State.-&#8216;.V4 , iv<\/p>\n<p>3.2 2 Vlllinhlorief, the inter se relationship of some of the<\/p>\n<p> A prosecution witnesses and the case of prosecution are as<\/p>\n<p>A&#8217;  follows:~<\/p>\n<p>as 3<br \/>\nPW1\u00bbRajaiah.C &#8212; the first informant is the father of<\/p>\n<p>PW2&#8211;Sharadamma {Wctim}. PW4\u00bb\u00bbAnitha <\/p>\n<p>were classmates of PW2. During the year 200&#8217;O5_:PW:2.x <\/p>\n<p>PW6 were studying in 11 year y_ 0\u00abCo11&#8217;e0gex'&#8221;&#8216;at 0?<\/p>\n<p>Malur. PW2 was aged about 20 yea_rs&#8217;.__A.PW1 as<\/p>\n<p>Health Inspector at Malur. Accused &#8220;No..1&#8217;wa_sRaV&#8221;student of<\/p>\n<p>\ufb01nal year B.A. of same c:&gt;neg\u00e9a;&#8221;Acr:used&#8221;2&#8211;~ are the<br \/>\nassociates of accused&#8221;No&#8217;.&#8217;1&#8217;\u00a7fNLo&#8217;.4 is the father of<\/p>\n<p>accused No._1 hover property held<\/p>\n<p>andZ&#8221;possesesed\ufb01?-gidy  Therefore, accused No.1 had<br \/>\nintent:-&#8216;on._ to  and marry her. In order to<br \/>\naccomplish such iA11~ega1&#8243;b0Vacts, accused No.1 had taken the<\/p>\n<p> ofAAaccu.se&#8217;d 2 &amp; 3 and accused No.4 ~&#8211; father of<\/p>\n<p>&#8216; .\u00bbVaec&#8217;u&#8217;s.edr  had supported accused No.1 to accomplish<\/p>\n<p>&#8221; .$t:\u00a2h ii&#8217;1\u00a2?gg1&#8217;s&#8217;a&#8217;\u00a2ts.\n<\/p>\n<p>  on 11.05.2000 at about 12.30 pm. (afternoon),<\/p>\n<p>it * .PW2VVaiong with PVV4 &lt;3: PW6 were returning after writing II-<\/p>\n<p> year BA. examination and they were walking on the road in<\/p>\n<p>&#039;0 front of JSS College, at that time, accused No.1 came in a<\/p>\n<p>}&quot;\\_s,  &#039;-e 6}!\u00bb-&#039;~\u00ab-5\u00a3\u20ac&#039;kr &#039;<\/p>\n<p>Tata Sumo vehicle bearing No.KA~O8rM~\u00bb33O and Vefpforcibly<\/p>\n<p>abducted PW2 and took her to different places. &quot;E0<\/p>\n<p>3 took PW2 to a temple, accused No.1 forcih_1jf&quot;tiedZVA_ia  if <\/p>\n<p>the neck of PW2 to marry her. Achcufsfed&#039;   3&#039; &quot;azei&#039;e_Vall&#039;:aloi&#039;:g<\/p>\n<p>assisting commission of above illegalfacts by_&#039;v_laccu&#039;sed&#039; &#039;N.o.i..,<\/p>\n<p>On the date of incident, at about 5 .p;rn.,&#039; first<br \/>\ninformation stating that accu&#039;se&#039;d.d1VVV&#039;to._3 have abducted his<br \/>\ndaughter [PW2} and these offf&#039;-accused 1 to 3 were<\/p>\n<p>supported    of accused No.1. The<\/p>\n<p>policefftracetd,   7 daysgwhen accused 1 to 3 and<\/p>\n<p>PW2 \u00a722rere_ rnovingjinfia_.carfn,ear Hosakote. Accused No.1 to 3<\/p>\n<p>were arrested and Was given to the custody of PW]. The<\/p>\n<p> aOlfficer\u00ab,&#039; after completion of investigation, filed<\/p>\n<p>V .=Vc11.arge:&#039;shcet&#039; against accused 1 to 4 for aforestated offences.<\/p>\n<p>4;,  trial, PW1 to PW9 were examined and<\/p>\n<p> AA docurnents as per Ex.P.1 to Ex.P.8 were marked so also<\/p>\n<p>  &#039;=n;1_ateria1 objects as per M.O.1 :3: M.O.2 were marked. The<\/p>\n<p> photographs produced by the defence were collectively<\/p>\n<p>marked as Ex.D.1 to Ex.D.5. IL).