signature of the defendant found in the promissory note<\/p>\n<p>with his available admitted signatures in the deposition,<\/p>\n<p>summons, written statement etc. and held that the<\/p>\n<p><span class=\"hidden_text\">AS 871\/97                         3<\/span><\/p>\n<p>promissory note was, in fact, executed by the defendant<\/p>\n<p>himself. The Court below was also of the view that since<\/p>\n<p>the defendant was a businessman, he would be aware of<\/p>\n<p>the consequences of signing any blank document. It is<\/p>\n<p>also found that it is supported by consideration. On a<\/p>\n<p>perusal of the testimonies of PWs 1 and 2, it can be seen<\/p>\n<p>that the defendant did execute the promissory note for<\/p>\n<p>Rs.30,000\/-.\n<\/p>\n<p>      6. It was submitted by the learned counsel for the<\/p>\n<p>appellant that the signature of the appellant in the<\/p>\n<p>promissory note was verified by comparison by the Court<\/p>\n<p>and that is not proper and legal. It must be noticed that<\/p>\n<p>the genuineness of the promissory note was found by the<\/p>\n<p>Court below, not solely based on the comparison of<\/p>\n<p>signatures, but also taking into consideration, other<\/p>\n<p>materials as well, which were brought out in evidence.<\/p>\n<p>S.73 of the Indian Evidence Act enables the Court to do<\/p>\n<p>so. It is significant to notice that if he had not executed<\/p>\n<p>the promissory note, he would have responded to the<\/p>\n<p><span class=\"hidden_text\">AS 871\/97                        4<\/span><\/p>\n<p>notice issued by the plaintiff, which was admittedly<\/p>\n<p>received by him. The documents produced by the<\/p>\n<p>defendant throw no light in the controversy involved in the<\/p>\n<p>suit. He claimed that he had documents to show that he<\/p>\n<p>had borrowed the amount. But, there are no materials<\/p>\n<p>produced by him to show that what he claims is true.<\/p>\n<p>Therefore, the Court below is perfectly justified in<\/p>\n<p>decreeing the suit.
