SIRI JAGAN, J.\n\n                      -----------------------------------\n\n                        W.P.(C)NO.13960 OF 2007\n\n                      -----------------------------------\n\n             DATED THIS THE 14th DAY OF JUNE, 2007\n\n\n                                    JUDGMENT\n<\/pre>\n<p>       The petitioner is a student of the KTCT College, who was written<\/p>\n<p>B.Ed examination in 2006.    She is aggrieved by the reduction of  her<\/p>\n<p>internal marks by the University.   According to the petitioner, internal<\/p>\n<p>marks cannot be reduced by the University.\n<\/p>\n<p>       2.     The learned counsel for the standing counsel appearing for<\/p>\n<p>the   University   submits   that   in   order   to   standardise   the   marks   of   the<\/p>\n<p>petitioner,   the   marks   scored   in   internal   assessment   has   been<\/p>\n<p>proportionately   reduced   on   the   basis   of   marks   obtained   by   the<\/p>\n<p>petitioner in the university Examination.\n<\/p>\n<p>       3.     Identical   question   was   considered   by   me   in   W.P.(c)<\/p>\n<p>Nos.20563\/06,21966\/06 and 22479\/06, in which I had held as follows:\n<\/p>\n<blockquote><p>                &#8220;I have considered the contentions of both sides.<\/p>\n<p>         The   University   is   a   creature   of   the   University   Act.<\/p>\n<p>         Their   actions   are   circumscribed   by   the   provisions   of<\/p>\n<p>         the Act, Statutes and Ordinance framed under the Act.<\/p>\n<p>         Without there being any provision in the Act, Statutes<\/p>\n<p>         or   Ordinance   no   power   can   be   conceded   to   the<\/p>\n<p>         University   to   reduce   the   internal   marks   awarded   by<\/p>\n<p>         the   teachers,   who   had   first   hand   knowledge   of   the<\/p>\n<p>         performance of the students during teaching practice,<\/p>\n<p>         which   is   the   basis   for   award   of   internal   marks.<\/p>\n<p>         Therefore, I am afraid that the University cannot under<\/p>\n<p>         law   reduce   the   marks   so   awarded.     I   also     feel   that<\/p>\n<p>         just   because   the   particular   students   have   got   low<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.13960\/07                          2<\/span><\/p>\n<p>         marks   in   the   theory   papers   that   does   not<\/p>\n<p>         automatically mean that the marks awarded by the<\/p>\n<p>         college   on   internal   assessment   have   to   be<\/p>\n<p>         proportionately   reduced.     The   internal   marks   are<\/p>\n<p>         awarded not on the basis of the performance of the<\/p>\n<p>         students   in   any   written   examination.     This   is<\/p>\n<p>         awarded based on the ability of the students to put<\/p>\n<p>         the theory in to practice, by observing the students<\/p>\n<p>         during   the   teaching   practice   classes.     Elaborate<\/p>\n<p>         procedure   is   also   prescribed   by   the   University   for<\/p>\n<p>         award   of   such   internal   marks   in   Ext.P2   curriculam<\/p>\n<p>         for B.Ed course issued for the purpose.   That being<\/p>\n<p>         so, the performance in the theory papers cannot be<\/p>\n<p>         a   yardstick   for   the   purpose   of   standardisation   of<\/p>\n<p>         internal assessment marks, especially when there is<\/p>\n<p>         no provision authorising the University to do so.  As<\/p>\n<p>         such, I am satisfied that the University had no right<\/p>\n<p>         to   reduce   the   internal   marks   of   the   petitioners   in<\/p>\n<p>         these   writ   petitions.     Therefore,   there   would   be   a<\/p>\n<p>         direction to respondents 1  and 2 to reconsider  the<\/p>\n<p>         results   of   the   petitioners,   review   the   same   taking<\/p>\n<p>         into   account   the   full   internal   marks   awarded   to<\/p>\n<p>         them   by   the   concerned   teachers   of   their   colleges<\/p>\n<p>         and   publish   their   results   afresh   by   completing   the<\/p>\n<p>         said process.   This shall be done within a period of<\/p>\n<p>         two weeks from the date of receipt of a copy of this<\/p>\n<p>         judgment.&#8221;<\/p><\/blockquote>\n<p>       4.     The   situation   in   this   case   being   identical   the   above<\/p>\n<p>decision squarely applies to the present case.   Accordingly, I direct<\/p>\n<p>respondents   1   and   2   to   reconsider   the   results   of   the   petitioner,<\/p>\n<p>review the same taking into account the full internal marks awarded<\/p>\n<p>to   him   by   the   concerned   teachers   of   her   College   and   publish   her<\/p>\n<p>results  afresh   by  completing the  said process.    This  shall  be  done<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.13960\/07                   3<\/span><\/p>\n<p>within a period of two weeks from the date of receipt of a copy of<\/p>\n<p>this judgment.\n<\/p>\n<p>       The writ petition is disposed of as above.\n<\/p>\n<p>                                           S.
