SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.0.\tBy<br \/>\nway of this application under Section 482 of the Code of Criminal<br \/>\nProcedure, the applicant-original accused has prayed for following<br \/>\nreliefs:\n<\/p>\n<p>8(a).\tTo<br \/>\nstruck down condition no.2 imposed upon the applicant in order dated<br \/>\n3.5.2011 passed in Criminal Miscellaneous Application No.642 of 2010<br \/>\nby the learned Additional Sessions Judge, at Deesa, Banaskantha.\n<\/p>\n<p>8(b).\tTo<br \/>\ngrant one month&#8217;s more time to the applicant to deposit the remaining<br \/>\n10% of the amount as per the order dated 3.5.2011 passed in Criminal<br \/>\nMiscellaneous Application No.642 of 2010 by the learned Additional<br \/>\nSessions Judge, at Deesa, Banaskantha.\n<\/p>\n<p>2.0.\tShri Virat<br \/>\nPopat, learned advocate for the petitioner has submitted that after<br \/>\nthe order dated 3.5.2011 and on non deposit of remaining amount of<br \/>\n10% as per the order dated 3.5.2011, further order has been passed by<br \/>\nthe learned Magistrate against which the petitioner has preferred<br \/>\nCriminal Miscellaneous Application No.10962 of 2011. In view of the<br \/>\nabove, as such the present application is not required to be<br \/>\nentertained as it will be open for the applicant to pray for the<br \/>\nrelief which is sought in the present petition and the said Criminal<br \/>\nMiscellaneous Application. Under the circumstances, Shri Popat,<br \/>\nlearned advocate for the petitioner seeks permission to withdraw the<br \/>\npresent application with a liberty to submit an appropriate<br \/>\napplication for amendment in the said  Criminal Miscellaneous<br \/>\nApplication No.10962 of 2011 seeking relief which is sought in the<br \/>\npresent Criminal Miscellaneous Application. Permission is accordingly<br \/>\ngranted. Without further entering into the merits of the case and<br \/>\nwithout expressing anything on merits and with above liberty, present<br \/>\napplication is dismissed as withdrawn.
