Justice M.SASIDHARAN NAMBIAR\n\n Dated :26\/10\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n\n            ---------------------------------------------\n             CRL.M.C.NO.4168 OF 2010\n            ---------------------------------------------\n             Dated        26th    October, 2010\n\n\n                           O R D E R\n<\/pre>\n<p>         By   Annexure-1 order                      Sessions Judge,<\/p>\n<p>Kasargod granted bail to the petitioner, an<\/p>\n<p>accused in C.P.78\/2008 on the file of Judicial<\/p>\n<p>First Class Magistrate&#8217;s Court-I, Kasargod on<\/p>\n<p>conditions. One of the conditions was that<\/p>\n<p>petitioner   shall           deposit              Rs.25,000\/-      as<\/p>\n<p>security.  In   addition,              he       was      directed  to<\/p>\n<p>execute a bond for Rs.20,0000\/- and also to<\/p>\n<p>surrender  his     passport.               Petition        is  filed<\/p>\n<p>under  Section       482         of        Code          of  Criminal<\/p>\n<p>Procedure to quash the condition to deposit<\/p>\n<p>Rs.25,000\/- contending that due to the failure<\/p>\n<p>of the petitioner to deposit the amount, even<\/p>\n<p>though  the  order         was       passed           on   13\/9\/2010,<\/p>\n<p>petitioner is   continuing in judicial custody.<\/p>\n<p><span class=\"hidden_text\">Crmc 4168\/10              2<\/span><\/p>\n<p>            2.  Learned  counsel appearing for the<\/p>\n<p>petitioner and learned Public Prosecutor       were<\/p>\n<p>heard.\n<\/p>\n<p>            3.  Learned  counsel  submitted that it<\/p>\n<p>is only due to the failure of the petitioner<\/p>\n<p>who hails from a poor family, he is still<\/p>\n<p>languishing      in   jail   and   therefore,   the<\/p>\n<p>condition is to be deleted.\n<\/p>\n<p>            4. Learned Public Prosecutor  submitted<\/p>\n<p>that petitioner had absconded and only later he<\/p>\n<p>could       be  arrested  and   it   is   in   such<\/p>\n<p>circumstances, the condition was imposed.<\/p>\n<p>            5. The very fact that petitioner is<\/p>\n<p>still       in custody, even though the order for<\/p>\n<p>release on bail was granted on 13\/9\/2010 shows<\/p>\n<p>that because of the financial condition of the<\/p>\n<p>petitioner, he is still continuing in judicial<\/p>\n<p>custody.      Poverty  is  not  a   sin.  In   such<\/p>\n<p>circumstances, it is necessary to modify the<\/p>\n<p><span class=\"hidden_text\">Crmc 4168\/10               3<\/span><\/p>\n<p>conditions.\n<\/p>\n<p>            Petition is allowed.   Annexure-1 order<\/p>\n<p>is modified as follows.        Petitioner shall be<\/p>\n<p>released      on  bail  on  executing  a  bond  for<\/p>\n<p>Rs.50,000\/- with two solvent sureties       for the<\/p>\n<p>like sum to the satisfaction of the         learned<\/p>\n<p>Magistrate.      At least one of the sureties shall<\/p>\n<p>be        a  close   relative of   the  petitioner.<\/p>\n<p>Petitioner shall surrender his passport before<\/p>\n<p>the    learned    Magistrate and  shall  not  leave<\/p>\n<p>India without the previous permission of the<\/p>\n<p>learned Magistrate.
