(Oral)\n<\/pre>\n<p>CRM 57927 of 2008<\/p>\n<p>            This application has been filed under Section 482, Code of<\/p>\n<p>Criminal Procedure, with a prayer that the main case (Criminal Revision<\/p>\n<p>No.2579 of 2008) be taken up for hearing today. The other prayer made is<\/p>\n<p>that impugned judgment dated 26.7.2006, passed by the trial court and<\/p>\n<p>judgment dated 26.11.2008, passed by the appellate court, be set aside in<\/p>\n<p>view of the fact that the disputes have been settled and the offence is<\/p>\n<p>compoundable under Section 147 of the Negotiable Instruments Act, 1881.<\/p>\n<p>            The complainant has already been paid the cheque amount to<br \/>\n<span class=\"hidden_text\"> Criminal Rev.2579 of 2008 (O&amp;M)                                2<\/span><\/p>\n<p>his entire satisfaction.\n<\/p>\n<p>             The application is allowed.\n<\/p>\n<p>             Main case (Criminal Revision No.2579 of 2008) is taken up<\/p>\n<p>for hearing, with the concurrence of both the sides.<\/p>\n<p>Criminal Revision No.2579 of 2008<\/p>\n<p>             Sub Divisional Judicial Magistrate, Khanna, vide judgment<\/p>\n<p>dated 26.7.2006 convicted petitioner No.1\/accused for committing an<\/p>\n<p>offence under Section 138 of the Negotiable Instruments Act, 1881 (for<\/p>\n<p>short &#8216;the Act&#8217;).     Vide order of sentence of even date, petitioner<\/p>\n<p>No.1\/accused has been sentenced to rigorous imprisonment for 2 years<\/p>\n<p>with fine of Rs.5,000\/-; in default of payment of fine to undergo simple<\/p>\n<p>imprisonment for six months.       A sum of Rs.30,000\/- has also been<\/p>\n<p>awarded as compensation to be paid to the complainant; in default of<\/p>\n<p>payment of compensation, to undergo simple imprisonment for three<\/p>\n<p>months.\n<\/p>\n<p>             An appeal was carried, which has been dismissed vide<\/p>\n<p>judgment dated 26.11.2008. The judgment of conviction and order of<\/p>\n<p>sentence have been maintained.\n<\/p>\n<p>             It has been pointed out that vide document executed on<\/p>\n<p>1.12.2008 (Annexure P-1), the parties have settled all their disputes with<\/p>\n<p>the intervention of respectables and elders in the society. The issue in<\/p>\n<p>respect of cheque bearing No.438072 dated 20.12.2004, in the sum of<\/p>\n<p>Rs.8 lacs, has been settled.\n<\/p>\n<p>             Respondent No.2-complainant, as identified by his counsel<\/p>\n<p>Shri Chanderhas Yadav, Advocate, is present in person. The complainant<br \/>\n<span class=\"hidden_text\"> Criminal Rev.2579 of 2008 (O&amp;M)                                   3<\/span><\/p>\n<p>states that, indeed, the disputes have been settled and the cheque amount<\/p>\n<p>has been received by him. The complainant, now, does not have any<\/p>\n<p>grievance against the petitioners and would support if the offence is<\/p>\n<p>compounded.\n<\/p>\n<p>            I have considered the issue.\n<\/p>\n<p>            Section 147 of the Act provides that every offence punishable<\/p>\n<p>under the Act shall be compoundable.\n<\/p>\n<p>            The matter has been considered by the the Hon&#8217;ble Supreme<\/p>\n<p>Court of India in <a href=\"\/doc\/1981864\/\">Vinay Devanna Nayak v. Ryot Sewa Sahakari Bank Ltd.,<\/a><\/p>\n<p>(2008) 2 Supreme Court Cases 305, and it has been held as under:-<\/p>\n<blockquote><p>                  &#8220;17. As observed by this Court in <a href=\"\/doc\/979235\/\">Electronics Trade &amp;<br \/>\n            Technology     Development       Corpn.        Ltd.   v.   Indian<br \/>\n            Technologists &amp; Engineers (Electronics) (P) Ltd.,<\/a> (1996) 2<br \/>\n            SCC 739, the object of bringing Section 138 in the statute<br \/>\n            book is to inculcate faith in the efficacy of banking operations<br \/>\n            and credibility in transacting business on negotiable<br \/>\n            instruments. The provision is intended to prevent dishonesty<br \/>\n            on the part of the drawer of negotiable instruments in issuing<br \/>\n            cheques without sufficient funds or with a view to inducing<br \/>\n            the payee or holder in due course to act upon it. It thus seeks<br \/>\n            to promote the efficacy of bank operations and ensures<br \/>\n            credibility in transacting business through cheques. In such<br \/>\n            matters, therefore, normally compounding of offences should<br \/>\n            not be denied. Presumably, Parliament also realized this<br \/>\n            aspect and inserted Section 147 by the Negotiable<br \/>\n            Instruments (Amendment and Miscellaneous Provisions)<br \/>\n            Act,2002. (ACT 55 of 2002). The said section reads thus:\n<\/p><\/blockquote>\n<blockquote><p>                         &#8220;147.    Offences     to     be      compoundable.-\n<\/p><\/blockquote>\n<blockquote><p>                  Notwithstanding anything contained in the Code of<br \/>\n                  Criminal Procedure, 1973 (2 of 1974), every offence<br \/>\n<span class=\"hidden_text\"> Criminal Rev.2579 of 2008 (O&amp;M)                                    4<\/span><\/p>\n<p>                   punishable under this Act shall be compoundable.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                   18.   Taking into consideration even the said provision<br \/>\n            (Section 147) and the primary object underlying Section 138,<br \/>\n            in our judgment, there is no reason to refuse compromise<br \/>\n            between the parties. We, therefore, dispose of the appeal on<br \/>\n            the basis of the settlement arrived at between the appellant<br \/>\n            and the respondent.\n<\/p><\/blockquote>\n<blockquote><p>                   19.   For the foregoing reasons the appeal deserves to<br \/>\n            be allowed and is accordingly allowed by holding that since<br \/>\n            the matter has been compromised between the parties and the<br \/>\n            amount of Rs.45,000\/- has been paid by the appellant towards<br \/>\n            full and final settlement to the respondent-bank towards its<br \/>\n            dues, the appellant is entitled to acquittal.    The order of<br \/>\n            conviction and sentence recorded by all courts is set aside and<br \/>\n            he is acquitted of the charge levelled against him.&#8221;<\/p><\/blockquote>\n<p>            Considering the facts and circumstances of the case, it<\/p>\n<p>transpires that the cheque amount has already been paid by the accused to<\/p>\n<p>the complainant.    The complainant has recorded his satisfaction and<\/p>\n<p>supported the plea raised on behalf of the accused for compounding of the<\/p>\n<p>offence.\n<\/p>\n<p>            In view of the above, the revision petition is disposed of on<\/p>\n<p>the basis of settlement arrived at between the parties.
