The petitioner has filed<br \/>\nthe present petition claiming certain monetary benefits challenging<br \/>\nthe order passed by the Labour Court in recovery proceedings.\n<\/p>\n<p>2.\tTowards<br \/>\nthe said claims as a full and final settlement the respondent has<br \/>\nagreed to pay a sum of Rs. 70,000\/- to the petitioner which the<br \/>\npetitioner agrees to accept as a full and final settlement of his<br \/>\nclaim arising under the petition.  Respondent agrees to pay a sum of<br \/>\nRs. 25,000\/- on or before 14\/11\/2005, a sum of Rs. 20,000\/- on<br \/>\n21\/11\/2005 and sum of Rs. 25,000\/- on or before 30th<br \/>\nDecember, 2005.  Upon this assurance to the Court, the petitioner<br \/>\nseeks permission to withdraw the petition.  Managing Director of the<br \/>\nrespondent company shall file an undertaking to this Court within a<br \/>\nperiod of one week that the above mentioned payments will be made<br \/>\nwithin the prescribed time.  Learned advocate Shri Clerk submitted<br \/>\nthat the claim of the petitioner for interest on the delayed deposit<br \/>\nof the provident fund amount is not being given up.  Learned advocate<br \/>\nMs. Sneha Jani for learned advocate Mr.Kogje submitted that this<br \/>\nclaim is not part of the present petition and the respondent reserves<br \/>\nliberty to raise all contentions in this regard. In view of the above<br \/>\ndevelopment, learned advocate for the petitioner seeks permission to<br \/>\nwithdraw the petition.  Permission granted.  Petition stands disposed<br \/>\nof as withdrawn.  Rule discharged.