\n<\/p>\n<p>AA 5 __<\/p>\n<p>5. The learned trial Judge on appreciation of -eifidence<\/p>\n<p>and after hearing learned counsel for parties-.\u00a7.&#8217;phpafcq\u00e9ritfed<\/p>\n<p>accused 2 to 4 for aforestated offencesqand&#8217;ipiconxrictedV&#8217;<\/p>\n<p>accused No.1 for an offence punishable und.ere:_sect.ion&#8217; 366<\/p>\n<p>{PC and sentenced him as peaforestated. &#8216;l&#8217;herefore;~ <\/p>\n<p>No. 1 has filed this appeal.\n<\/p>\n<p>6. In View of convfction  accusefd&#8217;~&#8211;No.1 andfacquittal of<br \/>\naccused 2 to 4, the  .&#8221;poir1fts__&#8217;.&#8217;&#8211;~would arise for<\/p>\n<p>deterrninationi  &#8216;\\  &#8216;<\/p>\n<p> {1} &#8211;Whei&#8217;.her&#8217;Vt.he-.pro_secution has proved that on<br \/>\nA&#8217; pp  12.30 p.m., {afternoon}<br \/>\nVdaccused Al:-IVo.&#8217;1..&#8217;=&#8221;Srinatha forcibly took PW2&#8211;<br \/>\nS.l{&#8220;Sharadamma when she was coming out<br \/>\nJSS v\u00e9ollege at Malur after writing ll year<\/p>\n<p>V  \u00bb.4B.,:A1examination in a TATA Sumo vehicle<br \/>\n &#8216;  No.KA-08\u00bb~l\\\/E-330 and kept her in<br \/>\n2 2 &#8216;different places and he forcibly tied thali to<br \/>\nher neck to marry her and thereby<\/p>\n<p>committed an offence punishable under<\/p>\n<p>section 366 IPC?\n<\/p>\n<p> _kNC}LU.W&#8230; ;{&lt;<\/p>\n<p>&quot;.5 M<\/p>\n<p>(2} Whether the learned trial Judge has   i\/<br \/>\nappreciated evidence on record?  xi&quot; &#039;M &quot;\n<\/p>\n<pre>(3) Whether the impugned'  '1    _ \n\ninterference?\n\n(4) What order?\"\n\n<\/pre>\n<p>7&#8242;. Before adveriiflg.  evidence in proof of<br \/>\nthe above, it  v&#8217;r1eeess2&gt;;ry&#8221;Atov&#8217;&#8211;  at the time of<br \/>\nincident, _    and she was<br \/>\nstudyirigv in   $0.1 was studying in III<\/p>\n<p>year:&#8217;&#8211;,_B.A.&#8211;  &#8216;eoi&#8217;ie.ge&#8211;. PW} was working as Health<br \/>\nInspector at Malurg&#8217; ,. &#8221;\n<\/p>\n<p>8; E  per  case of prosecution, incident of abduction of<\/p>\n<p>&#8216; No.1 took place at 12.30 pm. (afternoon) on<\/p>\n<p>H *  &#8211;.iIii:=.vfro-nt of JSB Coilege at a  of half a<\/p>\n<p>  from Meier Police Station. The incident of<\/p>\n<p>  A&#8217; ahciucfion took.&#8221; &#8220;piece VVi\ufb021il&#8217;1 ptibiic visiorg. At _.&#8217;tif;_e  cf.  H<\/p>\n<p> incident, PW2 was in the company of her classmates namely<\/p>\n<p> I?&#8217;W4&#8211;Anitha an\u00e9 PW6-Radha. As could be gathered from<\/p>\n<p>time and place of incident, incident is alleged to havle&#8221;&#8216;t.aken<\/p>\n<p>place when PW2 had come out of college after v:ritlu1ig_&#8217;__il&#8217;.j&#8217;year<\/p>\n<p>B.A.examination. It is obvious that the othe_r&#8217;jA&#8217;stud_ent&#8217;s afteif V&#8217; <\/p>\n<p>Writing examination were also rncavinglon, road&#8217; in.fi&#8217;ront&#8221;of the<\/p>\n<p>college. The incident is alleged to havetaken  in m5&#8217;1n;0o\u00a3<\/p>\n<p>JSS College in a broad  at la._l&#8217;disti1nlc&#8221;eWof half a<br \/>\nkilometer from Malur&#8217;JPolice.&#8221;Stati.o:n.TPW6 hasladniitted that<br \/>\npeople were moving onlthe  whenfincident took place.