Justice A.K.BASHEER\n\n Dated :07\/12\/2006\n\n O R D E R\n                    (M.RAMACHANDRAN &amp; A.K.BASHEER,  JJ)\n\n             -------------------------------------------------------------\n\n\n                       Writ Appeal No. 2309 of 2006\n\n\n         --------------------------------------------------------------\n\n                  Dated this the 7th day of December, 2006\n\n\n                                   JUDGMENT\n<\/pre>\n<p>Ramachandran, J:\n<\/p>\n<p>       Appellant was the petitioner in W.P.(C).No.27953  of 2005.\n<\/p>\n<p>Feeling   aggrieved   about   the   judgment   dated   27-09-2006,   this<\/p>\n<p>appeal has come to be filed.\n<\/p>\n<p>       2.        A   minor   penalty   had   been   imposed   on   the<\/p>\n<p>appellant\/petitioner,   who   was   working   as   Executive   Engineer<\/p>\n<p>under   the   Kerala   State   Electricity   Board.     There   was   also   a<\/p>\n<p>proposal   for   recovery   of   Rs.11,137\/-   being   the   proportionate<\/p>\n<p>amount of loss sustained by the Board.  The learned single Judge<\/p>\n<p>found   that   in   the   matter   of   recovery,   legal   formalities   have   not<\/p>\n<p>been   complied   with   and   thereupon   had   remitted  the   matter   for<\/p>\n<p>being considered afresh.\n<\/p>\n<p>       3.        Mr.P.Ali, appearing for the appellant, submits that in<\/p>\n<p>the matter of penalty as well it may be possible for the appellant<\/p>\n<p>to   bring   in   fresh   materials   and   a   reconsideration   at   the<\/p>\n<p>appropriate level is therefore warranted.\n<\/p>\n<p>       4.        We   had   heard   the   learned   standing   counsel   for   the<\/p>\n<p>Kerala   State   Electricity   Board.
