Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/08\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n             CRL.R.P.NO.1578 OF 2003\n           ---------------------------------------------\n            Dated 17th            August, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>          Third accused in C.C.288\/1993 on<\/p>\n<p>the   file      of         Judicial                First     Class<\/p>\n<p>Magistrate,     Ranni           filed           this      revision<\/p>\n<p>challenging his conviction for the ofence<\/p>\n<p>under Sections 341 and 324                              read with<\/p>\n<p>Section   34        of         Indian              Penal     Code.<\/p>\n<p>Prosecution case was that on 23\/3\/1993 at<\/p>\n<p>about 5.30 p.m              PW1, the injured while<\/p>\n<p>walking along the way near to the house of<\/p>\n<p>the first accused, asking whether he caused<\/p>\n<p>damage to her rubber tree, she                              pelted<\/p>\n<p>stones at PW1. It hit on his                       left shoulder<\/p>\n<p>causing  hurt.        When          first          accused    took<\/p>\n<p>another stone, PW1 tried to run away. The<\/p>\n<p>petitioner then caught hold of PW1 and<\/p>\n<p>CRRP 1578\/03<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>wrongfully restrained him. Second accused, son<\/p>\n<p>of the first accused, then a student, took<\/p>\n<p>rubber tapping knife and inflicted hurt on the<\/p>\n<p>stomach of PW1 with the knife and all the<\/p>\n<p>accused thereby committed the offences under<\/p>\n<p>Sections 341 and 324     read with Section 34 of<\/p>\n<p>Indian Penal Code. All the accused pleaded not<\/p>\n<p>guilty. Prosecution examined six witnesses and<\/p>\n<p>marked     seven exhibits. On  the side  of  the<\/p>\n<p>accused, DW1 was examined.   Learned  Magistrate<\/p>\n<p>on the evidence found all the accused guilty.<\/p>\n<p>They were convicted for the offences. As second<\/p>\n<p>accused was aged only 19 years        and was a<\/p>\n<p>student, learned Magistrate released him under<\/p>\n<p>Section 4 of Probation of Offenders Act and<\/p>\n<p>sentenced the petitioner and first accused to<\/p>\n<p>rigorous imprisonment for six months each for<\/p>\n<p>the offence under Section 324 of Indian Penal<\/p>\n<p>CRRP 1578\/03<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>Code       and to rigorous imprisonment for one<\/p>\n<p>month each for the offence under Section 341<\/p>\n<p>read with Section 34 of Indian Penal Code.<\/p>\n<p>Petitioners     challenged   the   conviction  and<\/p>\n<p>sentence before Sessions Court, Pathanamthitta<\/p>\n<p>in   Crl.A.1\/1996.    Learned  Additional  Sessions<\/p>\n<p>Judge on re-appreciation of the evidence, set<\/p>\n<p>aside the conviction of the first accused and<\/p>\n<p>acquitted her. Conviction and sentence of the<\/p>\n<p>first     petitioner  was  confirmed.  Revision  is<\/p>\n<p>filed challenging the conviction.<\/p>\n<p>           2.   Learned  counsel appearing for the<\/p>\n<p>petitioner and learned Public Prosecutor       were<\/p>\n<p>heard.\n<\/p>\n<p>           3.   Learned  counsel appearing for the<\/p>\n<p>petitioner submitted that first accused stands<\/p>\n<p>acquitted and second accused who inflicted the<\/p>\n<p>injury on PW1 was released on probation and<\/p>\n<p>CRRP 1578\/03<br \/>\n<span class=\"hidden_text\">                         4<\/span><\/p>\n<p>petitioner    who  according  to the  prosecution<\/p>\n<p>only wrongfully restrained PW1 alone       stands<\/p>\n<p>sentenced and     learned Magistrate and learned<\/p>\n<p>Sessions Judge     did not consider the question<\/p>\n<p>whether on the facts and circumstances of the<\/p>\n<p>case, petitioner could be released on probation<\/p>\n<p>or not. It is submitted that considering the<\/p>\n<p>fact     that  the  incident  was  in  1993  and<\/p>\n<p>petitioner    was  not   involved in  any   other<\/p>\n<p>offence before or after the incident, he may be<\/p>\n<p>released on probation.\n<\/p>\n<p>           4. Learned      Public     Prosecutor<\/p>\n<p>submitted that question of granting probation<\/p>\n<p>to the petitioner be decided     after calling a<\/p>\n<p>report from the District Probation Officer.<\/p>\n<p>           5. Though first accused was convicted<\/p>\n<p>and sentenced for the offences under Sections<\/p>\n<p>323 and 324 read with Section 34 of Indian<\/p>\n<p>CRRP 1578\/03<br \/>\n<span class=\"hidden_text\">                          5<\/span><\/p>\n<p>Penal     Code,  learned  Sessions  Judge  on  re-<\/p>\n<p>appreciation of the evidence acquitted        her.<\/p>\n<p>Case     against   the  petitioner   is  that   he<\/p>\n<p>wrongfully restrained PW1 and second accused<\/p>\n<p>who now stands released on probation inflicted<\/p>\n<p>the injury on the stomach of PW1 with a rubber<\/p>\n<p>tapping knife. Neither     learned Magistrate nor<\/p>\n<p>learned Sessions Judge considered the question<\/p>\n<p>whether the petitioner could be released on<\/p>\n<p>probation      granting  the    benefit   of   the<\/p>\n<p>benevolent provisions of Probation of Offenders<\/p>\n<p>Act, even though considering his age, second<\/p>\n<p>accused was released on probation. As stated<\/p>\n<p>earlier,     even  according  to  the  prosecution<\/p>\n<p>petitioner       only  wrongfully  restrained  PW1<\/p>\n<p>which enabled the second accused to inflict<\/p>\n<p>injury on his stomach. There is no case for the<\/p>\n<p>prosecution that petitioner was involved in any<\/p>\n<p>CRRP 1578\/03<br \/>\n<span class=\"hidden_text\">                          6<\/span><\/p>\n<p>other offence. In such circumstances, in the<\/p>\n<p>interest of justice,     learned Magistrate should<\/p>\n<p>have       considered   the    question    whether<\/p>\n<p>petitioner      could  be   released    on   bail,<\/p>\n<p>especially, when conviction is only for the<\/p>\n<p>offences under Sections 324 and 341 with the<\/p>\n<p>aid of Section 34 of Indian Penal Code. Hence<\/p>\n<p>it is necessary to remand the case to the<\/p>\n<p>learned Magistrate    to consider the question.<\/p>\n<p>           Revision is allowed in part. Sentence<\/p>\n<p>awarded     for the offence under Sections 324 and<\/p>\n<p>341    read with Section 34 of Indian Penal Code<\/p>\n<p>is set aside.     Judicial First Class Magistrate,<\/p>\n<p>Ranni is directed to call for     a report on the<\/p>\n<p>petitioner from the District Probation Officer.<\/p>\n<p>On    getting    the  report,   Magistrate   shall<\/p>\n<p>consider       the question whether he could be<\/p>\n<p>released either under Section 3 or 4 of the<\/p>\n<p>CRRP 1578\/03<br \/>\n<span class=\"hidden_text\">                          7<\/span><\/p>\n<p>Probation    of   Offenders Act.