<\/p>\n<p>Even then, none &#8220;of the pnljlic~.ven&#8217;ftt1i&#8217;edlfto prevent abduction<\/p>\n<p>of RW2&#8243;byfrgtceilggedil&#8221;ix\u00e9gs.1. twat, who is alleged to have<br \/>\nwitnessed. the not inform the Principal of the<br \/>\ncollege or&#8221;t~he&#8217; jiiri-sdictiorfial police. After the incident, none of<\/p>\n<p>.infonned&#8221;t&#8217;ie&#8212;-\u00abtr1atter to juiisdictional police regarding<\/p>\n<p>V  a young college girl by accused No.1, which<\/p>\n<p>.0 took place_ oiibroad day light at a distance of half a kilometer<\/p>\n<p>from jurisdictional Police Station. PW1~Rajaiah.C &#8212; the father<\/p>\n<p>0   of\u00ab&#8211;PWO lodged first information at 5 pm. on 11.05.2000.<\/p>\n<p> 9. During examination&#8211;in&#8211;chief, PW6&#8211;Radha has deposed;<\/p>\n<p>that on 11.05.2000 at 1.30 p.m., after writing examination,<\/p>\n<p>PW2, PW-4 81 PW6 and others were walking on thewlroad in<\/p>\n<p>front of JSS College and some persons <\/p>\n<p>took PW2 in a car. PW6 informed the matterio;  V&#8217; <\/p>\n<p>of PW2).\n<\/p>\n<p>During cross~exarnination, 15\\V(5:&#8221;has adrnitted <\/p>\n<p>road on which PW2. PW4  were a busy<\/p>\n<p>road and it was at adistance&#8221;&#8216;of&#8217;h&#8217;a.1.l;&#8221;a.._kilorne&#8217;ter&#8221;from Malur<br \/>\nPolice Station; there are :_house&#8221;sJor_1_:eit_h.er=_side of the road;<\/p>\n<p>though PW6..mised hiue  cry,.&#8217;rl&#8217;i1one&#8221;-came to rescue PW2;<\/p>\n<p>PW6:  even registration number of TATA Sumo<br \/>\nvehicle; PW2 taken by accused No.1 and others.<br \/>\nPW_6_ has &#8220;deposed; is-hlewi\/as advised to inform the matter to<\/p>\n<p>PW6  go to Malur Police Station. PW6 has<\/p>\n<p>V  deposedi; ivafterone week, PW2 contacted PW6 over phone and<\/p>\n<p>it 2  she had safely returned home.\n<\/p>\n<p> 10. H v.V__l\u00a7&#8217;W4&#8211;Anitha, who is alleged to have witnessed the<\/p>\n<p>V&#8217; &#8216;V.i_n:cfident, has not supported the case of prosecution. PW-4<\/p>\n<p> was declared as a hostile witness for resiling from her<\/p>\n<p>statement recorded under section 161 Cr.P.C. Even during<\/p>\n<p>crossmexamination by the learned Public Prosecuto_r&#8217;}a.PW4<br \/>\nhas not given any incriminating evidence aga;ms:&#8217;Va\u00a2\u00a2:u_s&#8221;ed<\/p>\n<p>No.1.\n<\/p>\n<p>11. As already stated, PW} lodged  1ri\u00a3onn;a:i.;$1\u00a7ii*s\ufb01rmg<\/p>\n<p>evening on the date of &#8216;in&#8217;c;dent.A&#8217;v-  first&#8217;<\/p>\n<p>information on the basis of ~he&#8217;h_ad  frofn others.<\/p>\n<p>12. On careful consideration ?of of PW6, I \ufb01nd<\/p>\n<p>that her evid=er&#8217;1ce:&#8217;does not .si:1spire&#8217;.jconfidence. The conduct of<\/p>\n<p>PW6 &#8216;at&#8221;tic1e:itimeiiof in&#8217;cid-entdandvafter the incident is highly<br \/>\nunnatural. The PW6 that PW2 was abducted or<br \/>\nforcibly xtalien by  No.1 in broad day light from a<\/p>\n<p> _road&#8217;Asitt1at.e at a distance of half a kilometer from<\/p>\n<p>&#8216; .lIV{aluvrV4Police&#8217;Station and no body came to rescue PW2 looks<\/p>\n<p>&#8221; .ui1natu1&#8217;aj}:.  