T he petitioner has contended that &quot; it <\/pre>\n<p>is his legally wedded Wife and their i&#8221;.nar_r&#8217;ia3\u00a7el&#8217;ret.ool{&#8220;&#8216;place&#8217; <\/p>\n<p>14.4.2000 in Sharnanur Shivashankarappa i3Vai%{athvandnia-.000&#8242;<\/p>\n<p>Kalyana Mantapa at Davanagere asliper=.t_heir&#8217;cnstorris in the<br \/>\npresence of the elders and it l:is-an_ arran\u00a5g:ed&#8217;lrnarriage. Out of<br \/>\nthe wedlock a fempalecu chi.idV&#8221;&#8216;u?g.sl.&#8221;born 06.2.2001. The<\/p>\n<p>petitioner has  tha_t_\u00ab_:the rfeslpondlent used to quarrel<\/p>\n<p>with him  a separate house at<br \/>\nMysore. Sheunirasl  the petitioner and his<br \/>\nfamily rneinbersltii at she &#8220;file a complaint before the police<br \/>\n  h&#8217;arassrnent. On becoming pregnant, she went<\/p>\n<p>to  for delivery a.nd thereafter she never<\/p>\n<p>l&#8217;v.:ll&#8221;&#8216;ti;rned b&#8211;a_ckv_f:o thelmarital house. An effort was made by the<\/p>\n<p>  his family members to bring back the<\/p>\n<p> ._:&#8221;&#8216;respondent to the marital house. but did not materialize. It is<\/p>\n<p><span class=\"hidden_text\">4<\/span><br \/>\naileged that she failed to attend the marriage of the<\/p>\n<p>petitioners brother. At every stage instead of co~opuerl_a&#8217;ting<\/p>\n<p>with the petitioner she has caused harassment&#8217; <\/p>\n<p>petitioner. Without any reasonable cause shei&#8212;-ha:s.,dde:serte_:d  <\/p>\n<p>the petitioner. Since 2001 she was=..:1iv:ingg3 <\/p>\n<p>house. in View of the harassment &#8220;and deVsett.i.on. their&#8217;<\/p>\n<p>petitioner has filed a petition seeking&#8221;-for&#8211;divorCe.l_  V\n<\/p>\n<p>3. in pursuance to the .no.tice issued the Fainily Court,<\/p>\n<p>the respondent entered into&#8217;  filed her<\/p>\n<p>objections    levelled against her<br \/>\ninteralia contending at the behest of his<br \/>\nmother has_Vfi1edl&#8217;a Vpet.i.t&#8217;ion*.sforidivorce and her mother&#8211;in&#8211;law<br \/>\n  llllllheliilrespondent, at no point of time<\/p>\n<p>misbehrivled the petitioner or with other family<\/p>\n<p> or  purpose of delivery she had been to the<\/p>\n<p>&#8221; &#8216;dpareiital  and thereafter, the petitioner failed to take her<\/p>\n<p> -tovthne marital house. She also contended that with an<\/p>\n<p>A\/\u00ab<\/p>\n<p><span class=\"hidden_text\">5<\/span><br \/>\nulterior motive. the present petition has been filed and sought<\/p>\n<p>for dismissal of the petition filed by the petitioner.<\/p>\n<p>4. Initially the above petition was filed <\/p>\n<p>Judge (Sr.Dn), Chitradurga and the sarne   &#8216;w <\/p>\n<p>MC.No.14\/2004. In View of the order m._ad.e inp&#8217;\\22.r&#8217;rit <\/p>\n<p>No.16266\/2005 by this Court t1*ie&#8221;&#8211;.J3.1atterlvvaVs transferred so<\/p>\n<p>Family Court, Davanagere.   _   &#8216;4\n<\/p>\n<p>5. On the basis of the ple_a&#8221;d_ing;s of i&#8221;thVe.vlparties, the Family<\/p>\n<p>Court framed the following    ht <\/p>\n<p>(1)  ,_&#8217;pe:ti&#8217;tioner proves that the<br \/>\nresvppo11dentVhad,_ cruelty to him&#8217;?<br \/>\n[ii]p_.;:&#8217;V\\ll&#8217;i\u20actl&#8221;i6&#8217;1&#8242;.__V_the petitioner proves that the<\/p>\n<p>V . respondentvhad deserted him?\n<\/p>\n<p>   T&#8217;  vs&#8217;-1&#8217;i.ether the petitioner is entitled to a<\/p>\n<p>it  deereeof (11% gz\/e&#8217;?\n<\/p>\n<p><span class=\"hidden_text\">6<\/span><\/p>\n<p>(iv) In the event. if a divorce is to be granted as<br \/>\nsought for then to what. extent the&#8221;&#8212;._<br \/>\nrespondent is entitled to have permani?_nt..f&#8221;p:&#8217;-VT:&#8221;&#8216;-,<\/p>\n<p>alimony? and<\/p>\n<p>(V) T 0 what order and deere_e&#8230;.th_e p_a.rti&#8221;es&#8217;_&#8217;;vaVr&#8221;e   <\/p>\n<p>entitled to&#8217;?\n<\/p>\n<p>6. In order to prove the ease, the petitioner ha,s&#8221;e)&lt;;&#039;arrr.inepd&quot;&#8211;.V<\/p>\n<p>himself as P.W.1 and aiso examinlevdianother.iivitneslsyissh PW2<br \/>\nand got marked the documentsi\u00bbAt\u00e9i&#039;s&quot; Thevreslpondent<\/p>\n<p>examined herself as R.W.l l   three other<\/p>\n<p>Witnesses and  documents as Ex.Rl and<\/p>\n<p>EXR2.\n<\/p>\n<p>   on the basis of the oral and<\/p>\n<p> ied by the parties held all the issues<\/p>\n<p> against Vl&#8221;the.\u00ab_&#8221;: &#8216;petitioner and consequently dismissed the<\/p>\n<p>&#8216;by the petitioner by its judgment and decree<\/p>\n<p>ll&#8217;7.&#8221;v.t:dzi:ed&#8217;t;w.VV1&#8217;7&#8242;; 21.2006.<\/p>\n<p>\/59\u00a2<\/p>\n<p>7&#8217;\n<\/p>\n<p>8. Being aggrieved by the Judgment and decree passed by<\/p>\n<p>the Family Court the appellant preferred this appeal.<\/p>\n<p>9. Sri.Ko.Vijay Kumar, Advocate appearirig&#8217;  <\/p>\n<p>appellant submitted the judgment &#8216;c1Il.dfA'(fl&#8217;t;&#8217;CtI&#8221;E3tl\u00a7l&#8217;  <\/p>\n<p>Family Court, Davanagere is oontr&#8217;ar_yl&#8217;&#8211;_tAo  &#8216;Theft<\/p>\n<p>depriving the husband, the pleasure&#8221;of mar&#8217;ried.failedlll<\/p>\n<p>to resume herself to C0&#8243;l=1abitatilon,&#8221;; itself isl&#8221;&#8216;enough to<br \/>\nconstitute cruelty. Therefore.&#8217;Athe&#8221;judgnient_&#8217;passed by the<\/p>\n<p>Family Court run &#8216;:&#8217;:ontralty  down by the<\/p>\n<p>Hon&#8217;ble Suprenie&#8221;inl&#8221;a_:ju_dgrnent reported in AIR 2005<br \/>\nso 3297 in eeseiiettiiieeeei PRASANNA TRIPATHY<br \/>\nv,\/,s_ARiJ\u00abIi\u00a7oi\u00abiAT1  He further submitted that in the<\/p>\n<p>guise   respondent went to the parental house<\/p>\n<p> in the -year   thereafter, she never returned back to<\/p>\n<p>marital housle and there is no cohabitation from the year<\/p>\n<p> An effort was made to bring back the wife to the<\/p>\n<p> house by the elders and it was ended in failure. The<\/p>\n<p>\/&#8217;N,<\/p>\n<p>wife had deserted the husband for more than \ufb01ve years.