Respondents\n                 For the Petitioner        : Mr. Din Bandhu Singh, Advocate\n                 For the State             : Mr. Rajeev Lochan, AC to GA 9\n\n\n\n3   20.10.2011<\/pre>\n<p>                 Heard learned counsel for the petitioner and<\/p>\n<p>                     State.\n<\/p>\n<p>                                Petitioner seeks      quashing    of    dated<\/p>\n<p>                     22.6.99\/28.6.99 passed by the District Magistrate,<\/p>\n<p>                     Rohtas     in Arms Case No. 35 of 1996 as well as<\/p>\n<p>                     appellate order     dated 28.9.2004     passed    by the<\/p>\n<p>                     Commissioner, Patna Division in Case No. 103\/1999<\/p>\n<p>                     as contained in Annexures 1 and 2 respectively.<\/p>\n<p>                               Learned counsel submits       that his license<\/p>\n<p>                     has been cancelled only on the ground of suspicion<\/p>\n<p>                     that he has not utilised the same while       the dacoits<\/p>\n<p>                     had attacked      the house   of co-villager Vijay Singh.<\/p>\n<p>                     Learned counsel drew attention of this Court towards<\/p>\n<p>                     paragraph 3 of the appellate order. It is claimed that<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>petitioner had fired from his rifle         when the dacoity<\/p>\n<p>was being        committed and upon         that dacoits had<\/p>\n<p>escaped.         It is also urged that since there is old<\/p>\n<p>enmity         between him and the Mukiya          and Vijay<\/p>\n<p>Singh, the such sanha has been lodged by the police<\/p>\n<p>at their instance.\n<\/p>\n<p>               A supplementary affidavit has also been<\/p>\n<p>filed     on     behalf of the petitioner      appending    a<\/p>\n<p>judgment        of acquittal passed in the aforesaid case<\/p>\n<p>of dacoity with regard to the accused persons and a<\/p>\n<p>certificate granted by the Block Development Officer<\/p>\n<p>regarding the conduct of the petitioner.            It is also<\/p>\n<p>stated on behalf of the petitioner that       the petitioner&#8217;s<\/p>\n<p>antecedent        is clean.   However,       on the basis of<\/p>\n<p>suspicion        raised by the police       on the basis   of<\/p>\n<p>statement of the Mukhia and Vijay Singh allegedly<\/p>\n<p>recorded in the case regarding the dacoity, the<\/p>\n<p>authorities have       come to the conclusion        that the<\/p>\n<p>petitioner was also in league of the accused persons.<\/p>\n<p>However,         all the accused persons have now been<\/p>\n<p>acquitted       of the charges whereas        the petitioner&#8217;s<\/p>\n<p>license     still remain cancelled even though        he was<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>not made accused in the aforesaid case even on the<\/p>\n<p>ground of suspicion.\n<\/p>\n<p>             A counter affidavit has been filed on behalf<\/p>\n<p>of the State.    Learned counsel submitted that during<\/p>\n<p>the course       of investigation      of the aforesaid<\/p>\n<p>regarding     Sanha no. 577 dated 23.4.1996,      it had<\/p>\n<p>transpired to the Officer In-charge that the petitioner<\/p>\n<p>conduct      was suspicious. However, nothing         has<\/p>\n<p>been brought on record to show that either the<\/p>\n<p>petitioner is having any criminal antecedent or<\/p>\n<p>what was the basis of such suspicion.<\/p>\n<p>             In above view of the matter, in my opinion<\/p>\n<p>the orders impugned       cannot be sustained in law as<\/p>\n<p>they     have been passed merely       on the basis    of<\/p>\n<p>suspicion.\n<\/p>\n<p>             As a result,     both the order       dated<\/p>\n<p>22.6.99\/28.6.99 passed by the District Magistrate,<\/p>\n<p>Rohtas       in Arms Case No. 35 of 1996 as well as<\/p>\n<p>appellate order      dated 28.9.2004    passed    by the<\/p>\n<p>Commissioner, Patna Division in Case No. 103\/1999<\/p>\n<p>as contained in Annexures 1 and 2 respectively are<\/p>\n<p>quashed       and the matter is remitted back      to the<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>        Collector, Rohtas        to consider   the   case    of the<\/p>\n<p>        petitioner afresh       and pass a reasoned order after<\/p>\n<p>        considering the materials available on record and<\/p>\n<p>        giving opportunity of hearing to the petitioner within<\/p>\n<p>        eight weeks from the date of receipt \/ production of<\/p>\n<p>        a certified copy of this order.\n<\/p>\n<p>                  Accordingly,       this writ application   stands<\/p>\n<p>        allowed to the extent as indicated above.<\/p>\n<pre>Spd\/-                           ( Dr. Ravi Ranjan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Suresh Singh vs The State Of Bihar &amp; Ors on 20 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Civil Writ Jurisdiction Case No.6542 of 2005 Suresh Singh , Son of Late Anesh Singh, resident of village Baluahi, P.s.
