Justice V.RAMKUMAR\n\n Dated :04\/06\/2010\n\n O R D E R\n                     V.RAMKUMAR, J.\n               -------------------------------------\n               W.P.(C)No.10553 of 2010\n              --------------------------------------\n           Dated this the 4th day of June, 2010\n\n                            ORDER\n<\/pre>\n<p>     Petitioner who is the father of accused Nos.1 and 2<\/p>\n<p>in Crime No.19\/07 of Kadinamkulam Police Station<\/p>\n<p>registered for an offence punishable under Sections 324,<\/p>\n<p>354 &amp; 427 read with Section 34 I.P.C. inter alia seeks to<\/p>\n<p>entrust the investigation of the said case with a special<\/p>\n<p>investigation team comprising of Police Officers other<\/p>\n<p>than    respondents        4      to      6     (DYSP, DCRB,<\/p>\n<p>Thiruvananthapuram, C.I. of Police, Kazhakoottam and<\/p>\n<p>S.I. of Police, Kadinamkulam) and to monitor the<\/p>\n<p>investigation.\n<\/p>\n<p>     2.   The learned Public Prosecutor on instructions<\/p>\n<p>submitted that the case was originally investigated by the<\/p>\n<p>sixth respondent SI of Police, Kadinamkulam Police<\/p>\n<p>Station and as per the orders of Superintendent of Police<\/p>\n<p>(Rural),  Thiruvananthapuram the investigation was<\/p>\n<p>handed over to DYSP, DCRB, Thiruvananthapuram and<\/p>\n<p>after conclusion of investigation the said officer has<\/p>\n<p>W.P.(C).No.10553\/2010<br \/>\n<span class=\"hidden_text\">                            : 2 :<\/span><\/p>\n<p>already laid the charge before the Judicial Magistrate of<\/p>\n<p>the First Class, Attingal where the case has been<\/p>\n<p>registered as C.C.No.763\/2009.\n<\/p>\n<p>     3.     When the investigation was concluded one year<\/p>\n<p>ago and the offence has been taken cognizance of by the<\/p>\n<p>Magistrate, the remedy of the petitioner is either to seeks<\/p>\n<p>further investigation under Section 173(8) of Code of<\/p>\n<p>Criminal Procedure by filing appropriate petition before<\/p>\n<p>the Magistrate. He cannot straight away approach this<\/p>\n<p>Court and seek directions. Without prejudice to the right<\/p>\n<p>of the petitioner to move the Magistrate in terms of<\/p>\n<p>Sakiri Vasu Vs. State of UP 2008(1)KLT 724(SC)<\/p>\n<p>and Kunga Nima Lepcha &amp; others Vs.