per the evidence of PW6, the incident occurred<\/p>\n<p>urithirilyypublic vision. PW6 raised hue and cry and no body<\/p>\n<p>2 it came\ufb02lto rescue PW2. PW6 did not go to Police Station to<\/p>\n<p>  the incident of abduction of PW2 and PW6 has not<\/p>\n<p>t given reasons for her unnatural conduct. The evidence of<\/p>\n<p>N  vcfa <\/p>\n<p>\u00bb 10<br \/>\nPW6 that accused No.1 had chosen a crowded road to<\/p>\n<p>abduct PW2 looks improbable. PW6 has deposed;&#8221;shef&#8217;~had<\/p>\n<p>informed PW1 {father of PW2} soon after <\/p>\n<p>then PW1 had not Eodged first information&#8217;inirnrediateiyd.  <\/p>\n<p>first information was lodged   thefV{iiate:1.c_of<\/p>\n<p>incident. Therefore, the evidence of  Laci\u00e9sffcre.dibi1&#8217;ityv.d <\/p>\n<p>the circumstances, we are  the \u00ab.ei_?iden\u20acte of PW2<br \/>\n{Victim}.\n<\/p>\n<p>13. PW2&#8211;Shat*a,dam.rna&#8221;11as   the year 2000,<\/p>\n<p>she was__ fB.A in the Junior College at<br \/>\nMalurr   from Shettikothanoor to the<\/p>\n<p>co\u00a7;1ege..every&#8217;-\u00bbc1ay;V&#8221; accused No.1 was studying in III year BA.<\/p>\n<p>   coiiege;  11.05.2000 at 12.30 p.m. (afternoon),<\/p>\n<p>I   aftefr-wri.ti1ig-examination, PW2, pwz; 8: PW6 were returning<\/p>\n<p>Ah-omeV_;v&#8217;acc.i;1sed No.1 came from her behind; gagged her and<\/p>\n<p> AA forcibigf&#8217; took her in a Tata Sumo vehicle; PW2 was taken to a<\/p>\n<p>  &#8216;rhojiise and she was con\ufb01ned in that house for a day;<\/p>\n<p> thereafter PW2 was taken to different places.<\/p>\n<p>Rf  ,.;_.,,.\n<\/p>\n<p>N11 _<\/p>\n<p>14. At this juncture, I deem it necessary to state th,_a&#8217;L.PW2<\/p>\n<p>has not deposed that she was abducted by <\/p>\n<p>when she was walking on the road, in frontlV_A4of.phey. ;_o11\u00e9gfe,; <\/p>\n<p>PW2 has deposed that accused  1 f_c4ame\u00ab_gfron1:_.herv<\/p>\n<p>gagged her and forcibly took_h_er inlay Tata Su:rrio&#8217;A.vehicle;&#8221;this.L<\/p>\n<p>is in contradiction of the evidence of PW.E_i,&#8217;v.rho fhaslldeposedl<br \/>\nthat not only accused No.1 ;but&#8217;some&#8217;.other &#8216;persons forcibly<br \/>\ntook PW2 in a car. The evid\u00a2;::e of that accused No.1<\/p>\n<p>alone gagged &#8216;r:_e_r&#8217;*mouth  too1~;&#8221;h_er&#8217;ir2&#8217;a Tata Sumo vehicle<\/p>\n<p>looks&#8221; it is~.n&#8217;ot disputved and cannot be disputed<br \/>\nat theytiinelof  .was in the company of PW4 &amp;<br \/>\nPW6 andother&#8217;collegeugirls. In the circumstances, accused<\/p>\n<p>15_4lp_d~:.1  not  overpowered PW2 to forcibly take her<\/p>\n<p>&#8216; ;.Va\u00bbvay&#8217;u_inaeaixwlthin public vision. The evidence of PW2 that<\/p>\n<p>&#8221; .accusfec1&#8217;V.&#8221;r\u00a7;of,&#8217;}iforcibly abducted her, even then no body came<\/p>\n<p>to her rescue also looks unnatural.\n<\/p>\n<p>*  At this juncture, it is necessary to recall the evidence<\/p>\n<p> of PW6, who has deposed; after one week, PW2&#8243; contacted<\/p>\n<p>PW6 over phone and PW2 informed PW6 that she had safely<br \/>\ni\\3c  &#8220;~13&#8243;? &#8221; &#8220;&#8221;&amp;&#8217;*&#8221;&#8216;<\/p>\n<p>,. 