This petition seeks quashing of order of assessment dated<br \/>\n17.01.1989, Annexure P-9, as affirmed in appeal by order dated 30.07.1993,<br \/>\nAnnexure P-13.\n<\/p>\n<p>2.          Case of the petitioner is that it was    a licencee under the<br \/>\nprovisions of Punjab Agricultural Produce Markets Act, 1961 (for short,<br \/>\n&#8220;the Act&#8221;). Its business premises are situated outside the principal market<br \/>\nyard and sub market yard. It was denying liability to pay market fee on the<br \/>\n<span class=\"hidden_text\">                          C. W. P. No. 11930 of 1993                        2<\/span><\/p>\n<p>ground that no sale or purchase was conducted in the principal market yard<br \/>\nor sub market yard and filed C. W. P. No. 2750 of 1989 in this Court. The<br \/>\nissue was decided by Full Bench of this Court in <a href=\"\/doc\/1309838\/\">M\/s Subhash Chander<br \/>\nKamlesh Kumar vs. State of Punjab and others<\/a>, AIR 1990 Punjab and<br \/>\nHaryana 259, rejecting the plea of the assessee. The writ petition of the<br \/>\npetitioner was disposed of in terms of the judgment passed in the case of<br \/>\nM\/s Subhash Chander (supra).\n<\/p>\n<p>3.          The petitioner received notice dated 14.05.1986, Annexure P-1<br \/>\nfor producing its accounts.     After examining the accounts, a sum of<br \/>\nRs.34,022.22 was assessed as market fee payable by the petitioner, in<br \/>\naddition to composition fee of Rs.3,400\/-. The said amounts were paid by<br \/>\nthe petitioner on 08.07.1986 vide Annexure P-2 and P-3. Thereafter, the<br \/>\nfirm was dissolved. However, subsequently, impugned assessment orders<br \/>\nwere passed for the assessment year 1983-84, 1984-85 and 1985-86. The<br \/>\npetitioner challenges the same on the ground that the matter stood finalized<br \/>\nand as amount of market fee due, as assessed, had already been paid, no<br \/>\nfresh assessment orders could be passed.         The Appellate Authority,<br \/>\nhowever, did not accept this plea.\n<\/p>\n<p>4.          Learned counsel for the petitioner submits that the assessment<br \/>\norder was not justified, having regard to the fact that the petitioner had<br \/>\nalready paid the amount assessed and the composition fee, after which<br \/>\nnothing survived.\n<\/p>\n<p>5.          Learned counsel for the Market Committee and the Market<br \/>\nBoard support the impugned order.\n<\/p>\n<p>6.          We have perused the order of assessment and order of the<br \/>\nAppellate Authority. The Appellate Authority observed as under :-\n<\/p>\n<blockquote><p>                                     &#8220;I have considered the above points<br \/>\n                         and do not find force in any of the contentions<br \/>\n                         raised on behalf of the appellant. Under rule 31(4),<br \/>\n                         the Committee has the right to frame assessment<br \/>\n<span class=\"hidden_text\">                          C. W. P. No. 11930 of 1993                         3<\/span><\/p>\n<p>                        against any dealer and the mere fact that some<br \/>\n                        amount had earlier been deposited by the dealer in<br \/>\n                        pursuance of the Board&#8217;s directions would not<br \/>\n                        stand in the way of exercise of this right, especially<br \/>\n                        since it is not shown that the amount paid earlier<br \/>\n                        was in any way related to the present transactions.<br \/>\n                        Secondly, no irregularity or infirmity can be<br \/>\n                        detected in the order through which the best<br \/>\n                        judgment    assessment     was   framed     and   the<br \/>\n                        Committee has taken care to see that all<br \/>\n                        requirements of law have been met with. Finally,<br \/>\n                        it cannot be doubted that a Committee is competent<br \/>\n                        to levy penalty upon any defaulting licencee. In<br \/>\n                        this case, the default of the appellant has been of a<br \/>\n                        very stubborn and persistent nature and I am of the<br \/>\n                        view that the imposition of the maximum penalty<br \/>\n                        was warranted in the circumstances of the case.&#8221;\n<\/p><\/blockquote>\n<p>7.          We are unable to sustain the finding of the Appellate Authority.<br \/>\nAnnexure P-2 is a document showing payment of market fee in pursuance of<br \/>\nnotice Annexure P-1, which was for the period 1983-84, 1984-85 and 1985-<br \/>\n86 and Annexure P-3 is payment of composition fee.\n<\/p>\n<p>8.          The Market Committee, having made the assessment and<br \/>\naccepted the market fee along with composition fee, will not be justified in<br \/>\ninitiating the assessment process again, particularly when the firm was<br \/>\nclosed.\n<\/p>\n<p>9.          Though counsel for the petitioner has advanced certain<br \/>\nalternative submissions with regard to limitation for making assessment, in<br \/>\nview of the fact that the accounts were required to be maintained only for<br \/>\ntwo years and impugned process for assessment was started vide notice<br \/>\ndated 19.03.1988 Annexure P-5, after almost two years after the last<br \/>\n<span class=\"hidden_text\">                        C. W. P. No. 11930 of 1993                    4<\/span><\/p>\n<p>assessment. In view of our above decision, we need not go into the said<br \/>\nquestion.\n<\/p>\n<p>10.
