petitioner has  tha_t_\u00ab_:the rfeslpondlent used to quarrel<\/p>\n
with him  a separate house at
\nMysore. Sheunirasl  the petitioner and his
\nfamily rneinbersltii at she “file a complaint before the police
\n  h’arassrnent. On becoming pregnant, she went<\/p>\n
to  for delivery a.nd thereafter she never<\/p>\n
l’v.:ll”‘ti;rned b–a_ckv_f:o thelmarital house. An effort was made by the<\/p>\n
  his family members to bring back the<\/p>\n
 ._:”‘respondent to the marital house. but did not materialize. It is<\/p>\n

\naileged that she failed to attend the marriage of the<\/p>\n
petitioners brother. At every stage instead of co~opuerl_a’ting<\/p>\n
with the petitioner she has caused harassment’ <\/p>\n
petitioner. Without any reasonable cause shei—-ha:s.,dde:serte_:d  <\/p>\n
the petitioner. Since 2001 she was=..:1iv:ingg3 <\/p>\n
house. in View of the harassment “and deVsett.i.on. their’<\/p>\n
petitioner has filed a petition seeking”-for–divorCe.l_  V\n<\/p>\n
3. in pursuance to the .no.tice issued the Fainily Court,<\/p>\n
the respondent entered into’  filed her<\/p>\n
objections    levelled against her
\ninteralia contending at the behest of his
\nmother has_Vfi1edl’a Vpet.i.t’ion*.sforidivorce and her mother–in–law
\n  llllllheliilrespondent, at no point of time<\/p>\n
misbehrivled the petitioner or with other family<\/p>\n
 or  purpose of delivery she had been to the<\/p>\n
” ‘dpareiital  and thereafter, the petitioner failed to take her<\/p>\n
 -tovthne marital house. She also contended that with an<\/p>\n

\nulterior motive. the present petition has been filed and sought<\/p>\n
for dismissal of the petition filed by the petitioner.<\/p>\n
4. Initially the above petition was filed <\/p>\n
Judge (Sr.Dn), Chitradurga and the sarne   ‘w <\/p>\n
MC.No.14\/2004. In View of the order m._ad.e inp’\\22.r’rit <\/p>\n
No.16266\/2005 by this Court t1*ie”–.J3.1atterlvvaVs transferred so<\/p>\n
Family Court, Davanagere.   _   ‘4\n<\/p>\n
5. On the basis of the ple_a”d_ing;s of i”thVe.vlparties, the Family<\/p>\n
Court framed the following    ht <\/p>\n

   on the basis of the oral and<\/p>\n
 ied by the parties held all the issues<\/p>\n

‘by the petitioner by its judgment and decree<\/p>\n

8. Being aggrieved by the Judgment and decree passed by<\/p>\n
the Family Court the appellant preferred this appeal.<\/p>\n

depriving the husband, the pleasure”of mar’ried.failedlll<\/p>\n
to resume herself to C0″l=1abitatilon,”; itself isl”‘enough to
\nconstitute cruelty. Therefore.’Athe”judgnient_’passed by the<\/p>\n
Family Court run ‘:’:ontralty  down by the<\/p>\n
Hon’ble Suprenie”inl”a_:ju_dgrnent reported in AIR 2005
\nso 3297 in eeseiiettiiieeeei PRASANNA TRIPATHY
\nv,\/,s_ARiJ\u00abIi\u00a7oi\u00abiAT1  He further submitted that in the<\/p>\n
guise   respondent went to the parental house<\/p>\n
 in the -year   thereafter, she never returned back to<\/p>\n
marital housle and there is no cohabitation from the year<\/p>\n
 An effort was made to bring back the wife to the<\/p>\n
 house by the elders and it was ended in failure. The<\/p>\n
\/’N,<\/p>\n
wife had deserted the husband for more than \ufb01ve years.<\/p>\n
Hence the court beiow, Without examining all these aspe’cts.._of<\/p>\n
the matter dismissed the petition, which is eonptralry<\/p>\n
and sought for setting aside the judgn_”_u::nt_ and”deoreelllp-alssedy K”<\/p>\n
by the Family Court.\n<\/p>\n
10. On the other hand  V\/{dvoeate
\nappearing for the respondent the date of
\nmarriage the respondent’    house as
\ndutiful wife    house for the
\npurpose of    that rnother–in–Iaw
\ndid not like  \u00abat the behest of motherin-
\niaw the petitioner’  back this respondent to the
\nrriavrit.alA  Iifle  that at no point of time the<\/p>\n
respondentrt  with the petitioner or any of the<\/p>\n
l:i,:”fa’mily  the petitioner. On the other hand, the<\/p>\n
”  of the petitioner amounts to cruelty to the wife hence<\/p>\n
 ‘sought fordismissal of the appeal.\n<\/p>\n

