DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/07\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tHeard<br \/>\nlearned advocates for the parties.\n<\/p>\n<p>\tHaving<br \/>\nargued the case for some time, learned advocate for the<br \/>\npetitioners\/original defendants submits that there appears to be<br \/>\ndispute about the title and the petitioners are in possession of the<br \/>\nland in question by virtue of sale deed, deserves to be adjudicated<br \/>\nas early as possible.\n<\/p>\n<p>\tLearned<br \/>\nadvocate appearing for the respondent\/original plaintiff has no<br \/>\nobjection if suitable directions is given by this Court.\n<\/p>\n<p>\tConsidering<br \/>\nthe facts and circumstances of the case and dispute is pertaining to<br \/>\nland, for which, a sale deed was executed as early as in 1980 by the<br \/>\nfather of the defendants but the plaintiff has relied on certain<br \/>\nrevenue entries and partition document in her favour along with<br \/>\nconcession given on earlier occasion by the father of the defendants.\n<\/p>\n<p>\tWithout<br \/>\nexpressing any opinion on merit of rival contentions and in view of<br \/>\nlearned advocates to decide the suit as early as possible, the trial<br \/>\ncourt is directed to decide the suit as expeditiously as possible and<br \/>\npreferably within 12 months from the date of receipt of the order of<br \/>\nthis Court.\n<\/p>\n<p>\tWith<br \/>\nthe aforesaid, this petition is disposed of.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[ANANT<br \/>\nS.
