SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/08\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\npetitioner herein has prayed for an appropriate writ, direction or<br \/>\norder quashing and setting aside the impugned order \/ communication<br \/>\ndated 10th March 2010, by which, in exercise of powers<br \/>\nunder Section 82(1) of the Gujarat Cooperative Societies Act, 1961,<br \/>\nRegistrar, Cooperative Societies, State of Gujarat, Gandhinagar has<br \/>\ncalled upon the petitioner Bank to furnish the information with<br \/>\nsupporting documents which were pursuant to the communication dated<br \/>\n25.01.2010.\n<\/p>\n<p>2.\tWhen<br \/>\nthe present Special Civil Application was heard for admission hearing<br \/>\non 27.05.2010, learned counsel appearing on behalf of the petitioner<br \/>\nBank sought time to comply with the direction given by the order<br \/>\ndated 10.03.2010 without prejudice to his right to contend that the<br \/>\nsaid order is passed without jurisdiction.  Shri N.D. Nanavaty,<br \/>\nlearned Senior Advocate appearing on behalf of the petitioner Bank<br \/>\nhas submitted that petitioner Bank has already complied with the<br \/>\ndirection given by the order dated 10.03.2010 and has already<br \/>\nfurnished the required information with supporting documents to the<br \/>\nRegistrar, Cooperative Societies, State of Gujarat, Gandhinagar.  It<br \/>\nis stated at the Bar by Shri Nanavaty, learned Senior Advocate<br \/>\nappearing on behalf of the petitioner Bank that according to<br \/>\npetitioner, petitioner Bank has supplied and\/or furnished the full<br \/>\nparticulars and the information sought vide communication dated<br \/>\n10.03.2010\/25.01.2010 and if any further information is lacking and<br \/>\nthe petitioner is informed, petitioner shall furnish the same as may<br \/>\nbe directed by the  Registrar, Cooperative Societies, State of<br \/>\nGujarat, Gandhinagar.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above, he does not press the present petition as the<br \/>\ncommunication dated 10.03.2010, which is impugned in the present<br \/>\npetition, has been complied with.  Shri Pranav Dave, learned<br \/>\nAssistant Government Pleader, under the instructions from Shri A.C.<br \/>\nPathan, Legal Superintendent, Office of Registrar, Cooperative<br \/>\nSocieties, State of Gujarat, has stated at the Bar that though<br \/>\nbelatedly, petitioner Bank has already supplied the information as<br \/>\nrequired pursuant to the communication dated 10.03.2010 and if still,<br \/>\non verification, it is found that some information is still required,<br \/>\npetitioner shall be communicated which may be furnished by the<br \/>\npetitioner at the earliest.  It is further submitted that appropriate<br \/>\nfurther action may be taken in accordance with law and on merits<br \/>\nafter considering the information supplied by the petitioner.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and having complied with the order passed by the<br \/>\nRegistrar, Cooperative Societies, State of Gujarat, Gandhinagar dated<br \/>\n10.03.2010, as required by Shri Nanavaty, learned Senior Advocate<br \/>\nappearing on behalf of the petitioner Bank, present Special Civil<br \/>\nApplication is disposed of.
