NO. 26 OF 2003\n               = = = = = = = = = = = = = = =\n           Dated this the 23rd day of July, 2010.\n\n                    J U D G M E N T\n<\/pre>\n<p>    This  appeal     is     preferred        against  the<\/p>\n<p>judgment and decree passed by the III Additional<\/p>\n<p>Subordinate Judge, Ernakulam in O.S.90\/95.            The<\/p>\n<p>suit is one for partition and the trial court<\/p>\n<p>has decreed the suit and directed the properties<\/p>\n<p>to be divided into six equal shares and to allot<\/p>\n<p>one share to the plaintiff.           Then the question<\/p>\n<p>of equity etc. were considered and provisions<\/p>\n<p>are made to protect the interest of purchasers.<\/p>\n<p>It is against that decision defendants 1 to 16,<\/p>\n<p>18 to 20, 23, 26 to 33 have come up in appeal.<\/p>\n<p>The brief facts necessary for the disposal of<\/p>\n<p>the  appeal  are     stated      as      follows.     The<\/p>\n<p>properties  described     in     the    plaint    schedule<\/p>\n<p>belonged to one Mathunni, Pethru, Thressia and<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                           -2-<\/span><\/p>\n<p>Souro.     This Thressia and Souro had six children<\/p>\n<p>namely Joseph, Peter, Kalister, Thressia, Rosy<\/p>\n<p>and Merry.       The plaintiff is the daughter of<\/p>\n<p>Thressia.       D1 and D2 are Joseph and Peter<\/p>\n<p>respectively.      Defendants 3 to 5 are the legal<\/p>\n<p>representatives of Kalister.      Defendants 6 to 9<\/p>\n<p>are    the    legal  representatives  of  Rosy  and<\/p>\n<p>defendants       10   to    14   are    the   legal<\/p>\n<p>representatives of Merry.      During the pendency<\/p>\n<p>of the litigation first defendant died and his<\/p>\n<p>legal       representatives   are    impleaded   as<\/p>\n<p>defendants 29 to 33.     Defendants 15 to 18 and 19<\/p>\n<p>to 25 are purchasers of portions of the property<\/p>\n<p>and     defendants   26   to  28   are   the  legal<\/p>\n<p>representatives of one of the purchasers namely<\/p>\n<p>24th defendant.     It is the case of the plaintiff<\/p>\n<p>that the properties described in the plaint<\/p>\n<p>schedule belonged to her ancestors and therefore<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                          -3-<\/span><\/p>\n<p>on their death it had devolved on her as well.<\/p>\n<p>Her specific case is that an extent of 3 acres<\/p>\n<p>and 27 cents of the plaint schedule property<\/p>\n<p>belonged to Mathunni and Pethru and another<\/p>\n<p>extent of one acre and 13= cents belonged to<\/p>\n<p>Thressia(plaintiff&#8217;s grandmother wife of Souro).<\/p>\n<p>The plaintiff is claiming right over the entire<\/p>\n<p>properties.\n<\/p>\n<p>      2.   The defence is that a partition has been<\/p>\n<p>entered into as Ext.A1 in the year 1969 between<\/p>\n<p>three sons and their mother Thressia by virtue<\/p>\n<p>of which the properties are allotted only to the<\/p>\n<p>sons    and    the mother Thressia  has  not  been<\/p>\n<p>allotted any share but the executants to the<\/p>\n<p>document had reserved the right in favour of<\/p>\n<p>Thressia to enjoy the usufructs of the property<\/p>\n<p>mentioned in the document till her death.     There<\/p>\n<p>is also a provision whereby two daughters Rosy<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                           -4-<\/span><\/p>\n<p>and Merry as well as granddaughter Thressia<\/p>\n<p>namely     plaintiff   are  directed  to   be  paid<\/p>\n<p>Rs.500\/-      each.   Now  the  contention  of the<\/p>\n<p>plaintiff is that the said document is not<\/p>\n<p>binding on her for the reason that she is not a<\/p>\n<p>party to the proceedings and her right which is<\/p>\n<p>otherwise there in the property cannot be taken<\/p>\n<p>away    by     virtue of  the   execution  of  that<\/p>\n<p>document.      