The detenue is  branded as  &#8220;bootlegger&#8221;.\n<\/p>\n<p>2.\tHeard<br \/>\nthe learned Advocate for the petitioner and learned AGP for the<br \/>\nrespondents. No Affidavit in reply is filed by the respondents<br \/>\ncontroverting the averments made by the petitioner.\n<\/p>\n<p>3.\tThe<br \/>\npetitioner came to be detained as &#8220;bootlegger&#8221; on his<br \/>\ninvolvement in two offence being  (i) Prohibition CR No.5114 of 2009,\n<\/p>\n<p>(ii) Prohibition CR No. 5221 of 2010, (iii) Prohibition CR No. 5083<br \/>\nof 2011, and (iv) Prohibition CR No. 5098 of 2011, all registered<br \/>\nwith Naroda Police Station, Ahmedabad.\n<\/p>\n<p>4.\tIt<br \/>\nhas been submitted by the learned Counsel for the petitioner that it<br \/>\nis a settled legal position that on registration of offence, no order<br \/>\nof detention could have been passed as petitioner &#8211; detenu<br \/>\ncannot be branded as &#8220;bootlegger&#8221;. It has been further<br \/>\nsubmitted that the activities of the petitioner cannot be said to be<br \/>\ninjurious to the public health or public order. It has been further<br \/>\nsubmitted by the learned Counsel for the petitioner that there is<br \/>\ngross delay in passing the order of detention as well as there is<br \/>\ngross delay in executing the order of detention.\n<\/p>\n<p>5.\tI<br \/>\nhave gone through the grounds of detention and considered the<br \/>\narguments advanced by the learned Counsel for the petitioner as well<br \/>\nas the learned A.G.P.\n<\/p>\n<p>6.\tThe<br \/>\nCourt is of the opinion that there is much substance in the arguments<br \/>\nadvanced by learned Counsel for the petitioner. It is seen from the<br \/>\ngrounds that a general statement has been made by the detaining<br \/>\nauthority that consuming liquor is injurious to health. In fact, a<br \/>\nperusal of the order passed by the detaining authority shows that the<br \/>\ngrounds which are mentioned in the order are in reference to the<br \/>\nsituation of &#8220;law and order&#8221; and not &#8220;public<br \/>\norder&#8221;. Therefore, on this ground, the subjective satisfaction<br \/>\nof the detaining authority is vitiated on account of non-application<br \/>\nof mind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>7.\tExcept<br \/>\nthe general statement, there is no material on record which shows<br \/>\nthat the petitioner &#8211; detenue is carrying out illegal<br \/>\nactivities of selling liquor which is harmful to the health of the<br \/>\npublic. In support of the above submission, learned Advocate for the<br \/>\ndetenue has placed reliance on the decision of the Hon&#8217;ble Apex Court<br \/>\nin the case of PIYUSH KANTILAL MEHTA v\/s COMMISISONER OF POLICE,<br \/>\nreported in AIR 1989 SC 491 and the recent Judgment dated<br \/>\n28.3.2011 passed by the Division Bench of this Court (Coram : S.J.<br \/>\nMukhopadhyay, CJ (as His Lordship then was) &amp; J.B. Pardiwala, J.)<br \/>\nin Letters Patent Appeal No. 2732 of 2010 in Special Civil<br \/>\nApplication No.9492 of 2010 (Artiben v\/s Commissioner of<br \/>\nPolice) which would squarely help the detenue.\n<\/p>\n<p>8.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention, the detaining authority must come to a definite<br \/>\nfindings that there is threat to the &#8216;public order&#8217; and it is very<br \/>\nclear that the present case would not fall within the category of<br \/>\nthreat to a public order. In that view of the matter, when the order<br \/>\nof detention has been passed by the detaining authority without<br \/>\nhaving adequate grounds for passing the said order, cannot be<br \/>\nsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>9.\tIn<br \/>\nthe result, this petition is allowed. The impugned order of detention<br \/>\ndated 30th June, 2011 passed by the Police Commissioner,<br \/>\nAhmedabad City, is hereby quashed and set aside. The detenu is<br \/>\nordered to be set at liberty forthwith, if not required in any other<br \/>\ncase. Rule is made absolute accordingly.
