Though  the appellant-landlord succeeded in  the  trial<br \/>\ncourt,\tthat  success was actually  short-lived.   The\tHigh<br \/>\nCourt  reversed the decree.  The landlord obtained a  decree<br \/>\nfor  eviction on the ground of bona fide need.\tHis plea  in<br \/>\nthe  plaint was that he was a Karta of the joint  family  of<br \/>\ntwo branches, namely, Sureshwar Sahay and Madheshwar  Sahay.<br \/>\nHowever, as PW 1 he deposed as under :\n<\/p>\n<blockquote><p>\t      &#8221;\t The disputed-house stands in the  names  of<br \/>\n\t      Sureshwar\t Sahay and Madheshwar Sahay.   Prior<br \/>\n\t      to them, this house belonged to their  mother,<br \/>\n\t      namely, Indramani Kunwar.\t She has a daughter,<br \/>\n\t      namely,  Girja Devi.  The name of\t Girja\tDevi<br \/>\n\t      was  not entered in mutation because  she\t did<br \/>\n\t      not raise<br \/>\n<span class=\"hidden_text\">\t      639<\/span><br \/>\n\t       any objection.  In 1982, Indramani Kunwar had<br \/>\n\t      died.    I  am  a\t Karta\tof  the\t family\t  of<br \/>\n\t      Madheshwar  Sahay.  The disputed land  belongs<br \/>\n\t      to both of the brothers.\tI am a Karta Khandan<br \/>\n\t      of half share.  There is no written  partition<br \/>\n\t      but  verbal partition has been made.   I\thave<br \/>\n\t      not  instituted  a case on behalf of  all\t the<br \/>\n\t\t\t    landlords  of  the house as I am  not  a  Kart<br \/>\na<br \/>\n\t      Khandan  of all the landlords.  From the\tvery<br \/>\n\t      childhood,  I knew the  defendant.   Formerly,<br \/>\n\t      the  defendant had opened a shop of  radio  by<br \/>\n\t      covering asbestos on my parti land which is by<br \/>\n\t      the side of the present shop.  He used to\t pay<br \/>\n\t      rent therefore but I cannot say whether he got<br \/>\n\t      receipts thereof or not.&#8221;\n<\/p><\/blockquote>\n<p>2.   Unfortunately,  this aspect of the matter has not\tbeen<br \/>\nproperly appreciated by the   trial court which ended in  a&#8217;<br \/>\ndecree in favour of the landlord.  The High court,     finding<br \/>\nthat the landlord does not represent the branch of Sureshwar<br \/>\ncame to the view that he does not represent the entire\tbody<br \/>\nof  co-sharers and partition had not been proved, so  as  to<br \/>\nestablish that the suit property had been allotted in favour<br \/>\nof  the\t branch represented by the landlord.   In  assailing<br \/>\nthese findings two  contentions are urged before us :\n<\/p>\n<blockquote><p>\t      (1)   Section II (1)(c) of the Bihar Buildings<br \/>\n\t      (Lease, Rent and Eviction) Control  Act<br \/>\n\t      whereunder  the  landlord is enabled  to\tseek<br \/>\n\t      eviction,\t not only on his own behalf, but  on<br \/>\n\t      behalf  of  any person for whose\tbenefit\t the<br \/>\n\t      building\tis held by him, and (2) Section\t 116<br \/>\n\t      of  the Evidence Act raising a presumption  in<br \/>\n\t      favour of the landlord.\n<\/p><\/blockquote>\n<p>3.   We\t find neither of these contentions could be held  to<br \/>\nbe  tenable.   No  doubt,  Section  11\t(1)(c)\tenables\t the<br \/>\nlandlord  to seek eviction on the ground that he  reasonably<br \/>\nand in good faith requires\n<\/p>\n<p>(a)  for  his  own occupation or for the occupation  of\t any<br \/>\nperson; or\n<\/p>\n<p>(b)  for the occupation of any person for whose benefit\t the<br \/>\nbuilding is held by him.\n<\/p>\n<p>4.   But  in  this  case, having regard\t to  the  deposition<br \/>\nextracted above, the landlord does not represent the  branch<br \/>\nof  Sureshwar Sahay.  Therefore, not the person holding\t the<br \/>\nbuilding  on behalf of that branch.  As regards Section\t 116<br \/>\nof  the Evidence Act, no doubt, the tenant is estopped\tfrom<br \/>\ndenying the title of the landlord, but the case proceeded on<br \/>\nbona  fide  need and, therefore, this will  not\t affect\t the<br \/>\nfinding\t in  relation  to that bona fide  need.\t  The  civil<br \/>\nappeal will stand dismissed.