This is presumably on account of the<\/p>\n<p>principles laid down by the Hon&#8217;ble Supreme<\/p>\n<p>Court in Mary Roy&#8217;s case <a href=\"\/doc\/1888433\/\">(Mary Roy and others v.<\/p>\n<p>State of Kerala and others<\/a> (1986 KLT 508).       It<\/p>\n<p>is true that when there is a property right<\/p>\n<p>unless     there    is a  relinquishment   of  that<\/p>\n<p>property right it cannot be get extinguished.<\/p>\n<p>But now in this case I feel the case has to be<\/p>\n<p>compartmentalized      into    two,    i.e.   first<\/p>\n<p>compartment is with respect to 3 acres and 27<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                            -5-<\/span><\/p>\n<p>cents which belonged to Mathunni and Pethru, the<\/p>\n<p>second compartment is with respect to one acre<\/p>\n<p>and    13=     cents  belonging  to  Thressia,  the<\/p>\n<p>grandmother of the plaintiff.       So far as three<\/p>\n<p>acres    and    27  cents  are  concerned when  the<\/p>\n<p>plaintiff had acquired right in the property by<\/p>\n<p>virtue of the death of her mother without her<\/p>\n<p>junction the said right cannot be taken away.<\/p>\n<p>So any amount of assertion in Ext.A1 document<\/p>\n<p>would    not    militate  against   her  right  and<\/p>\n<p>therefore as the legal representative of her<\/p>\n<p>mother Threesia and as it is the daughter of<\/p>\n<p>Souro and Thrresia she will be entitled to 1\/6th<\/p>\n<p>shares as there were six children also to this<\/p>\n<p>couple.      Ext.A1 thus I hold will not affect the<\/p>\n<p>right of the plaintiff in the property.<\/p>\n<p>      3.   Now the next question is regarding one<\/p>\n<p>acre and 13= cents.          Even according to the<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                           -6-<\/span><\/p>\n<p>plaintiff it is the property which belonged to<\/p>\n<p>the grandmother, Thressia.     During the life time<\/p>\n<p>of Thressia in the year 1969 this property has<\/p>\n<p>been put into the common hotch pot and division<\/p>\n<p>has been effected between the sons and the<\/p>\n<p>mother whereby the mother had not reserved any<\/p>\n<p>right in her favour but only right to enjoy the<\/p>\n<p>income from the property.       Therefore by virtue<\/p>\n<p>of the provisions in the partition deed the<\/p>\n<p>mother had virtually given up her right in the<\/p>\n<p>property      and therefore when it is accepted the<\/p>\n<p>question of succession being opened to that<\/p>\n<p>property on the death of grandmother Thressia<\/p>\n<p>does not arise.      So I find that this one acre<\/p>\n<p>and 13= cents of property are not available for<\/p>\n<p>partition.\n<\/p>\n<p>      4.   Learned counsel for the appellant had<\/p>\n<p>then raised a contention of adverse possession<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                           -7-<\/span><\/p>\n<p>and    limitation    or  ouster.     The  classical<\/p>\n<p>decision       of  this  Court  regarding   adverse<\/p>\n<p>possession      between co-owners  is  reported in<\/p>\n<p>Krishnan v. Raman (1986 KLT SN 104 page 63).<\/p>\n<p>The Court held that,<\/p>\n<p>           &#8220;It may not be always possible<\/p>\n<p>           for each and every co-owner to be<\/p>\n<p>           in physical possession of the co-<\/p>\n<p>           ownership property. Some of them<\/p>\n<p>           or one of them alone may be in<\/p>\n<p>           actual   physical  possession and<\/p>\n<p>           others may be sharing rents and<\/p>\n<p>           profits from him or them.     Some<\/p>\n<p>           times    sharing   of  rents  and<\/p>\n<p>           profits itself may not be there<\/p>\n<p>           ans some of them or one of them<\/p>\n<p>           alone may be appropriating the<\/p>\n<p>           income without sharing the same<\/p>\n<p>           with other co-owners.      