Justice P.BHAVADASAN\n\n Dated :01\/07\/2009\n\n O R D E R\n              P.R.RAMAN &amp; P.BHAVADASAN, JJ.\n\n                   -------------------------------\n\n                   W.P.(C) No. 17629 OF 2009\n\n                   -------------------------------\n\n                   Dated this the 1st July, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>Raman, J.\n<\/p>\n<\/p>\n<p>             Petitioner has filed this writ petition seeking a<\/p>\n<p>direction to respondents 1 to 3 to provide adequate and<\/p>\n<p>necessary   protection   to the petitioner and his employees to<\/p>\n<p>carry out the loading and unloading work in the depot of<\/p>\n<p>Parenteral     Drugs       (I)     Limited       at  Thiruvallam,<\/p>\n<p>Thiruvananthapuram, without any obstruction from respondents<\/p>\n<p>5 to 8 and their supporters.\n<\/p>\n<\/p>\n<p>             2.   According to the petitioner, he is running a<\/p>\n<p>depot of pharmaceutical company.          He has three registered<\/p>\n<p>employees for carrying out the loading and unloading work. On<\/p>\n<p>an earlier occasion, the Manager has filed a writ petition before<\/p>\n<p>this Court seeking protection, when there was obstruction caused<\/p>\n<p>by respondents 3 to 6 therein, and this Court by Ext.P1 judgment<\/p>\n<p>W.P.(C) No.17629 of 2009<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>made it clear that if the petitioner is engaging persons holding<\/p>\n<p>identity cards, unless and until the same are cancelled by any<\/p>\n<p>statutory authority, the petitioner therein is entitled to employ<\/p>\n<p>such registered workers. It is also directed that so long as the<\/p>\n<p>work of loading and unloading is carried on by the registered<\/p>\n<p>workers, there cannot be any obstruction, at the instance of<\/p>\n<p>respondents 3 to 6.      In case of any obstruction, there was a<\/p>\n<p>direction to the police to give necessary protection.<\/p>\n<p>                3. It is the case of the petitioner that two of the<\/p>\n<p>registered workmen engaged by him had already left the service<\/p>\n<p>and now two persons have joined in their place. It is also stated<\/p>\n<p>that applications for registration has also been made as<\/p>\n<p>contemplated under Rule 26A of the Rules for loading and<\/p>\n<p>unloading work.\n<\/p>\n<\/p>\n<p>                4. In the facts and circumstances of the case, we<\/p>\n<p>find that this is not a scheme covered area. Petitioner is running<\/p>\n<p>a pharmaceutical company        and necessarily materials brought<\/p>\n<p>has to be unloaded        which is incidental to the work of the<\/p>\n<p>W.P.(C) No.17629 of 2009<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>establishment.       So long as the petitioner is engaging the<\/p>\n<p>registered workmen including the two newly joined workmen, in<\/p>\n<p>respect of them applications had been submitted for registration,<\/p>\n<p>there will not be any obstruction caused by respondents 5 to 8<\/p>\n<p>and their supporters. However, it is open to the party<\/p>\n<p>respondents, if they are otherwise aggrieved, to approach the<\/p>\n<p>authority before whom the applications for registration are<\/p>\n<p>pending, and the authority will take a decision in the matter<\/p>\n<p>within two weeks.         In case, registration in respect of two<\/p>\n<p>workmen is not granted, then the petitioner will not be entitled to<\/p>\n<p>continue such workmen, until that decision is reversed by any<\/p>\n<p>competent court.
