Vide these applications, defendant No.1 is seeking<\/p>\n<p>review of the order dated 23.02.2011 whereby defendant<\/p>\n<p><span class=\"hidden_text\">CS(OS)No.765\/2010                                    Page 1 of 10<\/span><br \/>\n No.1 was allowed to continue in possession of the suit<\/p>\n<p>property bearing No.61\/30, Ramjas Road, Karol Bagh<\/p>\n<p>(towards house No.61\/29, Ramjas Road, Karol Bagh), New<\/p>\n<p>Delhi, subject to his giving undertaking to the Court that in<\/p>\n<p>the event of the Court ultimately deciding that his<\/p>\n<p>possession to the exclusion of other co-owners of the<\/p>\n<p>property was not lawful, he would pay 5\/6 of the current<\/p>\n<p>market rent of the aforesaid premises to the other co-owners<\/p>\n<p>of the property, he will maintain status quo with respect to<\/p>\n<p>the aforesaid possession, will not part with its possession in<\/p>\n<p>favour of any other person, will not create any third party<\/p>\n<p>interest therein and will not carry out        any addition,<\/p>\n<p>alteration, renovation or any repair whatsoever therein<\/p>\n<p>without prior permission of the Court. He was also required<\/p>\n<p>to ensure that the above-referred portion was properly<\/p>\n<p>maintained and does not get damaged in any manner. The<\/p>\n<p>undertaking was directed to be filed within one week.<\/p>\n<p>2.          The learned counsel for the applicant states that<\/p>\n<p>only the first and second floor of property No. 61\/30,<\/p>\n<p>Ramjas Road, Karol Bagh (towards house No.61\/29, Ramjas<\/p>\n<p>Road, Karol Bagh), New Delhi, is the subject matter of this<\/p>\n<p>suit and, therefore, the undertaking should be confined to<\/p>\n<p><span class=\"hidden_text\">CS(OS)No.765\/2010                                   Page 2 of 10<\/span><br \/>\n only those two floors of the property and should not cover<\/p>\n<p>the ground floor which is the exclusive property of<\/p>\n<p>defendant No.1. A bare perusal of the order would clearly<\/p>\n<p>show that the undertaking sought from defendant No.1 is<\/p>\n<p>confined to property which is subject matter of the suit. It<\/p>\n<p>is, in any case, clarified that the undertaking to be<\/p>\n<p>furnished by defendant No.1 in terms of the order of this<\/p>\n<p>Court dated 23.02.2011 would be confined to the first and<\/p>\n<p>second floor of property No.61\/30, Ramjas Road, Karol<\/p>\n<p>Bagh (towards house No.61\/29, Ramjas Road, Karol Bagh),<\/p>\n<p>New Delhi.\n<\/p>\n<p>3.          The learned counsel for the applicant\/defendant<\/p>\n<p>No.1 states that there is no justification for requiring him to<\/p>\n<p>give undertaking to pay 5\/6 of the current market rent of<\/p>\n<p>the aforesaid premises to the other co-owners since the<\/p>\n<p>applicant\/defendant No.1 is not actually occupying the<\/p>\n<p>aforesaid portion of the property and is holding only the<\/p>\n<p>keys of those premises.     Since it is defendant No.1 alone<\/p>\n<p>who continues to hold the keys of the aforesaid portions, it<\/p>\n<p>is he who is deemed to be in possession of the aforesaid<\/p>\n<p>portions and there is no reason why he alone should<\/p>\n<p>continue to enjoy the possession of the aforesaid joint<\/p>\n<p><span class=\"hidden_text\">CS(OS)No.765\/2010                                    Page 3 of 10<\/span><br \/>\n property.\n<\/p>\n<p>            At this stage, the learned counsel appearing for<\/p>\n<p>defendant No.1 states that defendant No.1 is ready to<\/p>\n<p>deposit the keys of the first and second floor of the property,<\/p>\n<p>during pendency of       the   suit.   