Justice S.S.SATHEESACHANDRAN\n\n Dated :15\/01\/2010\n\n O R D E R\n                   S.S.SATHEESACHANDRAN, J.\n                   -----------------------------------\n                   W.P.(C).No.1439 of 2010 - O\n                   ---------------------------------\n            Dated this the 15th day of January, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>     Writ petition is filed seeking the following reliefs:<\/p>\n<p>             &#8220;i)    To call for the record leading to Exhibit<\/p>\n<p>        P4 order and set aside the same.\n<\/p>\n<p>             ii)    To stay all proceedings pursuant to<\/p>\n<p>        Exhibit P4 order pending final disposal of the above<\/p>\n<p>        writ petition.&#8221;\n<\/p>\n<p>     2.   Petitioner is a third party to a suit in which the court<\/p>\n<p>has passed an order directing police assistance to the advocate<\/p>\n<p>commissioner to facilitate the measuring out of the suit property.<\/p>\n<p>The commissioner has filed an interim report before the court<\/p>\n<p>stating that on his second visit a fencing was seen made in the<\/p>\n<p>property which was not in existence earlier causing obstruction to<\/p>\n<p>the measuring out of the property. In the light of the interim<\/p>\n<p>report, plaintiff applied for providing police assistance to the<\/p>\n<p>commissioner and also for removing of the fence to facilitate the<\/p>\n<p>execution   of    the    commission      order     by  the advocate<\/p>\n<p>commissioner.     The court after hearing both sides passed an<\/p>\n<p>W.P.(C).No.1439 of 2010 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>order directing for assistance by the police to the commissioner<\/p>\n<p>for executing the commission order, and, also, if necessary, by<\/p>\n<p>removing the fence to the extent required for executing the<\/p>\n<p>commission order. A typed copy of that order has been produced<\/p>\n<p>as Ext.P4.      Propriety and correctness of Ext.P4 order is<\/p>\n<p>challenged by the petitioner invoking the supervisory jurisdiction<\/p>\n<p>vested with this Court under Article 227 of the Constitution of<\/p>\n<p>India.\n<\/p>\n<p>     3.     I heard the counsel for the petitioner.\n<\/p>\n<p>     4.     Petitioner submits that though she is not a party to the<\/p>\n<p>proceedings she is injuriously affected by P4 order passed by the<\/p>\n<p>court below. It is seen that the suit is instituted as early in 2001<\/p>\n<p>and the advocate commissioner appointed by the commissioner<\/p>\n<p>had conducted local inspection previously as well. At that point<\/p>\n<p>of time as per the statement made in P4 order of the court there<\/p>\n<p>was no fence at all. The fence came into existence according to<\/p>\n<p>the commissioner at a later point of time. In that circumstance<\/p>\n<p>to facilitate the execution of commission order, it seems, the<\/p>\n<p>court has passed Ext.P4 order.         If the petitioner has any<\/p>\n<p>W.P.(C).No.1439 of 2010 &#8211; O<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>grievance against Ext.P4 order, she can approach the court below<\/p>\n<p>and seek leave of the court for being heard in the matter and<\/p>\n<p>needless to point out if grievance espoused by the petitioner has<\/p>\n<p>any merit the court has to pass appropriate orders thereof in<\/p>\n<p>accordance with law.       Writ jurisdiction cannot be invoked to<\/p>\n<p>challenge Ext.P4 order.\n<\/p>\n<p>     Writ petition lacks merit, and it is dismissed.
