1.\tBy
\nthis application, the applicant has prayed for the following
\nsubstantive relief:-\n<\/p>\n
\t?S12(C)
\nto transfer the Criminal Case No.116 of 2002 from the Court of the
\nlearned Chief Metropolitan Magistrate, Ahmedabad, to the Court of the
\nlearned Chief Metropolitan Magistrate, Vadodara for its fresh trial
\nand adjudication in the interest of justice, by declaring and holding
\nthat the Court of learned Chief Metropolitan Magistrate, Vadodara is
\ncompetent and having jurisdiction to try and adjudicate upon the
\nCriminal Case No.116 of 2002.??\n<\/p>\n
2.\tThe
\nfacts stated briefly are that the applicant herein in his capacity as
\nJoint Managing Director of Surat Nagarik Sahakari Bank Ltd. had
\nduring his tenure lodged a complaint against the respondents No.3 to
\n6 herein alleging commission of offences punishable under sections
\n408, 409, 468, 469, 471, 201 and 109 of the Indian Penal Code (IPC)
\nbefore the Director General of Police , Economic Offence Cell, CID
\nCrime Branch, (Vadodara Zone), Gujarat State ?  respondent No.2
\nherein, which came to be registered as an FIR vide CID Crime Branch,
\nVadodara Zone I C.R. No.1 of 1999.\n<\/p>\n
3.\tUpon
\nculmination of investigation, charge sheet was submitted in the Court
\nof the learned Chief Metropolitan Magistrate, Ahmedabad and the same
\ncame to be registered as Criminal Case No.116 of 2002. It appears
\nthat in the said proceedings, the learned Assistant Public Prosecutor
\nhad on 18th January, 2007 filed an application at Exhibit
\n6 inter alia praying for transfer of the said case to the Court of
\nthe learned Chief Metropolitan Magistrate at Vadodara on the ground
\nthat in view of the circular of the Home Department, State of
\nGujarat, the said Court would have jurisdiction to try the case. By
\nan order dated 18th January, 2007, the learned Chief
\nMetropolitan Magistrate, Ahmedabad rejected the application on the
\nground that the said Court has no power to transfer a case from one
\ndistrict to another district. As the State Government has not carried
\nthe matter any further, the applicant herein being the original
\ncomplainant has filed the present application praying to transfer the
\ncase from the Court of the learned Chief Metropolitan Magistrate,
\nAhmedabad to the Court of the learned Chief Metropolitan Magistrate,
\nVadodara.\n<\/p>\n
4.\tHeard
\nMr. Dhirendra Mehta, learned advocate for the applicant and Mr. K.P.
\nRaval, learned Additional Public Prosecutor appearing on behalf of
\nrespondents No.1 and 2. Despite service of notice, there is no
\nappearance on behalf of respondents No.3 to 6.\n<\/p>\n
5.\tMr.\n<\/p>\n
Dhirendra Mehta, learned advocate for the applicant has submitted
\nthat the offence in question has been committed at Surat against the
\nBank which is situated in the city of Surat and therefore, the
\napplicant had lodged the complaint with the respondent No.2 and the
\ninvestigation was carried out by the Police Sub Inspector, CID Crime
\nBranch, Surat city. It is submitted that such economic offences are
\ndealt with, investigated and prosecuted by the respondent No.2 under
\nits Vadodara zone office and for that purpose, the competent Court,
\nwhich can have the jurisdiction as per the circular of the Home
\nDepartment of the State of Gujarat is the Court of the learned Chief
\nMetropolitan Magistrate at Vadodara.\n<\/p>\n
6.\tIt
\nis further submitted that after investigation, the charge sheet came
\nto be submitted by the respondent No.2 before the learned Chief
\nMetropolitan Magistrate at Ahmedabad. The apprehension of the
\napplicant is that such irregularities may vitiate the entire
\nproceedings and ultimately may cause serious prejudice and grave
\ninjustice, if the proper Court having jurisdiction over the criminal
\ncase does not conduct the trial. That the accused persons, if
\nadversely affected by the final outcome may get undue benefit by
\nraising a contention regarding the decision being void for want of
\njurisdiction on the part of the concerned Court. Reliance is placed
\nupon a circular of the Home Department of the State of Gujarat, to
\nsubmit that the case is required to be tried and adjudicated by the
\nCourt of the  learned Chief Metropolitan Magistrate, Vadodara, as the
\ncase falls within the purview of the Vadodara zone of the office of
\nthe respondent No.2. It is accordingly urged that the application be
\nallowed and the case be transferred from the Court of the  learned
\nChief Metropolitan Magistrate, Ahmedabad to the Court of the  learned
\nChief Metropolitan Magistrate, Vadodara.\n<\/p>\n

\nthe other hand, Mr. K.P. Raval, learned Additional Public Prosecutor
\nhas drawn the attention of the Court to the affidavit-in-reply filed
\non behalf of the respondent No.2 in response to the present