<\/p>\n<p>Hence the court beiow, Without examining all these aspe&#8217;cts.._of<\/p>\n<p>the matter dismissed the petition, which is eonptralry<\/p>\n<p>and sought for setting aside the judgn_&#8221;_u::nt_ and&#8221;deoreelllp-alssedy K&#8221;<\/p>\n<p>by the Family Court.\n<\/p>\n<p>10. On the other hand  V\/{dvoeate<br \/>\nappearing for the respondent the date of<br \/>\nmarriage the respondent&#8217;    house as<br \/>\ndutiful wife    house for the<br \/>\npurpose of    that rnother&#8211;in&#8211;Iaw<br \/>\ndid not like  \u00abat the behest of motherin-<br \/>\niaw the petitioner&#8217;  back this respondent to the<br \/>\nrriavrit.alA  Iifle  that at no point of time the<\/p>\n<p>respondentrt  with the petitioner or any of the<\/p>\n<p>l:i,:&#8221;fa&#8217;mily  the petitioner. On the other hand, the<\/p>\n<p>&#8221;  of the petitioner amounts to cruelty to the wife hence<\/p>\n<p> &#8216;sought fordismissal of the appeal.\n<\/p>\n<p>\/iv<\/p>\n<p><span class=\"hidden_text\">9<\/span><\/p>\n<p>11. We have carefully gone through the argunients<\/p>\n<p>addressed by the learned counsel for the parties. <\/p>\n<p>judgment and decree passed by the Famiiy Cou.-&#8216;*t Aorai ._ <\/p>\n<p>and documentary evidence of the parties.   3 <\/p>\n<p>12. It is not in dispute that th&#8217;e..__marriage of  va_ppe&#8217;llant_:ti\u00bb<\/p>\n<p>and respondent was solemnized  at:l)a\\fanagere.<br \/>\nOut of the wedlock, a female&#8217; childgp&#8217;waaboivn an 26,2,20()1_<br \/>\nThere is no allegationV.against&#8211;vth:e  and only<\/p>\n<p>after giving  child   others started<\/p>\n<p>making allegation.s.v_V   that she did not<br \/>\nreturned  Further she failed to<br \/>\nattend the thel&#8221;&#8216;appellant&#8217;s brother because of<br \/>\n tlie\u20ac&#8217;relauti\\&#8217;es olfl thelappellant were looking suspiciously<\/p>\n<p>towardsthe  The allegation of the appellant is that<\/p>\n<p> respo_nderit_vl3:vas demanding him to set up a separate<\/p>\n<p>  she will come and join him and she was<\/p>\n<p> that she will foist a police case alleging dowry<\/p>\n<p>\/\ufb01v&#8217;<\/p>\n<p>H}<br \/>\nharassment. The appellant in his evidence has admitted that<\/p>\n<p>the respondent was sent to her parental house when vshellwas<\/p>\n<p>pregnant of 5 1\/2 months. After so going to the parerits H<\/p>\n<p>the respondent gave birth to the mehild ,0-hti4.ii_j:9+&#8217;t\u00a7}2o0i; <\/p>\n<p>Further, the appellant himself has :iad1nitt?ed&#8217;ee.i.n..&#8217;l1i4sVer.oss&#8217;\u00bbd<\/p>\n<p>examination that they lived happily tilllshe  <\/p>\n<p>parental house for deliver._ The appellant l\ufb01trthervvvfadmitted<br \/>\nthat the respondent contin&#8217;ued.,to sftayu parental house<br \/>\nand insulted the petitioner&#8221;    But, the<\/p>\n<p>appellant has not   towstate as to what is<br \/>\nthe nature of  &#8216;to:&#8221;hae1*A  respondent.