11. We have carefully gone through the argunients<\/p>\n
addressed by the learned counsel for the parties. <\/p>\n
judgment and decree passed by the Famiiy Cou.-‘*t Aorai ._ <\/p>\n
and documentary evidence of the parties.   3 <\/p>\n
12. It is not in dispute that th’e..__marriage of  va_ppe’llant_:ti\u00bb<\/p>\n
and respondent was solemnized  at:l)a\\fanagere.
\nOut of the wedlock, a female’ childgp’waaboivn an 26,2,20()1_
\nThere is no allegationV.against–vth:e  and only<\/p>\n
after giving  child   others started<\/p>\n
making allegation.s.v_V   that she did not
\nreturned  Further she failed to
\nattend the thel”‘appellant’s brother because of
\n tlie\u20ac’relauti\\’es olfl thelappellant were looking suspiciously<\/p>\n
towardsthe  The allegation of the appellant is that<\/p>\n
 respo_nderit_vl3:vas demanding him to set up a separate<\/p>\n
  she will come and join him and she was<\/p>\n
 that she will foist a police case alleging dowry<\/p>\n

\nharassment. The appellant in his evidence has admitted that<\/p>\n
the respondent was sent to her parental house when vshellwas<\/p>\n
pregnant of 5 1\/2 months. After so going to the parerits H<\/p>\n
the respondent gave birth to the mehild ,0-hti4.ii_j:9+’t\u00a7}2o0i; <\/p>\n
Further, the appellant himself has :iad1nitt?ed’ee.i.n..’l1i4sVer.oss’\u00bbd<\/p>\n
examination that they lived happily tilllshe  <\/p>\n
parental house for deliver._ The appellant l\ufb01trthervvvfadmitted
\nthat the respondent contin’ued.,to sftayu parental house
\nand insulted the petitioner”    But, the<\/p>\n
appellant has not   towstate as to what is
\nthe nature of  ‘to:”hae1*A  respondent.\n<\/p>\n
13. On the otherihand,A’*th\u00e9” respondent contended that she<\/p>\n
 theappellant till she went to the parental<\/p>\n
hotisell for  a dutiful wife. After giving birth to a<\/p>\n
xvfemaled\u00ab::hild.,~ ~t’_h}ellappel1ant has not taken her back to the<\/p>\n
“”l.-1’i.ti1ari\u00bbt.a1p house and she has also contended that due to ill-<\/p>\n
   19w11~200l. she Could not attend the marriage of<\/p>\n

produced E3x.R1 and Ex.R2 to show that as on l9–1_l’–l.\u00e9GQl,<\/p>\n
she was taking treatment. in the hospital due to_””ili–{he_alt:h.”\u00ab_<\/p>\n
She had no intention to avoid the marriage of-her: ._ <\/p>\n
law and due to unavoidable circumstances, ‘she. V”eoul:d..__1’3ot<\/p>\n
attend the marriage. She also*c_on_tende.d’<\/p>\n
and willing to join the marital ho1.1_s_ie’.-..:_Ho_vve\\.\/er.the appellant
\nhas refused to take her  ‘the.p’muarital’ihouse. Further,
\nshe has contended that wher1″then1.atter pending before<\/p>\n
the Family Cou1___’t–;  -retevrreldmto conciliation. In<\/p>\n
the conciliaition  appellant has refused to take
\nher back to  ed  <\/p>\n
14. As could  s’een~._fro,m”the petition averrnents, nowhere
\ni_n'”~the  the llavppcllant has pleaded cruelty except<\/p>\n
stating tha_t” of the respondent amounts to cruelty<\/p>\n
   anything about the physical and mental<\/p>\n
..l.l.l’_;’cr.1.ielty suffered by him so also with regard to desertion.<\/p>\n
  appellant alleged that the respondent has<\/p>\n