32 __<\/p>\n<p>returned back. If PW2 had been forcibly taken:.~b\u00a7.f&#8217;<\/p>\n<p>No.1 against her wish and accused No.1 had.Vforctb1:,f1nax&#8217;riee1 K V&#8217; <\/p>\n<p>her. PW2 would not have told <\/p>\n<p>returned home.\n<\/p>\n<p>16. PW2 has deposed; that eaccused\u00bb_No.d1  taken her to<\/p>\n<p>a house and urrongfutlyconftneci&#8217; h\u00e91~;Ltvac&#8217;cused No.1 took her<br \/>\nto a temple; accused  neck: after two<br \/>\ndays,  l\ufb02to 2:3  her near Hosakote.\n<\/p>\n<p>they were   wPW2 has deposed; that<br \/>\naccused  &#8216;edyeh-..o&#8217;V&#8217;er_&#8217;;;V)Vr&#8217;operty held and acquired by<br \/>\nPW1:  had requested her to marry<\/p>\n<p>hirn. &#8220;but P&#8217;.W2s  refused to marry accused No.1.<\/p>\n<p>  1  .cross&#8211;exarnination. PW2 has deposed; that she<\/p>\n<p>.&#8217; cannot \u00a7ij\u00a7reA&#8217;o1=the names of places to which she was taken;<\/p>\n<p>PW2. had stayed with accused Nos.1 to 3 for 5-6 days in a<\/p>\n<p>2 AA &#8216;house&#8221;: there was a priest in the temple: when bunch of<\/p>\n<p> \ufb02rotographs [seven in number coliectively marked as Ex.D.1)<\/p>\n<p>&#8216; were confronted to her: PW2 has admitted that those<\/p>\n<p>N on.\n<\/p>\n<p>_. 13 W<br \/>\nphotographs were taken during marriage of accused No.1<\/p>\n<p>and PW2. PW2 has also admitted photographs in<\/p>\n<p>numbers and collectively marked as    <\/p>\n<p>taken when PW2 and accused :No&#8217;.1.had iotttdifferentdji <\/p>\n<p>places. PW2 has also admitted<br \/>\nmarked as Ex.D.2 were takenijxiear 1i&#8221;arihar.dVd1\u00a71?i?2:&#8217;has&#8217;V;denieddd<br \/>\nsuggestion that she had fa11e;:3&#8230;:1:&#8217;Vi1A&#8221;1&#8243;p&#8217;.l.o&#8217;VepA.\\J\u00a3Iith&#8221;ac\ufb02usdd No.1 and<br \/>\nshe had consented for accused No.1 and<\/p>\n<p>accused No.1 _n&#8217;iarried&#8217;dVPW&#8217;i?{in&#8221;a:&#8217;tenip1e..i  has not denied<\/p>\n<p>the vt&#8217;conten5;,s  &#8216;*pho_t&#8217;ographs&#8221;&#8221;vzconfronted to her. Accused No.1 has<\/p>\n<p>it   Vdnot denied that PW2 and himself had left Malur and had<\/p>\n<p> Visited several places. Accused No.1 has not denied that he<\/p>\n<p>1 tied thaii to the neck of PW2 to marry her. The defence of<\/p>\n<p>f\\&#8217;:&#8217;  \\, &#8221;~~- !7&#8243;&#8221;&#8216;&#8221;&#8221;&#8221;&#8221;\u20ac5&#8243;&#8216;<\/p>\n<p>_ 14 _<br \/>\naccused No.1 that PW2 and accused No.1 had fallen ___in love<\/p>\n<p>with each other and decided to marry, accort1.ing1yVp:.&#8217;PW2<\/p>\n<p>accompanied accused No.1 to a temple and   4_<\/p>\n<p>a marriage. Thereafter, newly wedded 13aVd.4_&#8221;Vfisited&#8217;a. <\/p>\n<p>different places.\n<\/p>\n<p>18. Therefore, the crucia1,_:&#8221;p_oint.V&#8217;that.VV}w.Qu1d&#8221;L&#8221;arfse for<br \/>\ndetermination is: &#8212;\n<\/p>\n<p>&#8220;Whether &#8220;FW2 was a consenting party for<br \/>\nwhatever. that was done -by_ ac\u00a2;~..1s\u00e9d., &#8216;No. 1 ?&#8221;<\/p>\n<p>19.  As  -}?