Rohilla, Advocate\n             for the petitioner.\n\n             Mr. Harish Rathee, Sr. DAG, Haryana.\n\n             Mr. Harkesh Manuja, Advocate\n\n\nAJAY TEWARI, J.\n<\/pre>\n<p>             The petitioner was selected as Medical Officer (HCMS-II) and<\/p>\n<p>was called for counselling for posting by letter dated 23.6.2006 in which it<\/p>\n<p>was mentioned as follows:-\n<\/p>\n<p>                         &#8220;You     are   to   give     the   choice   of    ten<\/p>\n<p>                   PHCs\/CHCs\/General Hospitals as per order of preference<\/p>\n<p>                   out of the list of vacancies attached herewith. In the list<\/p>\n<p>                   of vacancies so provided the places\/vacancies identified<\/p>\n<p>                   with an asterisk indicates that this place\/vacancy is<\/p>\n<p>                   challenging in nature where one year of experience will<\/p>\n<p>                   be counted as two years rural experience for while<\/p>\n<p>                   counting rural experience for applying to PG courses.&#8221;<\/p>\n<p>             The petitioner opted for a challenging posting.<\/p>\n<p>             In the policy regarding Higher Studies for Doctors dated<br \/>\n<span class=\"hidden_text\"> CWP No.4116 of 2009 (O&amp;M)                          -2-<\/span><\/p>\n<p>12.03.2008, the following stipulation has been made:-<\/p>\n<blockquote><p>                         &#8220;The basic condition for eligibility is three years<\/p>\n<p>                   regular service with successful completion of probation<\/p>\n<p>                   period out of which two years service is essential in rural<\/p>\n<p>                   areas for both for re-served and open seats in the case of<\/p>\n<p>                   HCMS doctors. However, the condition of rural service<\/p>\n<p>                   will not be applicable in the case of a member of the<\/p>\n<p>                   HMES.&#8221;<\/p><\/blockquote>\n<p>            The petitioner applied for Post Graduation studies with<\/p>\n<p>respondent No.2 &#8211; Pt. B. D. Sharma University of Health Sciences, Rohtak<\/p>\n<p>(Haryana) and appeared in the written test held on 01.03.2009 wherein he<\/p>\n<p>secured 5th position. The grouse of the petitioner is that he has not been<\/p>\n<p>issued the NOC and counseling is fixed for 27.3.2009. As per learned<\/p>\n<p>counsel for the petitioner under the letter of appointment extracted above, he<\/p>\n<p>was entitled to count one year of rural service as two years. Thus, since he<\/p>\n<p>two years eight months of actual service, it would be equivalated to one year<\/p>\n<p>eight months plus one year equal to two years, thus making a grand total of<\/p>\n<p>three years eight months. At this stage, it would also be apposite to notice<\/p>\n<p>the terms of the policy which was in force at the time when the petitioner<\/p>\n<p>joined service. At that time, the provision read as follows:-<\/p>\n<blockquote><p>                          &#8220;Candidates keen to go in for higher studies for<\/p>\n<p>                   the P.G. Diploma\/P.G. Degree Courses against the<\/p>\n<p>                   reserved seats will be required to apply for a &#8220;No<\/p>\n<p>                   Objection Certificate&#8221; to the competent authority before<\/p>\n<p>                   submitting their applications for admission to the said<\/p>\n<p>                   course. Only those candidates will be considered for<br \/>\n<span class=\"hidden_text\"> CWP No.4116 of 2009 (O&amp;M)                          -3-<\/span><\/p>\n<p>                   NOC under this category who fulfill the following<\/p>\n<p>                   conditions.\n<\/p><\/blockquote>\n<blockquote><p>                        i) He\/she must have completed the probation period<\/p>\n<p>                           successfully and completed 5 years service under<\/p>\n<p>                           the State Government including the probation<\/p>\n<p>                           period out of which three years services should<\/p>\n<p>                           be in rural area\/service.&#8221;<\/p><\/blockquote>\n<p>            Thus, at that time, the petitioner was looking at three and a half<\/p>\n<p>years actual service which would be equivalated to five years i.e. two years<\/p>\n<p>plus one and a half year equal to three years.\n<\/p>\n<p>            The question which arises in this writ petition is:-<\/p>\n<blockquote><p>                   i) Whether the requirement of putting in three years<\/p>\n<p>                      regular service is an absolute requirement or whether<\/p>\n<p>                      it can be deemed to be notional?\n<\/p><\/blockquote>\n<p>            In a somewhat similar case bearing CWP No.9946 of 2008<\/p>\n<p>decided on 04.11.2008 titled as <a href=\"\/doc\/98551\/\">Dr. Anoop Goel V. State of Haryana and<\/p>\n<p>others<\/a>, a Division Bench of this Court held as follows:-<\/p>\n<blockquote><p>                          &#8220;We have heard learned counsel for the parties.<\/p>\n<p>                   The petitioner cannot rely upon the stipulation contained<\/p>\n<p>                   in Annexure P-4 i.e. letter addressed to Dr. Varun Garg.<\/p>\n<p>                   The concession to Dr. Garg was personal in nature.<\/p>\n<p>                   There is no policy decision in respect of such benefit.<\/p>\n<p>                   But even if such benefit is deemed to be available to the<\/p>\n<p>                   petitioner, it will only mean that one year&#8217;s experience in<\/p>\n<p>                   such PHC will be counted as two years&#8217; Rural<\/p>\n<p>                   experience.     It means that three years&#8217; rural over<br \/>\n<span class=\"hidden_text\"> CWP No.4116 of 2009 (O&amp;M)                           -4-<\/span><\/p>\n<p>                    experience required to be eligible for admission would<\/p>\n<p>                    be satisfied by working for two years in Rural area. It<\/p>\n<p>                    does not amount to relaxation in respect of 5 years of<\/p>\n<p>                    service under the State Government. The three years&#8217;<\/p>\n<p>                    rural experience is within 5 years of service under the<\/p>\n<p>                    State Government. As the petitioner has not completed<\/p>\n<p>                    five years of service under the State Government,<\/p>\n<p>                    therefore, the petitioner is not eligible to seek admission<\/p>\n<p>                    as an in-service candidate.&#8221;<\/p><\/blockquote>\n<p>              Learned counsel for the petitioner has argued that the<\/p>\n<p>observations in that writ petition took colour from the fact that the service of<\/p>\n<p>the petitioner therein did not amount to five years even after giving the<\/p>\n<p>benefit. I see no warrant for this interpretation. The observations of the<\/p>\n<p>Hon&#8217;ble Division Bench are not qualified in any manner.<\/p>\n<p>              The interpretation given by the Hon&#8217;ble Division Bench is<\/p>\n<p>binding on this Court.\n<\/p>\n<p>              Consequently, I hold that the requirement of having three years<\/p>\n<p>regular service is an absolute requirement and thus the petitioner cannot get<\/p>\n<p>the benefit of his rural service in challenging posting in the manner that he<\/p>\n<p>is seeking.\n<\/p>\n<p>              This writ petition is accordingly dismissed with no costs.<\/p>\n<p>              Since, the counselling is stated to be fixed for tomorrow, let the<\/p>\n<p>copy of this order be given dasti under the signature of the Court Secretary.<\/p>\n<pre>\n\n\n\n                                                          ( AJAY TEWARI )\nMarch 26, 2009                                                 JUDGE\nashish\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Dr. Ritesh Garg vs State Of Haryana And Another on 26 March, 2009 CWP No.4116 of 2009 (O&amp;M) -1- IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH.
