(1) 532\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>ORDER\n<\/p>\n<p>1.In  this case there were six accused before  the  trial<br \/>\ncourt arraigned for the offences under Section 302 read with<br \/>\nSection\t 149 and under Sections 324, 325 and 120-B  of\tIPC.<br \/>\nThe  trial  court  acquitted  all the  accused\tof  all\t the<br \/>\noffences.   The\t trial court held that the  prosecution\t had<br \/>\nfailed\tto  prove  the\tcharges\t beyond\t reasonable   doubt.<br \/>\nAgainst\t the acquittal, the State preferred an appeal.\t The<br \/>\nHigh Court came to the conclusion that the finding  recorded<br \/>\nby  the\t trial\tcourt was unreasonable\tand  held  that\t the<br \/>\noffence under Section 304 Part II read with Section 149\t for<br \/>\nthe  death  of victim-Kishore Chand and\t the  offence  under<br \/>\nSections  324  and  325 read with Section  149\tfor  causing<br \/>\ninjuries  to  witness  Virender Kumar  (PW  7)\twere  proved<br \/>\nagainst the appellants.\t The High Court, however, held\tthat<br \/>\nthe  offence of conspiracy was not proved.  Having  come  to<br \/>\nthe  said conclusion, the High Court  accordingly  convicted<br \/>\nand   sentenced\t  the\tappellants   to\t  undergo   rigorous<br \/>\nimprisonment  for 7 years and to pay a fine of Rs  500\teach<br \/>\nfor the conviction under Section 304 Part 11 and to  undergo<br \/>\none year&#8217;s rigorous imprisonment each for the offences under<br \/>\nSections  324  and 325 read with Section 149  of  IPC.\t The<br \/>\nsentences  were directed to run concurrently.\tAs  regards,<br \/>\nthe  original accused 5, he was 19 years of age at the\ttime<br \/>\nof  the incident.  He was also the first offender and  hence<br \/>\nhe  was\t given\tthe  benefit  of  the  probation  under\t the<br \/>\nProbation of Offenders Act, 1958.\n<\/p>\n<p>2.Mr Kohli, learned counsel appearing for the appellants,<br \/>\nchallenges the finding of conviction on the ground that\t the<br \/>\nprosecution had failed to establish the offence against\t the<br \/>\naccused\t beyond\t reasonable doubt and,\tin  particular,\t the<br \/>\nprosecution  had  failed  to  establish\t that  a  particular<br \/>\naccused\t had  inflicted\t a particular  injury  both  on\t the<br \/>\ndeceased-Kishore  Chand as well as on the  witness  Virender<br \/>\nKumar  (PW  7).\t His second contention is that\tit  was\t not<br \/>\nestablished that the death of the deceased was on account of<br \/>\nthe injuries in question.\n<\/p>\n<p>3.As regards the first contention, we are satisfied  that<br \/>\nthe  court, after taking into consideration  the  eyewitness<br \/>\naccount\t as well as the two dying declarations, has come  to<br \/>\nthe  right  conclusion\tthat it was  the  accused  who\twere<br \/>\nresponsible  for  the attack both  on  the  deceased-Kishore<br \/>\nChand  and the injured witness Virender Kumar in the  manner<br \/>\nalleged by the prosecution.  According to us, therefore,  no<br \/>\ninterference is called for with the said finding.\n<\/p>\n<p>4.As  regards the second contention, Mr Kohli  relied  on<br \/>\nthe fact that the incident took place on April 11, 1977, and<br \/>\nKishore Chand died about a fortnight thereafter on April 26,<br \/>\n1977.\tHe  further relied on the fact that the\t Doctor,  Mr<br \/>\nPramod Gill (PW 2) who performed the postmortem examination,<br \/>\ndid  not give his opinion with regard to the exact cause  of<br \/>\nthe death at the time of the said examination.\tOn the other<br \/>\nhand,  after performing the postmortem examination, he\tsent<br \/>\nthe kidneys of the deceased to the pathologist (PW 1) on the<br \/>\nsame day.\n<\/p>\n<p><span class=\"hidden_text\">534<\/span><\/p>\n<p>The  pathologist  gave\this  report  on\t May  12,  1977\t and<br \/>\nthereafter  on May 28, 1977, Dr Gill gave his opinion  based<br \/>\non  the\t said report, that the death was on account  of\t the<br \/>\nshort supply of blood to the kidneys as a consequence of the<br \/>\nmultiple  injuries  which the deceased had  received.\tShri<br \/>\nKohli referred us in this connection to the evidence of PW 1<br \/>\npathologist where the pathologist has stated that the  short<br \/>\nsupply of blood to the kidneys can be on account of  various<br \/>\nreasons including the injuries in question.  The pathologist<br \/>\nhas also stated that the said cause of death can be detected<br \/>\nonly  within  3\t days  of  the\tdeath.\t Since\tthough\t the<br \/>\npostmortem  was\t conducted within 3 days of the\t death,\t the<br \/>\nreport\twas submitted only on May 12, 1977, according to  Mr<br \/>\nKohli,\tthe report given by the pathologist and the  opinion<br \/>\nof Dr Gill based on the said report has to be discarded.  He<br \/>\nalso stressed that the pathologist had not mentioned in\t the<br \/>\nreport,\t the grounds on which he had come to the  conclusion<br \/>\nthat, in the present case, there was a short supply of blood<br \/>\nto the kidneys.\n<\/p>\n<p>5.We  have carefully considered the evidence both of  the<br \/>\npathologist  (PW 1) and of Dr Gill (PW 2) who performed\t the<br \/>\npostmortem examination.\t The record shows that the deceased-<br \/>\nKishore\t Chand\thad received as many as 13 injuries  on\t his<br \/>\nperson of which five were serious according to Dr Gill.\t The<br \/>\npostmortem report also shows that the wounds in question had<br \/>\ndeveloped  septic.  It is not in dispute that Kishore  Chand<br \/>\ndied  after 15 days as a consequence of the  said  injuries.<br \/>\nThe  only question to be considered in the present case,  on<br \/>\nthe  contention of Mr Kohli, is whether these  complications<br \/>\nhad resulted in a short supply of blood to the kidneys which<br \/>\nwas  the  proximate cause of death.  The  pathologist  while<br \/>\nstating that the short supply of blood to the kidneys can be<br \/>\non  various  accounts,\thas also stated\t that  the  multiple<br \/>\ninjuries received by the deceased could also be the cause of<br \/>\nsuch  short  supply.   The prosecution is  not\trequired  to<br \/>\nexhaust\t all causes that may lead to a disease\tor  ailment.<br \/>\nAll  that prosecution had to establish in the  present\tcase<br \/>\nwas  whether the multiple injuries received by the  deceased<br \/>\nwould  have  resulted in the short supply of  blood  to\t the<br \/>\nkidneys\t which was the immediate cause of the death  of\t the<br \/>\nvictim.\t  We  are satisfied that the opinions given  by\t the<br \/>\npathologist  and  by Dr Gill, establish the  fact  that\t the<br \/>\nshort supply of blood to the kidneys in the present case was<br \/>\non account of the multiple injuries received by the  victim.<br \/>\nWe, therefore, find nothing wrong in the conclusion  arrived<br \/>\nat   by\t the  High  Court.