_W2_&#8217;has not bothered to state place<br \/>\nfrom tizhere   PW2 has deposed; that she<\/p>\n<p>waskept houseffor 5-6 days; accused No.1 had forcibly<\/p>\n<p>.   th&#8217;a1iVh&#8217;to her  accused No.1 had held out threats to<\/p>\n<p>&#8221; &#8220;.her&#8217;1if&#8217;eA._ &#8221; V<\/p>\n<p> &#8220;VAs.&#8217;xscou1d be seen from the evidence of PW2,<\/p>\n<p> photographs collectiveiy marked as Ex.D.1 to E.x.D.5,<\/p>\n<p> accused No.1 tied a thali to the neck of PW2 in a temple<\/p>\n<p>__ 15 _<br \/>\nwithin public vision. The marriage had taken place&#8221;-\u00abduring<\/p>\n<p>day time and a priest had perfonned marriage.     <\/p>\n<p>21. As could be seen from the contents;\n<\/p>\n<p>photographs, apart from marriagewparty&#8217;&#8211;\u00abconsistir;gxVoi&#8217; PW2 7<\/p>\n<p>and accused i to 3 there were other deirotees_&#8211;v_of&#8217;ternp14e;&#8211;~.:lf~it<\/p>\n<p>was a marriage forced upon  she. had<br \/>\nto reveal the same to .others&#8221;&#8216;tuAd:escdap.e from&#8221;the-djclutches of<br \/>\naccused No. 1. The photographs&#8217;  marriage would<\/p>\n<p>reveal that  .had\u00a7_&#8217;cVo&#8217;&#8211;:op:t21&#8217;at&#8217;et&#8217;1&#8217;~.fQr&#8217;ail the ceremonies that<\/p>\n<p>preceded   th ali -her neck.\n<\/p>\n<p>It&#8217;~i.s seerj.&#8217; marriage photographs. some of the<\/p>\n<p>d\u20ac}:V&#8217;oVtees had  blessed accused no.1 and PW2. It is seen<\/p>\n<p> , ..from&#8217;.&#8217;pho_to&#8217;graphs, after accused No.1 tied a thali to the neck<\/p>\n<p> ._   accused No.1 had exchanged garlands.<\/p>\n<p> v&#8211;..&#8217;:A.s&#8217;vc&#8217;ould be seen from the marriage photographs, PW2<\/p>\n<p> was in a traditional dress and costumes of a bride.<\/p>\n<p>&#8220;&#8221;._vd&#8217;i&#8217;l1erefore, evidence of PW2 that accused No.1 held out<\/p>\n<p>W   rt.\n<\/p>\n<\/p>\n<p>&#8212;- 16<br \/>\nthreats to her life and to forcibly marry her isP._high1y<\/p>\n<p>incredible and untrustworthy.\n<\/p>\n<p>22. It is seen from the evidence of PW2, <\/p>\n<p>accused No.1 &amp; PW2 had visited ldifferenlt  l?W2  l 7<\/p>\n<p>admitted that photographs collectiye.ly marlted. as <\/p>\n<p>were taken at Harihar, whicl1..l;iS&#8211;.almost. at&#8217;.a_&#8221;distancelllof 300<\/p>\n<p>kilometers from place of &amp;ll&#8217;I&gt;&#8221;&#8216;N2&#8243;.V: PW2 has<\/p>\n<p>admitted that accusedll\\llo&#8217;.&#8217;l ll1ald.lta}::erl1v&#8221;l\u00bb&#8217;1.ei- in a bus.<\/p>\n<p>23.  &#8220;As &#8216;could  lseei1,:f1&#8217;omlphotographs collectively marked<br \/>\nas  _.and PW2 are found moving in<br \/>\npublic places like gardens, bus stands and all along PW2<\/p>\n<p> to be l&#8221;1&#8217;n-..a.n\u00ab&#8217;ecstatic mood. From the appearance of<\/p>\n<p>&#8216; alaccuvsved  PW2 in photographs collectively marked as<\/p>\n<p>&#8221;  both accused No.1 8: PW2 appear as newly<\/p>\n<p>wfedded husband and wife. I do not see PW2 in a frightened<\/p>\n<p>  it &#8216;moodlllin any of the photographs. PW2 has not offered any<\/p>\n<p> &#8216;explanation as to how she had moved with accused No.1 to<\/p>\n<p>l different places, without there being any slightest protest or<\/p>\n<p>R}: aglg\\.., \u00a3&#8217;::.