Justice V.GIRI\n\n Dated :28\/11\/2007\n\n O R D E R\n                             V.GIRI,J.\n                      -------------------------\n                 W.P ( C) No. 35109 of 2007\n                      --------------------------\n            Dated this the 28th November, 2007\n\n                        J U D G M E N T\n<\/pre>\n<p>          The petitioners are Foresters working in the Forest<\/p>\n<p>Department. According to them, on completion of 23 years of<\/p>\n<p>service, they are entitled to Time Bound Higher Grade. This<\/p>\n<p>was granted to them but later respondents proposed to cancel<\/p>\n<p>the grant on the premise that the petitioners have not completed<\/p>\n<p>necessary forester&#8217;s training. Petitioners&#8217; claim that since they<\/p>\n<p>have crossed the age of 50 they are entitled to be exempted from<\/p>\n<p>Foresters   Training.  Apparently,      the    2nd respondent has<\/p>\n<p>recommended that the grant of Higher Grade to the petitioners<\/p>\n<p>should be retained.\n<\/p>\n<p>     2.   This writ petition was filed when the petitioners<\/p>\n<p>apprehended that the Higher Grade already granted to them is<\/p>\n<p>sought to be recovered pursuant to Exhibit-P3.<\/p>\n<p>     After having heard the learned counsel for the petitioners<\/p>\n<p>and the learned Government Pleader, this writ petition is<\/p>\n<p>disposed of directing the 1st respondent to consider Exhibit-P5 to<\/p>\n<p>P 7 representations filed by the petitioners and take a decision<\/p>\n<p>W.P ( C) No. 35109 of 2007<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>thereon, after hearing the petitioners, within a period of three<\/p>\n<p>months from the date of receipt of a copy of this judgment.<\/p>\n<p>Recovery of amounts already granted to the petitioners shall be<\/p>\n<p>kept in abeyance, pending a decision by the Government, as<\/p>\n<p>aforementioned.\n<\/p>\n<\/p>\n<p>                                              (V.GIRI, JUDGE)<br \/>\nma<\/p>\n<p>W.P ( C) No. 35109 of 2007<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>                                 K.THANKAPPAN,J<\/p>\n<p>                                CRL.A.
