2.1 The esseintiai facts of the case arising in this appeal with

plaintit'f~appellant being a Government of Karnataka<\/p>\n
 ' .__VUndertali<ing, holding both mining and minerals and accordingly,<\/p>\n
V'<\/p>\n
the Department of Mines and Geology has granted the Minirigu<\/p>\n
bearing ML No.1659 in respect of land bearing <\/p>\n
measuring 127.78 acres (51.71 hectares]..of__Jan:hunatha,naT:ialli'-_ <\/p>\n
village for a period of 20 years with effect from<\/p>\n
application for renewal of the said: lease '\ufb01led by p.l,aiVntiff–l<\/p>\n
appellant is still pending.<\/p>\n
\n2.2 It is averred that the  herein has<\/p>\n
been granted mining,   towards eastern
\nside of the suit    defendant having evil
\neye on the plvairivtiflllsefllealseghoidlp “intends to remove iron ore
\nillegally. on:’…s.11.2.oo4’i’;- when the defendant
\nCompany had actuiallyvmadell i.l:legr:a’l.’evattempts to remove the iron ore,
\nthevyplaintiffiappellant’  constrained to \ufb01le complaint to that
\n  is bent upon to encroach over the suit<\/p>\n
schedule ‘pjrop’\u20acvrt3ty,iV’anld’remove the iron ore, the plaintiff has \ufb01led<\/p>\n
the present \u00a7’uit.\u00ab–l”‘for permanent injunction restraining the<\/p>\n

2.4. The trial court, framed appropriate issues. On belllalfiof<\/p>\n
the plaintiff, P.Ws 1 and 2 were examined and Exhibits 19:1. if <\/p>\n
were marked. On behalf of the defendant, D.W.1 <\/p>\n
and Exhibits D.1 to D.18 were marked.\n<\/p>\n
2.5. The trial court, afteriicorlsidering .

\nheld that the plaintiff has   p1*o{re.ig’vinterference by the
\ndefendant and the plaintiff  fact viz.,<\/p>\n
that the plaintiff   had m:_ad._el”an”app1ication seeking<\/p>\n
permission for    the common boundary
\nunder Regulat?_ion’- 1 1   and a Memorandum of
\nUnderstanding  “1:-eeri  into between the plaintiff and
\ndefendant i16..7.2iOC)4..i_anld that under the Agreement the plaintiff
\nhas defendant to enter the plaintiffs leased area to<\/p>\n
put   plaintiff has failed to prove interference by<\/p>\n
 defendant, V._di’srniissed the suit.\n<\/p>\n
A “ii3..p j\u00e9eing aggrieved by the dismissal of the suit by the trial<\/p>\n
i”  plaintiff preferred R.A. No.36 \/ 2007 and the appellate court,<\/p>\n
\\><\/p>\n
by Judgment dated 12.4.2007 dismissed the appeal con\ufb01rmingtlie<\/p>\n
Judgment and decree passed by the trial court.<\/p>\n
4. The appellant being aggrieved by the .thex:i<\/p>\n

6. The learned counsel for   vstlzbmitted that the
\ncourts below withoutidconsideiringtt  zmd documentary
\nevidence in its proper  h’ave’v’_hel.d that the plaintiff-<\/p>\n
appellant has failiedlbto Ti3pro\u00abve.inter{erence by the defendant.
\nTherefore, theidudgment passed by the courts below<\/p>\n
are liable to set aside! 2 <\/p>\n

8. We have given careful consideration to the contentionsofg\u00e9<\/p>\n
the learned counsel appearing for the parties and  ‘<\/p>\n
material on record. I  _<\/p>\n
9. The material on record clearly  ‘of
\nplaintiff in OS. No.225\/ 2004 was  plermanerit
\nagainst the defendanbrespondent  grour1d..v’that the
\ndeferidanbrespondent is trying’ the mining area
\nleased to the p1aintiff–appellant    out mining
\nwork illegally. The   ilsiibstantiated in the
\nevidence. P.W.  make himself available
\nfor cross–exair1inat.ioln;v.”and’itheplairltiff was left with the evidence
\nof P.W.2 alone;  statement. Further, both
\nthe courts helovv haverightly that the plaintiff has suppressed
\ntkieln1at&erial’fa,ct viz… the factithat the plaintiff and the defendant<\/p>\n