\u00a7.&#8221;L\/\u00bb.____C:\u00a3\ufb02*<\/p>\n<p>_ 17 IV&#8217;!<br \/>\ndemur on her part. PW2 has not given explanation for<br \/>\nmoving with accused No.1 in a romantic mood. PW2_)__was in<\/p>\n<p>the company of accused No.1 for a period of seve.n*d:ays&#8221;&#8211;and<\/p>\n<p>they had visited different places, including <\/p>\n<p>every opportunity to seek help f_rom__pnI;:lic&#8221;tog&#8217;_&#8217;escapepfront_ <\/p>\n<p>the clutches of accused No.1. On th.eie&#8217;ither_hand.VV<\/p>\n<p>contents of photographs c&#8217;o_ll&#8217;ectivc&#8217;lyv.   <\/p>\n<p>Ex.D.5 and conduct of PW2_,___l:1&#8243;-.f:ind_pthat   jubilant<br \/>\nand ecstatic. PW2   nor Inorosive. It is<\/p>\n<p>obVio&#8217;us&#8221;&#8216;that, P\\il\/lf};&#8217;lhas.gd&#8217;epos.ed:&#8217;accused No.1 had held out<br \/>\nthreats to  married her and took her to<br \/>\ndifferentlplaces  cover up lapses on her part. The<\/p>\n<p> trial t}udvge._i\u00ab11 spite of noticing the fact that PW2 has<\/p>\n<p>&#8216; ;,V&#8217;ad.InitVted_&#8217;the contents of photographs collectively marked as<\/p>\n<p>   has not considered the same for non-\n<\/p>\n<p>produetion of negatives of photographs. It is not a situation<\/p>\n<p>in &#8216;where the prosecution had taken any objection for<\/p>\n<p> confrontation of positive photographs to PW2, without the<\/p>\n<p>1 production of negative photographs. The prosecution has no<\/p>\n<p>,x?~_  i::\\.vL.&#8211; {E-&#8216;V&#8217;\\w&#8212;-C{g\u00a2.. ~<\/p>\n<p>_ 13 __<br \/>\ncase that photographs marked as EXD1 to D5 collectively<\/p>\n<p>are superimposed photographs.\n<\/p>\n<p>24. The learned counsel for appellant\/acc&#8217;a_:sedp&#8217;eNo.1*<\/p>\n<p>produced negatives of photographs rtiarkted _:asAip&#8217;1v1\u00a7_;.VE:)1&#8211;:VtoVd&#8217;D5 b T <\/p>\n<p>along with an application under   it\n<\/p>\n<p>25. On comparison of negatixre photogra_phs&#8217;1.:aiong<br \/>\npositive photographs~.__co11ective1y Vd&#8217;i&#8217;narked&#8217;V&#8221;as&#8221;VV&#8217; I3x.D.1 to<\/p>\n<p>Ex.D.5, Ifind the phodtograpiis&#8217;Lmarked as Ex.D1<\/p>\n<p>to d&#8221;a1&#8243;e.:i&#8217;.he  of utVh&#8217;eV\ufb02negatives produced before<br \/>\nCourt, it\n<\/p>\n<p>26.  accu_.se&#8217;-qlv :I&#8221;~Io.~.&#8217;1 was examined under section 313<\/p>\n<p> he  made a categorical statement that PW2 had<\/p>\n<p>&#8216; _V&#8217;fa11cn_ in&#8217;1.oift3___vvith accused No.1 and accused No.1 married<\/p>\n<p>H *:t3\\_t\/tf&#8221;2x&#8217;o1i.&#8221;.&#8217;if1erf:=.ifolition, without any force or threat to her life.<\/p>\n<p> 1 did not compel PW2 to marry him.\n<\/p>\n<p>it &#8221;  &#8220;&#8216;PW1&#8211;Rajaiah.C &#8212; the father of &#8216;PW2 lodged first<\/p>\n<p>hginwformation at 5 p.m., on 11.05.2000. 1;; the first<\/p>\n<p>Irv;  &#8216;&#8211;\n<\/p>\n<p>W 20<\/p>\n<p>conduct and acts of PW2 were in agreement &#8220;thfe&#8230;Vacts<\/p>\n<p>committed by accused No.1. The evidencewiof <\/p>\n<p>accused No.1 had all along helrl~&#8221;&#8216;out.threatsfto_her.