By
\n\tway of present appeal, the appellants have inter alia prayed for
\n\tquashing and setting aside the judgment and order dated 14th
\n\tSeptember 2009 passed by the Chamber Judge, City Civil Court No.23,
\n\tAhmedabad, in Civil Suit No.805 of 2009, below application Exh.6\/7.\n<\/p>\n
When
\n\tthis appeal came up for hearing on 23rd June 2010, this
\n\tCourt passed the following order :\n<\/p>\n
“1.0\tLearned
\nadvocate Mr. Shah for the appellants states that as the advocate
\nengaged by the present appellants returned the papers to the
\nappellants after order dated 5th April 2010, the
\nappellants could not file application as was contemplated by order
\ndated 8th February 2010, relevant part of which, reads as
\nunder:\n<\/p>\n
“In
\nthe above view of the matter, the learned counsel for the appellants
\nis permitted to raise this objection before the Trial Court because
\nthe objection goes to the root of the matter and relates to the very
\nfoundation of the suit before the Court which has issued injunction.\n<\/p>\n
\tThe
\npresent Appeal from Order is kept pending and the Trial Court
\nconcerned is directed to entertain the application of the appellants
\nand decide the same after affording opportunity to the respondents.”\n<\/p>\n
\t2.0\tBy
\norder dated 5th April 2010, the Registry was directed to
\ncall for the report from the learned Judge, City Civil Court, so as
\nto reach this Court on or before 21st April 2010.  S. O to
\n22nd April 2010.\n<\/p>\n
\t2.1\tIt
\nis pointed out that the Report is received from the learned Judge and
\nthe relevant part of it, reads as under:\n<\/p>\n
“With
\nreference to the subject noted above, I have the honour to state that
\nthis Court was directed to entertain the application of the
\nappellants and to decide same after affording opportunity to the
\nrespondents within two weeks by Hon’ble High Court of Gujarat’s Order
\ndated 08\/02\/2010 of which H.C. Writ No. 283\/2010 was received on
\n11-02-2010 and thereafter matter was lastly kept on 09\/03\/2010.  This
\nmatter was placed on board on 19-02-2010, 22-02-2010 & 23-02-2010
\nbut defendants \/ appellants have not preferred to file any
\napplication as to objection regarding jurisdiction and therefore,
\nthis Court had proceeded to hear the learned Advocates for respective
\nparties.  The defendants did not wanted to file application raising
\nobjection as to jurisdiction and they have admitted the jurisdiction
\nof this Court.  Hence, I heard the both the side advocates and passed
\nfurther order on 25-02-2010 below N.M. Exhibit 6\/7.  A simple copy of
\nsaid order is attached herewith for your Honours reference.\n<\/p>\n
 \t3.0\tThe
\nlearned advocate Mr. Shah for the appellants seeks three
\nweeks’ time to put his house in order.  The request is granted.”\n<\/p>\n
Thus,
\n\tin view of the aforesaid order as well as the report dated 19th
\n\tApril 2010 forwarded by the concerned learned Judge, it transpires
\n\tthat the appellants have not chosen to prefer any application before
\n\tthe trial Court.\n<\/p>\n
Having
\n\tconsidered the contentions raised by the learned advocate for the
\n\tappellants, contentions raised in the appeal and on perusal of the
\n\timpugned order, it transpires that the observations made by the
\n\ttrial Court are just and proper. Hence, it will not be appropriate
\n\tto entertain present appeal at this stage.\n<\/p>\n
For
\n\tthe foregoing reasons, present appeal fails and is, accordingly,
\n\tdismissed. Notice is discharged with no order as to costs.
\n\tConsequently, the Civil Application also stands disposed of.
\n\tIt is, however, clarified that the said observations made by the
\n\ttrial Court in the impugned order are tentative in nature and will
\n\tnot come against the appellants in future.\n<\/p>\n
 \t\tIt
\n\tis further clarified that if an application is moved by the
\n\tappellants before the trial Court for expediting the suit
\n\tproceedings, the trial Court will consider the same.\n<\/p>\n
