(Orthapatics) and Diploma in Orthopaedics at G.R.Medical<br \/>\nCollege, Gwalior under Jiwaji University with effect from 1981 and<br \/>\n1980, respectively, and the Central Government by a notification has<br \/>\nrecognised the aforesaid courses. It is submitted that a notification<br \/>\nhas been issued on 18.3.2011 in this regard, which is filed alongwith<br \/>\nreturn as Annexure-II. That this petition has rendered infructuous and<br \/>\nmay be dismissed accordingly.\n<\/p>\n<p>      Shri Samdarshi Tiwari, learned GA submitted that the students<br \/>\nwho have already passed the courses from G.R.Medical College,<br \/>\nGwalior may also be extended benefit of this notification.\n<\/p>\n<p>      Learned counsel for petitioner also submitted that the<br \/>\npetitioner be given same benefit and the Medical Council of India be<br \/>\ndirected to register the petitioner as registered medical practitioner<br \/>\nwith M.S.degree.\n<\/p>\n<p>      From the perusal of the notification, we find that the<br \/>\nGovernment of India, Ministry of Health &amp; Family Welfare, New Delhi<br \/>\nvide notification dated 18.3.2011 has directed for amendment in the<br \/>\nfirst schedule of the Indian Medical Council Act, 1956 in respect of<br \/>\ncertain courses run by Jiwaji University. For ready reference, we<br \/>\nquote aforesaid notification which reads as under:-\n<\/p>\n<p><span class=\"hidden_text\">                                                                               2<\/span><\/p>\n<p>                    W.P.No.9196\/09<\/p>\n<p>Dr.Rajeev Dalela                                 State of M.P. &amp; others<\/p>\n<p>5.4.2011<br \/>\n                              &#8220;Government of India<br \/>\n                       Ministry of Health &amp; Family Welfare<br \/>\n                   (Department of Health and Family Welfare)<br \/>\n                                                    Nirman Bhavan, New Delhi<br \/>\n                                                    Dated the 18th March 2011<br \/>\n                                 NOTIFICATION<br \/>\n        S.O&#8230;&#8230; In exercise of the powers conferred by sub-section (2) of the<br \/>\nsection 11 of the Indian Medical Council Act, 1956 (102 of 1956), the<br \/>\nCentral Government, after consulting the Medical Council of India, hereby<br \/>\nmakes the following further amendments in the First Schedule to the said<br \/>\nAct, due to change of nomenclature of the qualification namely:-<br \/>\nIn the said Schedule-\n<\/p>\n<p>a)      against &#8220;Jiwaji University&#8221; under the heading &#8216;Recognised Medical<br \/>\nQualification&#8217; [hereinafter referred to as column (2)], after the last entry and<br \/>\nentry ralating thereto under the heading &#8216;Abbreviation for Registration&#8217;<br \/>\n[hereinafter referred to as column (3), the following shall be inserted,<br \/>\nnamely:-\n<\/p>\n<pre>                   (2)                                    (3)\n\"Master of Surgery (Orthopaedics)\"      MS(Ortho.)\n                                        (This shall be a recognised medical\n<\/pre>\n<p>                                        qualification when granted by Jiwaji<br \/>\n                                        University in respect of students<br \/>\n                                        being trained at G.R. Medical<br \/>\n                                        College, Gwalior, Madhya Pradesh<br \/>\n                                        on or after 1981.\n<\/p>\n<p>&#8220;Diploma in Orthopaedics&#8221;               D.Ortho.\n<\/p>\n<p>                                        (This shall be a recognised medical<br \/>\n                                        qualification when granted by Jiwaji<br \/>\n                                        University in respect of students<br \/>\n                                        being trained at G.R. Medical<br \/>\n                                        College, Gwalior, Madhya Pradesh<br \/>\n                                        on or after 1980.\n<\/p>\n<p>Note to all:1. As aforesaid courses<br \/>\n     have been recognized in view of the notification dated 18.3.2011, we<br \/>\n     find that the relief prayed by the petitioner has already been granted<br \/>\n     by the respondents and this petition has rendered infructuous.<br \/>\n     However, respondents shall give effect to the notification and extend<br \/>\n     benefit of the notification to all the concerned including the students<br \/>\n     who have passed the courses within the aforesaid period.\n<\/p>\n<p>            With the aforesaid directions, this petition is disposed of finally<br \/>\n     with no order as to costs.\n<\/p>\n<p>            A copy of this order be sent to the G.R.Medical College,<br \/>\n     Gwalior for information and necessary action.\n<\/p>\n<p>            C.C. as per rules.<\/p>\n<pre>\n\n\n     (Krishn Kumar Lahoti)                      (Smt.Sushma Shrivastava)\nC.
