Justice ANTONY DOMINIC\n\n Dated :26\/02\/2008\n\n O R D E R\n                          ANTONY DOMINIC, J.\n\n                        ===============\n\n                     W.P.(C) NO. 6543 OF 2008 D\n\n                   ====================\n\n\n            Dated this the 26th day of February, 2008\n\n\n                              J U D G M E N T\n<\/pre>\n<p>      Petitioner   contends   that   for   realising   the   debts   of   the   3rd<\/p>\n<p>respondent, revenue recovery proceedings were initiated and that<\/p>\n<p>properties   belonging   to   the   petitioner   have   been   attached   by<\/p>\n<p>Ext.P4.     It   is   submitted   that   following   the   attachment,   the<\/p>\n<p>petitioner   had   filed   Ext.P5   claim   petition   invoking   the   power   of<\/p>\n<p>the   1st  respondent   under   Section   46   of   the   Revenue   Recovery<\/p>\n<p>Act.   In this  writ petition, the relief sought  for  is  essentially  for<\/p>\n<p>expediting   orders   on   Ext.P5   claim   petition   keeping   in   abeyance<\/p>\n<p>further proceedings pursuant to Ext.P4.<\/p>\n<p>      2.     Having   heard   the   counsel   for   the   petitioner   and   also<\/p>\n<p>the learned Government Pleader on this, I am satisfied that the<\/p>\n<p>petitioner is entitled to the aforesaid relief.<\/p>\n<p>      3.     Accordingly,   I   dispose   of   this   writ   petition   directing<\/p>\n<p>that   the   1st  respondent   shall   take   up   and   consider   Ext.P5.   This<\/p>\n<p>WPC 6543\/08<\/p>\n<p><span class=\"hidden_text\">                                       :2 :<\/span><\/p>\n<p>shall be done, as expeditiously as possible, at any rate within six<\/p>\n<p>weeks   of   production   of   a   copy   of   this   judgment.
