    Petitioner is the accused in C.C.368\/2007<\/p>\n
on the file of Judicial First Class Magistrate<\/p>\n
Court II, Neyyattinkara.    When the case was<\/p>\n
posted for questioning   under section 313 of<\/p>\n
Code of Criminal Procedure, petitioner filed<\/p>\n
Crl.M.P.1210\/2009   before   Sessions    Court,<\/p>\n
Thiruvananthapuram.  Annexure-I is the copy of<\/p>\n
the said petition filed under section 408 of<\/p>\n
Code of Criminal Procedure for transfer.  It is<\/p>\n
alleged in the petition that the complainant in<\/p>\n
that case is the Principal of N.S.S College and<\/p>\n
though he is the uncle of the petitioner, they<\/p>\n
are on inimical terms in respect of family<\/p>\n
properties and  Judicial First Class Magistrate<\/p>\n
is showing undue interest in the case and the<\/p>\n
counsel was absent at the time of recording the<\/p>\n

evidence and it is understood that the Magistrate<\/p>\n
was a student of the complainant and personally<\/p>\n
known to him.       Petitioner also stated that at the<\/p>\n
time of cross examination of witness on 28.4.2009 a<\/p>\n
photostat copy of report was sought to be marked<\/p>\n
which was objected and as the original was not<\/p>\n
found the case was adjourned and on the adjourned<\/p>\n
day a report styled as original was produced which<\/p>\n
was marked as        exhibit. When the counsel for the<\/p>\n
petitioner       started cross  examining  the  witness<\/p>\n
challenging the veracity of the document,       learned<\/p>\n
Magistrate intervened whether this is the only case<\/p>\n
for trial and the       case was posted for questioning<\/p>\n
under section 313. According to petitioner,          he<\/p>\n
does not expect a fair decision from the Magistrate<\/p>\n
and therefore the case is to be transferred.<\/p>\n
      2. In view of the allegations raised against<\/p>\n
the Magistrate, learned Sessions Judge called for<\/p>\n
remarks from the Magistrate.        The Magistrate has<\/p>\n
denied all the allegations.       The learned Sessions<\/p>\n

Judge       in   the  light  of  the  remarks   and  the<\/p>\n
allegations raised by the petitioner, after hearing<\/p>\n
his      counsel dismissed it under Annexure A2 order.<\/p>\n
This petition is filed for transfer contending that<\/p>\n
the     petitioner    will  not  get  justice  from  the<\/p>\n
learned Magistrate.\n<\/p>\n
      3.         Learned  counsel   appearing  for   the<\/p>\n
petitioner        vehemently   argued   that   all   the<\/p>\n
allegations raised by the petitioner in Annexure A1<\/p>\n
petition         was not met in Annexure A2 order and<\/p>\n
petitioner is entitled to get a fair trial which is<\/p>\n
denied consequent to the refusal to transfer and so<\/p>\n
the case is        to be transferred to any other  court<\/p>\n
at Neyyattinkara and          hence    transfer may be<\/p>\n
ordered.\n<\/p>\n
      4.      On hearing the learned   counsel and going<\/p>\n
through the reasoned order passed by the Sessions<\/p>\n
Judge, I find no reason to order transfer.            As<\/p>\n
stated by the Sessions Judge, if the case of the<\/p>\n
petitioner        was  that  he   did  not   get  proper<\/p>\n

opportunity to cross examine the witness, he could<\/p>\n
have filed an application to recall the witness for<\/p>\n
the purpose of further cross examination.        Inspite<\/p>\n
of the          opportunity granted, petitioner has not<\/p>\n
moved the learned Magistrate.        If a case is to be<\/p>\n
transferred by raising such baseless allegations,<\/p>\n
lower judiciary cannot function.       I find no reason<\/p>\n
to transfer the case as sought for.<\/p>\n
      Petition is dismissed.      Petitioner is entitled<\/p>\n
to challenge the judgment of the trial court, if it<\/p>\n
goes against him and in that event        he is entitled<\/p>\n
to    raise all the contentions raised herein also.<\/p>\n