\n<\/p>\n<p>13. On the otherihand,A&#8217;*th\u00e9&#8221; respondent contended that she<\/p>\n<p> theappellant till she went to the parental<\/p>\n<p>hotisell for  a dutiful wife. After giving birth to a<\/p>\n<p>xvfemaled\u00ab::hild.,~ ~t&#8217;_h}ellappel1ant has not taken her back to the<\/p>\n<p>&#8220;&#8221;l.-1&#8217;i.ti1ari\u00bbt.a1p house and she has also contended that due to ill-<\/p>\n<p>   19w11~200l. she Could not attend the marriage of<\/p>\n<p>X\u00bb<\/p>\n<p><span class=\"hidden_text\">11<\/span><br \/>\nher brother&#8211;in&#8211;law. To support her evidence, she has also<\/p>\n<p>produced E3x.R1 and Ex.R2 to show that as on l9&#8211;1_l&#8217;&#8211;l.\u00e9GQl,<\/p>\n<p>she was taking treatment. in the hospital due to_&#8221;&#8221;ili&#8211;{he_alt:h.&#8221;\u00ab_<\/p>\n<p>She had no intention to avoid the marriage of-her: ._ <\/p>\n<p>law and due to unavoidable circumstances, &#8216;she. V&#8221;eoul:d..__1&#8217;3ot<\/p>\n<p>attend the marriage. She also*c_on_tende.d&#8217;<\/p>\n<p>and willing to join the marital ho1.1_s_ie&#8217;.-..:_Ho_vve\\.\/er.the appellant<br \/>\nhas refused to take her  &#8216;the.p&#8217;muarital&#8217;ihouse. Further,<br \/>\nshe has contended that wher1&#8243;then1.atter pending before<\/p>\n<p>the Family Cou1___&#8217;t&#8211;;  -retevrreldmto conciliation. In<\/p>\n<p>the conciliaition  appellant has refused to take<br \/>\nher back to  ed  <\/p>\n<p>14. As could  s&#8217;een~._fro,m&#8221;the petition averrnents, nowhere<br \/>\ni_n'&#8221;~the  the llavppcllant has pleaded cruelty except<\/p>\n<p>stating tha_t&#8221; of the respondent amounts to cruelty<\/p>\n<p>   anything about the physical and mental<\/p>\n<p>..l.l.l&#8217;_;&#8217;cr.1.ielty suffered by him so also with regard to desertion.<\/p>\n<p>  appellant alleged that the respondent has<\/p>\n<p>A<\/p>\n<p>%\u00ab<\/p>\n<p><span class=\"hidden_text\">12<\/span><br \/>\ninsulted his mother when she went to see the newly born<\/p>\n<p>child, he has not examined his mother, to prove thlelsaid<\/p>\n<p>contention. There is no iota of evidence to show;&#8221;&#8216;thatj _<\/p>\n<p>was physical and mental cruelty on the appe_i1ant,:j~.. W <\/p>\n<p>person to speak about the insult is his m&#8221;o.ther,.lblu&#8217;t &#8216;s&#8217;ii:e..&#8217;_hiiVsrl<\/p>\n<p>not been examined. in the absence of thesan1ie:,l&#8217;the._Vcase of<\/p>\n<p>the appellant cannot be  There&#8217;  specific<br \/>\npleading regarding harassnient_  that from the<br \/>\nyear 2001. the respon-dent   parental house<br \/>\nand no such   a decree of<\/p>\n<p>divorce eith&#8217;e&#8217;rmu&#8217;nder ll}w(ia}land (ib) of the Hindu<br \/>\nMarriage   any such pleadings and the<br \/>\nevidence, &#8216;the  the appellant will not come<br \/>\n pnrvieyv  Section 13(1}[ia) and (ib) of the Hindu<\/p>\n<p> We&#8221;\u00ab\u00ab.are___&#8221;of.the opinion that the appellant has miserably<\/p>\n<p>4&#8243;&#8221;failed topmake. out a case for divorce.
