Justice V.K.MOHANAN\n\n Dated :01\/10\/2009\n\n O R D E R\n                    C.N.RAMACHANDRAN NAIR &amp;\n                               V.K.MOHANAN, JJ.\n               ....................................................................\n                         Writ Appeal No.849 of 2000\n               ....................................................................\n                Dated this the 1st day of October, 2009.\n\n                                      JUDGMENT\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>      Appeal is filed by the appellant-Co-operative Bank challenging<\/p>\n<p>the judgment of the learned Single Judge upholding the finding of the<\/p>\n<p>Co-operative Tribunal that the borrower who has taken agricultural<\/p>\n<p>loan is entitled to benefit under the Kerala Co-operative Agricultural<\/p>\n<p>and Rural Debt Relief Scheme, 1990.                       The appellant&#8217;s contention is<\/p>\n<p>that the appellant is an Urban Co-operative Bank and therefore, the<\/p>\n<p>borrower is not entitled to benefit of the scheme. However, on facts the<\/p>\n<p>Tribunal found that the loan is agricultural loan which is not denied by<\/p>\n<p>the appellant. Appellant&#8217;s claim that it is an Urban Bank which is not<\/p>\n<p>bound to give the incentive under the Scheme to the borrower is turned<\/p>\n<p>down by the learned Single Judge by holding that primarily appellant is<\/p>\n<p>a Primary Co-operative Society under the Kerala Co-operative<\/p>\n<p>Societies Act and it has taken RBI&#8217;s approval for the banking business.<\/p>\n<p>Even though counsel for the appellant contested the findings of the<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>learned Single Judge, we do not find any ground to interfere with the<\/p>\n<p>finding of the Tribunal confirmed by the learned Single Judge.<\/p>\n<p>Consequently Writ Appeal is dismissed.\n<\/p>\n<\/p>\n<p>                                 C.N.RAMACHANDRAN NAIR<br \/>\n                                 Judge<\/p>\n<p>                                 V.K.MOHANAN<br \/>\n                                 Judge<br \/>\npms<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Thiruvalla East Co-Operative &#8230; vs The Kerala Co-Op.
