No.43737 of 2010\n                                    JITENDRA LAL\n                                          Versus\n                                THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>3.   23.2.2011                 Heard both sides.\n<\/p>\n<p>                               If it is true that nine witnesses who were examined<\/p>\n<p>                 by the prosecution were not supporting the prosecution charges<\/p>\n<p>                 and on that account they were declared hostile, then this Court<\/p>\n<p>                 does not appreciate as to why to go on to examine the<\/p>\n<p>                 Investigating Officer or record the statement of the accused as<\/p>\n<p>                 there may not be any circumstances appearing from the evidence<\/p>\n<p>                 requiring any explanation from the accused persons. Likewise,<\/p>\n<p>                 in a case of the present nature, as was submitted, there may not<\/p>\n<p>                 be a justification for delivering judgment after hearing<\/p>\n<p>                 arguments of the parties. The learned trial Judge would please<\/p>\n<p>                 note that the provision of Section 232 Cr. P.C. has to be taken<\/p>\n<p>                 resort to for disposing of the case. There is a Standing<\/p>\n<p>                 Instruction from this Court also that in the case of the witnesses<\/p>\n<p>                 turning hostile the lower court may not go on to seek production<\/p>\n<p>                 of official witnesses, like, the Investigating Officer and the<\/p>\n<p>                 Doctor and should simply shut down the case of prosecution<\/p>\n<p>                 and proceed to dispose it of. The Court believes that the learned<\/p>\n<p>                 trial Judge acts accordingly and does not go on with such<\/p>\n<p>                 meaningless prosecution and disposes of the case with ado.<\/p>\n<p>                               This petition is disposed of in expectation that the<\/p>\n<p>                 learned trial Judge disposes of the case as per the Court&#8217;s<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>        expectation.\n<\/p>\n<p>                       Learned counsel for the petitioner is directed to<\/p>\n<p>        produce a copy of this order before the trial Judge.
