No. 314 of 2009\n               - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 14th day of January, 2010\n\n                              JUDGMENT\n<\/pre>\n<p>Basheer, J.\n<\/p>\n<p>       Appellants are the petitioners in an Original Petition<\/p>\n<p>filed under Section 25 of the Travancore Cochin Literary<\/p>\n<p>Scientific and Charitable Societies Registration Act, 1955<\/p>\n<p>on the file of the District Court, Kollam. The prayer in the<\/p>\n<p>Original Petition     is to remove the existing Governing<\/p>\n<p>Body of Respondent No.1 Society and to appoint a fresh<\/p>\n<p>Governing Body and also to frame a scheme for the better<\/p>\n<p>and efficient management of the first respondent Society<\/p>\n<p>and other incidental reliefs.\n<\/p>\n<p>      2.   During the pendency of the                 above Original<\/p>\n<p>Petition, the appellants moved an application under Order<\/p>\n<p>F.A.O. No. 314 of 2009<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>XL Rule 1 of the Code of             Civil Procedure praying for<\/p>\n<p>appointment of a Receiver for the management of the affairs of<\/p>\n<p>the Society by removing respondent Nos. 2 to 4 from the<\/p>\n<p>management.\n<\/p>\n<p>      3.    The court below, after considering the rival<\/p>\n<p>contentions, held that this is not a fit case, where a Receiver is to<\/p>\n<p>be appointed as suggested by the appellants. The said order is<\/p>\n<p>impugned in this appeal.\n<\/p>\n<p>      4. We have heard learned counsel for the parties and<\/p>\n<p>perused the materials available on record.<\/p>\n<p>      5.   Having perused the impugned order, we are not<\/p>\n<p>satisfied that any interference is warranted with the order under<\/p>\n<p>challenge. We have been informed that pleadings are complete<\/p>\n<p>in the Original Petition. In the peculiar facts and circumstances<\/p>\n<p>of this case, we are of the view that the court below has to be<\/p>\n<p>directed to expedite the trial and dispose of the Original Petition.<\/p>\n<p>We do so.\n<\/p>\n<p>F.A.O. No. 314 of 2009<\/p>\n<p><span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>     6. The appeal is, therefore, disposed of with a direction to<\/p>\n<p>the   court below to dispose of the Original Petition as<\/p>\n<p>expeditiously as possible, at any rate, before closure of the<\/p>\n<p>courts for summer recess.\n<\/p>\n<\/p>\n<p>                                     (A.K.
