Respondents\n                                          -----------\n<\/pre>\n<p>              For the petitioners      : Mr. Raj Kumar, Advocate<br \/>\n              For the State            : Mr. Ajay, S.C. 24<br \/>\n              For the Respondent       : Mr. Naresh Kumar Sinha, Advocate<br \/>\n              Nos. 4 and 5\n<\/p>\n<p>                                  &#8212;-\n<\/p>\n<p>3   16.12.2010             Heard the parties.\n<\/p>\n<p>                           The petitioner has approached   this Court in<\/p>\n<p>                   public interest seeking a direction upon the District<\/p>\n<p>                   Magistrate, Katihar to remove fresh encroachment by<\/p>\n<p>                   vendors upon Dr. Rajendra Prasad Path in the town of<\/p>\n<p>                   Katihar and further to ensure that such encroachment<\/p>\n<p>                   does not recur.\n<\/p>\n<p>                           It appears that earlier directions were issued<\/p>\n<p>                   for the same purpose not only in writ jurisdiction but<\/p>\n<p>                   action was taken in contempt also. However, allegedly<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>the vendors have again encroached upon the limited<\/p>\n<p>space on the road called as Dr. Rajendra Prasad Path in<\/p>\n<p>Katihar.\n<\/p>\n<p>           It is recurring problem not only in Katihar but in<\/p>\n<p>all the major towns of Bihar including in capital town at<\/p>\n<p>Patna. The problem needs to be supervised by highest<\/p>\n<p>level so that the right of the public to travel and move<\/p>\n<p>safely on public roads is not totally subjugated to the<\/p>\n<p>rights of the vendors to sell their mercantile on the road.<\/p>\n<p>It is expected that such problems shall be solved by the<\/p>\n<p>Government at the highest level without any delay<\/p>\n<p>otherwise the people will continue to face difficulties<\/p>\n<p>even in walking on roads what to say about plying their<\/p>\n<p>vehicles.