The learned counsel<\/p>\n<p>representing other parties state that they would not insist<\/p>\n<p>on an undertaking for payment of 5\/6 of the current market<\/p>\n<p>rent of the aforesaid premises to the other co-owners of the<\/p>\n<p>property in case the keys of the first and second floor,<\/p>\n<p>including the staircase leading to the first and second floor<\/p>\n<p>of the suit property No.61\/30, Ramjas Road, Karol Bagh<\/p>\n<p>(towards house No.61\/29, Ramjas Road, Karol Bagh), New<\/p>\n<p>Delhi, are deposited by defendant No.1 in the Court. Hence,<\/p>\n<p>a consent order is passed directing defendant No.1 to<\/p>\n<p>deposit the keys of the first and second floor and the<\/p>\n<p>staircase of property No.61\/30, Ramjas Road, Karol Bagh<\/p>\n<p>(towards house No.61\/29, Ramjas Road, Karol Bagh), New<\/p>\n<p>Delhi, in the Court within a week. The undertaking to be<\/p>\n<p>furnished by defendant No.1 will not include an obligation<\/p>\n<p>to pay 5\/6 of the current market rent of the aforesaid<\/p>\n<p>premises to the other co-owners of the property.                    If<\/p>\n<p>defendant No.1 wants the keys of the staircase temporarily<\/p>\n<p><span class=\"hidden_text\">CS(OS)No.765\/2010                                    Page 4 of 10<\/span><br \/>\n for the purpose of cleaning it, he will be entitled to apply to<\/p>\n<p>the Court for this purpose.\n<\/p>\n<p>            These applications stand disposed of in terms of<\/p>\n<p>this order.\n<\/p>\n<p>IA 11089\/2011(O.12 R.6 CPC)<\/p>\n<p>4.             Vide this application, defendant No.1 is seeking<\/p>\n<p>permission to file written statement.             This is a suit for<\/p>\n<p>partition and, the plaintiff as well as defendants No.1 &amp; 5<\/p>\n<p>are practising Advocates. When this matter was taken up<\/p>\n<p>by    Hon&#8217;ble       Mr.   Justice    J.R.Midha,    on   20.05.2010,<\/p>\n<p>defendants No.1 &amp; 5 were present in the Court along with<\/p>\n<p>their counsel and they admitted that Smt. Kailash Wati was<\/p>\n<p>the owner of suit property bearing No. No.61\/30, Ramjas<\/p>\n<p>Road, Karol Bagh (towards house No.61\/29, Ramjas Road,<\/p>\n<p>Karol Bagh), New Delhi.             It was also admitted that the<\/p>\n<p>plaintiff has one-sixth share in the suit property.                The<\/p>\n<p>shares of the parties as mentioned in para 10 of the plaint<\/p>\n<p>were also admitted. It was also submitted that defendants<\/p>\n<p>No.1 &amp; 5 had no objection to the preliminary decree being<\/p>\n<p>passed in terms of the order made in the plaint. It was also<\/p>\n<p>submitted to the Court that a Local Commissioner be<\/p>\n<p>appointed for examining whether the suit property can be<\/p>\n<p><span class=\"hidden_text\">CS(OS)No.765\/2010                                          Page 5 of 10<\/span><br \/>\n partitioned by metes and bounds.           When this matter was<\/p>\n<p>taken up by the Hon&#8217;ble Judge on 31.05.2010, defendant<\/p>\n<p>No.1     sought      to   withdraw   the   admissions    made       on<\/p>\n<p>20.05.2010 and submitted that he wanted to contest the<\/p>\n<p>suit.    Defendant No.5, however, stuck to her statement<\/p>\n<p>made before the Court on 20.05.2010. The Court was of the<\/p>\n<p>view that this was a fit case for exercising power under<\/p>\n<p>Order 12 Rule 6 of the Code of Civil Procedure, in view of<\/p>\n<p>the unequivocal statements made by defendants No.1 &amp; 5<\/p>\n<p>before the Court on 20.05.2010 and passed a preliminary<\/p>\n<p>decree declaring that the plaintiff has one-sixth share,<\/p>\n<p>defendant No.1 has one-sixth share and defendant No.5 has<\/p>\n<p>1\/42nd share in the suit property.           Defendant No.2 had<\/p>\n<p>already filed written statement by that time.           Defendants<\/p>\n<p>No.3, 4, 6 to 18 were granted thirty days time to file the<\/p>\n<p>written statement.        An appeal was preferred by defendant<\/p>\n<p>No.1 against the order dated 31.05.2010.           The appellant<\/p>\n<p>stated before the Division Bench that he proposed to file an<\/p>\n<p>application before this Court praying for leave to file written<\/p>\n<p>statement.          The appeal was dismissed as withdrawn.<\/p>\n<p>Pursuant to the statement made before the Division Bench<\/p>\n<p><span class=\"hidden_text\">CS(OS)No.765\/2010                                         Page 6 of 10<\/span><br \/>\n on 27.05.2011, defendant No.1 has now filed the application<\/p>\n<p>seeking leave to file the written statement.