one Madarangi’ Gouge P\u00e9er\u00ab”Sab (since deceased) filed a suit in<\/p>\n

‘res’traiVn= diegfendants from interfering in any manner with<\/p>\n
his Ap.eacefui[poissession and enjoyment of the vacant site<\/p>\n
i1″\u00bb-=.__d-escribe’d___in the scheduie to the piaint, on the basis that the<\/p>\n
  .,ptoperty was acquired by one Madarangi Madar Sab who<\/p>\n

is his senior paternai uncie. Thereafter, the properties
\nacquired by the famiiy were subjected to partition and;b–y orai<\/p>\n
partition amongst them, the piaintiff has assigned\u00e9hyd-44i:gViy’en<\/p>\n
the schedule property towards his share. He if-J__asvj&nVd’–‘is’<\/p>\n
physical possession and enjoymentzofi theyschedtiie_p:ro*p’er’t’y<\/p>\n
pursuant to the partition ofythe  prop_erties.x<\/p>\n
defendants who have no mannerfof ripht_,_’ti~ti_\u00e9.= andiiiiiniterestwi<\/p>\n

5. The respioin.’dven_Ht~de<fer.dant_' resisted the suit, inter aiia<\/p>\n
contendingj~.._thiat'  Madarangi Madar Sab had<\/p>\n
purcha;sedo_thex p-roV_pe'1rty'in duestion in 1929 from the originai<\/p>\n
   of awdeed of sale. He has been in physical<\/p>\n
  property. The iocai panchayath has re–\n<\/p>\n
 assigned ,.;iuini3ers as K.No.336 & K.No.337. The property in<\/p>\n
if”‘::v”i4y”‘-.i;iothVoy_the”i-numbers is thereafter re–numbered as K.i\\io.338.<\/p>\n
 .They\u00bb~have put a residentiai house on the property ieaving a<\/p>\n

claim of the plaintiff, they sought for dismissal of the st;-‘i’t.._<\/p>\n
6. During the pendency of the suit, the <\/p>\n
application seeking permission to amend  if<\/p>\n
decree of mandatory injunction   ‘gro-iu  <\/p>\n
defendants had after filing the _suitfe.nc’roache,d’.i,a”port’i–on\u00bbof.,<\/p>\n
the property. Thus, the suit wastnot onlyfoivihjun\u00e9cltion, but<\/p>\n
also for removal of encro’a’c.hme’nt’. ”\n<\/p>\n
7. However, in support. Aoffthe __p”la.Ai_n.t” ‘averments, the<\/p>\n
plaintiff produced’\u00ab.e)\u00a7tratEA_ts ,of:3re’le\u00abvajn.t,register in respect of<\/p>\n
the sched’u’le-_p’r:opetty t’o._’show””‘thaVt his name was entered
\nthereuncier and l<hathaV'wa's\u00ab,aiso in his name. Per contra, the<\/p>\n
defendants referregd 'vtoA'~t_he~.-'absolute deed of sale in favour of<\/p>\n
"VMada'rang.i:MadarhSavb—-of' the year 1929 to claim succession to<\/p>\n
.V'–theiVp'roperty ,a'ft:'er.his demise.<\/p>\n
8. .'[“i’he _\u00e9Ti’iaii.c::Court noticed that except for the revenue<\/p>\n
V%”–\u00ab___”e,ntries,~~the plaintiff had not produced any other document<\/p>\n
   :o’n*\u00ab_.that ground, the suit was dismissed. In appeal against<\/p>\n
RSA 606\/2009<\/p>\n
the said judgment, the Appellate Court accepting the<\/p>\n
reasoning of the Trial Court, has dismissed the appeal also.<\/p>\n

contend thiatalthe p’rope’rt-y””‘i-at’guestion was purchased by the<\/p>\n
 fatheif._{of’ the respondent-defendant and after his demise, he<\/p>\n

  are, the plaintiff admits that Madarangi<\/p>\n
 _Mada”r”\u00ab.Sab’  acquired the property by virtue of a valid sale<\/p>\n
 Thesdefendant had nothing eise to prove on the basis<\/p>\n

There  th’e’iip’I’aint itseif that Madarangi
\nMadar Sap had’purchased’itheproperty and he is his paternal<\/p>\n
uncle. Part’i\u00abes”are._ i’\u00ab4_oharnmedans and are undoubtedly<\/p>\n
“”~governied,y_._l):y Mohainwm-ed’an Law. On the contention that there<\/p>\n
.V’w’as\u00e9a’r=_ oral \/,,’I33}’tition in the family, the plaintiff claims titie.<\/p>\n
When””Mad_ar’a’no:i VMadar Sab had purchased the property and<\/p>\n
 he ..is’;_said to be the paternal uncle, the property<\/p>\n
  ufnd,oiub.tedly would pass on upon his death to his heirs and<\/p>\n
