He has submitted that in para-15 of<br \/>\n\tthe judgment the Court has observed that  Mr.Parthiv B. Shah,<br \/>\n\tlearned advocate appearing for the respondent   original<br \/>\n\tdefendant&#8230;.. . He has submitted that instead of &#8216;original<br \/>\n\tdefendant&#8217; the word &#8216;original plaintiff&#8217; is required to be<br \/>\n\tsubstituted in place of &#8216;original defendant&#8217;.\n<\/p>\n<p>\tThe Registry is directed<br \/>\n\tto carry out this amendment\/modification in para-15 of the order<br \/>\n\tdated 11.8.2010.\n<\/p>\n<p>\tMr.Patel further<br \/>\n\tsubmitted that the Court while deciding the Second Appeal has<br \/>\n\tobserved that,  subject to the above, this Second Appeal is<br \/>\n\tdisposed off . He has submitted that this would create some<br \/>\n\tcomplication in future and hence operative portion of the order<br \/>\n\tshould be as under :-\n<\/p>\n<p> The<br \/>\n\t\tappeal is allowed and the judgment and decree of the Appellate<br \/>\n\t\tCourt passed in Civil Appeal No.189 of 1973 dated 6.10.1986 by<br \/>\n\t\tlearned 4th Extra Assistant Judge, Vadodara is set aside<br \/>\n\t\tand judgment and decree dated 26.6.1972 passed in Regular Civil<br \/>\n\t\tSuit No.564 of 1969 by 4th Joint Civil (JD), Vadodara is<br \/>\n\t\thereby confirmed.\n<\/p>\n<p>\tHaving considered the<br \/>\n\tsubmissions made by Mr.Patel, the learned advocate for the<br \/>\n\tappellants, the Court is of the view that in place of  disposed<br \/>\n\toff  if the words are put as  allowed  in terms of para-4(A)<br \/>\n\tof the memo of Second Appeal,  the same would serve the purpose.<br \/>\n\tAccordingly, Registry is directed to put the words  allowed  in<br \/>\n\tterms of para-4(A) of the memo of Second Appeal  in place of<br \/>\n\t disposed off .\n<\/p>\n<p>\tThis note for speaking to<br \/>\n\tminutes is accordingly disposed off.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(K.\n<\/p>\n<p>A.