\napplication, wherein it is stated that the complaint was lodged by
\nthe applicant herein before the Vadodara zone of the respondent No.2
\non 16th February, 1999. Pursuant to the registration of
\nthe said complaint, investigation was taken over by the Police
\nInspector P.S. Pathak, CID Crime, Surat Unit. Subsequently, the
\ninvestigation was handed over to Shri B.S. Pathan, Police Inspector,
\nCID Unit. Thereafter, by an order dated 1st March, 2001
\nmade by the Additional Director General of Police, CID Crime and
\nRailways, Gujarat State, Gandhinagar, the investigation had been
\ntaken over by Shri V.S. Shevale, Police Inspector, Economic Cell,
\nGandhinagar Camp, Meghaninagar, Ahmedabad on 11th March,
\n2001. That the said investigating officer submitted charge sheet on
\n31st January, 2002 in the Court of the learned Chief
\nMetropolitan Magistrate, Ahmedabad. It is categorically averred in
\nthe affidavit-in-reply that as per the notification dated 10th
\nFebruary, 1980 issued by the Home Department, State of Gujarat under
\nsection 173(2) of the Code of Criminal Procedure, 1973 (the Code),
\nthree police stations were sanctioned, on the basis of which, the
\noffence in question which had taken place at Surat was registered
\nwith the Vadodara zone. That thereafter, the investigation has been
\ntransferred to the Economic Offence Cell, Gandhinagar Cell Camp
\nOfficer, Ahmedabad. It is further averred that all cases investigated
\nand filed by the Crime Branch Police of the State CID, office of
\nwhich is situated in the Director General of Police and IGP’s office,
\nAhmedabad fall within the jurisdiction of the learned Chief
\nMetropolitan Magistrate, Ahmedbad. It is pointed out that accordingly
\nthe learned Chief Metropolitan Magistrate, Ahmedabad had issued an
\norder No.A(VI) 1984 clarifying that all the cases investigated and
\nfiled by the Crime Branch Police of the State CID, office of which is
\nsituated in the Director General of Police and IGP’s office,
\nAhmedabad fall within the jurisdiction of the  learned Chief
\nMetropolitan Magistrate, Ahmedabad. The learned Additional Public
\nProsecutor has accordingly submitted that the present case would fall
\nwithin the jurisdiction of the  learned Chief Metropolitan
\nMagistrate, Ahmedabad and that no case is made out for transferring
\nthe same.\n<\/p>\n
8.\tThis
\nCourt has considered the submissions advanced by the learned
\nadvocates for the parties and has perused the record of the case. A
\nperusal of the notification dated 10th February, 1980
\nissued by the Home Department in exercise of powers conferred by
\nclause (a) of section 2 of the Code of Criminal Procedure, 1973 (the
\nCode) shows that the State Government has declared the places
\nspecified in column 2 of the Schedule appended thereto to be a police
\nstation and has directed that each of such police station shall
\ninclude the areas specified against them in column 3 of the said
\nSchedule. Under serial No.2 of the said Schedule, the office of the
\nDeputy Superintendent of Police, CID Crime, Baroda unit, Baroda has
\nbeen specified as a Police Station for Baroda City, Baroda Rural,
\nSurat City, Surat Rural, Bharuch, Valsad, Dangs and Panchmahals
\ndistricts. Hence, the offence in question has rightly been registered
\nwith the office of the CID Crime Branch, Vadodara.\n<\/p>\n
9.\tHowever,
\ninsofar as the jurisdiction of the Court is concerned, the Chief
\nMetropolitan Magistrate Court, Ahmedabad is vested with the
\njurisdiction to try all cases investigated and filed by the Crime
\nBranch Police of the State CID, office of which is situated in the
\nDirector General of Police and IGP’s office, Ahmedabad. In the facts
\nof the present case, the case was initially investigated by the
\nofficer of the CID Crime Branch, Vadodara but was subsequently
\ntransferred to the officer of the Economic Cell, Gandhinagar Camp,
\nMeghaninagar, Ahmedabad, who concluded the investigation and
\nsubmitted the charge sheet before the Chief Metropolitan Magistrate
\nCourt, Ahmedabad. In the circumstances, as the case was investigated
\nand filed by an officer of the Crime Branch Police of the State CID,
\noffice of which is situated in the Director General of Police and
\nIGP’s office, Ahmedabad, the jurisdiction to try the case lies with
\nthe  Chief Metropolitan Magistrate Court, Ahmedabad. In the
\ncircumstances, no case is made out for transfer of the said case from
\nthe Court of the learned  Chief Metropolitan Magistrate, Ahmedabad to
\nthe Court of the learned  Chief Metropolitan Magistrate, Vadodara.\n<\/p>\n
10.\tFor
\nthe foregoing reasons, the application fails and is, accordingly,
\nrejected. Notice is discharged. Interim relief, if any, stands
\nvacated.\n<\/p>\n