In all<\/p>\n<p>           these cases law presumes that the<\/p>\n<p>           co-owner or co-owners in actual<\/p>\n<p>           possession   is  or   are  so  in<\/p>\n<p>           possession   not  for  himself or<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                           -8-<\/span><\/p>\n<p>           themselves alone but on behalf of<\/p>\n<p>           other co-owners also.&#8221;\n<\/p>\n<p>      5.   Then this Court went on to consider the<\/p>\n<p>question and held that the classical principle<\/p>\n<p>to be followed in these types of cases are the<\/p>\n<p>principle of nec vi nec claim nec precario. That<\/p>\n<p>is, possession required must be adequate in<\/p>\n<p>continuity, in publicity and in extent to show<\/p>\n<p>that    its    possession  adverse   to the   rival<\/p>\n<p>claimant.\n<\/p>\n<p>      6.   Now at the outset I may like to state<\/p>\n<p>that the contention of the defendants is to the<\/p>\n<p>effect that the plaintiff does not have title<\/p>\n<p>over the property at all.     So according to them,<\/p>\n<p>the plaintiff does not have right over the<\/p>\n<p>property at all.       When they do not admit the<\/p>\n<p>right of the plaintiff necessarily there cannot<\/p>\n<p>be    any   hostile  animus   against that  person.<\/p>\n<p>Therefore the fundamental ingredient of hostile<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                            -9-<\/span><\/p>\n<p>animus does not come for consideration in this<\/p>\n<p>case    at    all.    Secondly   it is not  pleaded<\/p>\n<p>properly in the written statement from which<\/p>\n<p>date or which period the hostile animus starts.<\/p>\n<p>Therefore there is absolutely no materials to<\/p>\n<p>hold    in     favour  of  adverse  possession and<\/p>\n<p>limitation.        Therefore   the plea of  adverse<\/p>\n<p>possession and limitation or ouster also has to<\/p>\n<p>be negatived.\n<\/p>\n<p>      7.   So from these discussions I find the<\/p>\n<p>result of the case is to the effect that one<\/p>\n<p>acre and 13= cents of property which belonged to<\/p>\n<p>the grandmother Thressia is to be deleted from<\/p>\n<p>the partition decree and a preliminary decree of<\/p>\n<p>partition with respect to the other properties<\/p>\n<p>have to be passed as follows.          Therefore a<\/p>\n<p>revised preliminary decree is passed.<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                          -10-<\/span><\/p>\n<p>      (1) The   plaint schedule  properties  other<\/p>\n<p>than one acre and 13= cents of property which<\/p>\n<p>belonged to the grandmother Thressia is ordered<\/p>\n<p>to be divided into 6 equal shares and to allot<\/p>\n<p>one such share to the plaintiff.<\/p>\n<p>      (2) The   property which  belonged  to   the<\/p>\n<p>grandmother Thressia having an extent of one<\/p>\n<p>acre and 13= cents is excluded from partition.<\/p>\n<p>      (3) When the plaintiff&#8217;s share is worked out<\/p>\n<p>in the final decree as far as the property<\/p>\n<p>outstanding with the strangers be not allotted<\/p>\n<p>to her share and be allotted to the persons from<\/p>\n<p>whom the strangers have purchased the property<\/p>\n<p>so that equity can be worked out.<\/p>\n<p>      (4) The   plaintiff  shall be  entitled   to<\/p>\n<p>future profits as ordered by the trial Court,<\/p>\n<p>the quantum of which can be decided in the final<\/p>\n<p>decree proceedings and the respective persons in<\/p>\n<p>A.S. 26 OF 2003<br \/>\n<span class=\"hidden_text\">                          -11-<\/span><\/p>\n<p>possession be liable to pay the same to the<\/p>\n<p>plaintiff.     Parties are at liberty to apply for<\/p>\n<p>final decree proceedings.     Let the costs of the<\/p>\n<p>appeal as well as the of the suit come out of<\/p>\n<p>the estate.\n<\/p>\n<\/p>\n<p>                           M.N.