<\/p>\n<p>5.          Since a preliminary decree for partition has already<\/p>\n<p>been passed against defendant No.1, there is no occasion<\/p>\n<p>for him to file a written statement at this stage. On passing<\/p>\n<p>of preliminary decree, the Court needs only to ascertain<\/p>\n<p>whether the property is capable of partition by metes and<\/p>\n<p>bounds or not and in case the property is capable of<\/p>\n<p>partition by metes and bounds, a final decree of partition is<\/p>\n<p>to be passed, thereby partitioning the properties by metes<\/p>\n<p>and bounds. In case the property is incapable of metes and<\/p>\n<p>bounds, the Court is to pass an appropriate order with<\/p>\n<p>respect to its sale, on the request of one or more of its co-<\/p>\n<p>owners.\n<\/p>\n<p>6.          Since a decree based on admission before the<\/p>\n<p>Court has already been passed by this Court and an appeal<\/p>\n<p>preferred against that order has also been dismissed, there<\/p>\n<p>is no question of allowing defendant No.1 to file written<\/p>\n<p>statement at this stage.         If defendant No.1 has any<\/p>\n<p>submission to make with respect to passing of final decree,<\/p>\n<p>he will get an opportunity to make such submissions, as<\/p>\n<p><span class=\"hidden_text\">CS(OS)No.765\/2010                                     Page 7 of 10<\/span><br \/>\n and when, the Court takes up the passing of the final<\/p>\n<p>decree.\n<\/p>\n<p>            The application being devoid of any merit is hereby<\/p>\n<p>dismissed.\n<\/p>\n<p>CS(OS) 765\/2010<\/p>\n<p>7.          Defendants    No.5,   who   is   an   Advocate     and<\/p>\n<p>represents defendants No.2 to 4 and 6 to 8, Ms. Jaya<\/p>\n<p>Tomar, Advocate, who represents defendants No.9 to 13 and<\/p>\n<p>Mr. Rajat Aneja, Advocate, who represents defendants No.14<\/p>\n<p>to 17 admit, on instructions, that property No. 61\/30,<\/p>\n<p>Ramjas Road, Karol Bagh (towards house No.61\/29, Ramjas<\/p>\n<p>Road, Karol Bagh), New Delhi, was owned by late Smt.<\/p>\n<p>Kailash Wati who died on 07.02.1980 leaving behind six<\/p>\n<p>legal heirs, namely, plaintiff &#8211; Shri Nripendra Kumar<\/p>\n<p>Aggarwal, defendant No.1 &#8211; Shri Surinder Lal Aggarwal, late<\/p>\n<p>Jitender Kumar Aggarwal, late Shri Ravi Aggarwal, late Shri<\/p>\n<p>B.M.Aggarwal and Mrs. Veena Gupta. They also admit that<\/p>\n<p>all the six legal heirs of Smt. Kailash Wati referred above<\/p>\n<p>became entitled to one-sixth share in the suit property, i.e.<\/p>\n<p>first and second floor of property No. 61\/30, Ramjas Road,<\/p>\n<p>Karol Bagh (towards house No.61\/29, Ramjas Road, Karol<\/p>\n<p>Bagh), New Delhi.        They also request that a preliminary<\/p>\n<p><span class=\"hidden_text\">CS(OS)No.765\/2010                                      Page 8 of 10<\/span><br \/>\n decree for partition of the suit property be passed in the<\/p>\n<p>aforesaid ratio. It has also been pointed out that defendant<\/p>\n<p>No.18 &#8211; Mrs. Veena Gupta, has also admitted the aforesaid<\/p>\n<p>facts in the written statement filed by her.<\/p>\n<p>8. All the parties present and\/or represented before<\/p>\n<p>the Court state that the suit property is incapable of<\/p>\n<p>partition by metes and bounds.       Since the parties admit<\/p>\n<p>that the property is incapable of partition by metes and<\/p>\n<p>bounds, the only course of action left for the Court is to sale<\/p>\n<p>the suit property, as is provided under Section 3 of the<\/p>\n<p>Partition Act, on the request of one or more co-owners. The<\/p>\n<p>learned Counsel present before the Court, except defendant<\/p>\n<p>No.1, do make a request for sale of the suit property.<\/p>\n<p>            List the matter for hearing on 27th January, 2012,<\/p>\n<p>to work-out the modalities for the sale of the suit property.<\/p>\n<p>                                               (V.K.