&#8217;_:i.if\u00e9$.,.AisVif 1&#8242;<\/p>\n<p>falsified by her conduct and also  lithe&#8217; <\/p>\n<p>collectively marked as  5.. It at)&#8217;pears&#8221;afier PW2 1&#8242;<\/p>\n<p>was brought back bythe poli&#8211;ce..&#8221;PW&#8217;-.1&#8217;periormedyrnarriage of<br \/>\nPW2 with some other   PW2 in order to<br \/>\nkeep her marfita_i. status&#8217;  in tact has thrown<\/p>\n<p>blame on  falselyliddehosing that all along<\/p>\n<p>accused&#8217; N 0:1  threatened&#8221;_her life.\n<\/p>\n<p>29.  Qrderlltofyyoffence punishable under section<br \/>\n366 IPC.dp.rosecutioi1 to establish that accused No.1 had<\/p>\n<p> PW2&#8242; w:i.th&#8217; intent to compel her to marry him<\/p>\n<p>&#8216; ;.V&#8217;against&lt;  &#8211;._will. In order to constitute an offence of<\/p>\n<p>&#039;&#039; .&#039;habductiorr\ufb01fnrosecution has to prove that accused no.1 by<\/p>\n<p>forcehad &#039;compelled PW2 to go with him.<\/p>\n<p>From the evidence on record, I do not \ufb01nd that<\/p>\n<p> accused No.1 had used force against PW2 to go with him. I<\/p>\n<p> \ufb02 =&quot;&#039;g;_ p1,~w..c?.\u00a3,.\\.\n<\/p>\n<\/p>\n<p>&#8212; 23.\n<\/p>\n<p>do not find that accused No.1 had compelled PW2 to marry<\/p>\n<p>him. I do not \ufb01nd that accused No.1 had compelled to<br \/>\naccompany him. PW2 was in the company of <\/p>\n<p>for seven days.\n<\/p>\n<p>30. The iearned trial<br \/>\nevidence in proper perspec-ii_v&#8217;e..__.WithouVt<br \/>\nof parties and referring to   vyhich Wouid<br \/>\nconstitute an offence&#8211;&#8230;_of ghelddaccused No.1<br \/>\nguilty of an offence   366 IPC. The<\/p>\n<p>findiif1gs__ oft-&#8230;t_ii&#8211;al&#8217; Judge is based on improper<br \/>\nappreciation of Ve&#8217;ttide4nce&#8217;4&#8217;and some of the \ufb01ndings on no<\/p>\n<p>evidence. lv\ufb01aough l&#8217;Wt\u00a3 has not deposed that she was<\/p>\n<p>  and photographs collectively marked as Ex.D.1 to<\/p>\n<p>    by putting her to fear of iife, the learned<\/p>\n<p>trial  has heid that photographs were taken after<\/p>\n<p> pp threatening PW2 with dire consequences to her life. The<\/p>\n<p>V&#8217; * iea-rned trial Judge has failed to notice that there was total<\/p>\n<p> inconsistency between the evidence of PW2 and her conduct<\/p>\n<p>at the time of incident and after the incident. In the<\/p>\n<p> ;  C,&#8217;\/&#8217;L vu\ufb01ax ,<\/p>\n<p> &#8211; . A jiuagrn\u00a2nt.~ito%<\/p>\n<p>__ 22 _<br \/>\ncircumstances, the evidence on record is hardiy sufficient to<\/p>\n<p>hold that accused No.1 had abducted PW2 and:v:c&#8217;or:I1;oe{ied<\/p>\n<p>her to marry him. Therefore, the impugned  a<\/p>\n<p>be sustained.   ~\n<\/p>\n<p>31. In the resuit, I pass the :i7o11o&#8217;\\_\u00a7vii&#8217;ig:d~:d&#8217;.&#8217;  <\/p>\n<p>The appeal is a_c:cepted_.__&#8217;_d:&#8217;i*:;;:c;_  is set<br \/>\naside. Accused No.1 a\ufb01fztffence punishable<\/p>\n<p>under section .366   by accused<\/p>\n<p>No.I_\ufb02standi&#8221;carieeiled if accused No.1 had deposited<br \/>\n\ufb01ne arnount.&#8217; the&#8221;4v\u00a7a;\u00a7ie..:gha11 be refunded to him.
