None is present for the respondent,<br \/>\n\tthough served.\n<\/p>\n<p>The<br \/>\n\tappellant- State of Gujarat has preferred this appeal under section<br \/>\n\t378 of Criminal Procedure Code challenging the order of acquittal<br \/>\n\tdated 7\/5\/2004 passed by learned JMFC,Gandhinagar in Criminal Case<br \/>\n\tNo. 633 of 1995, acquitting the respondent \/ original accused of the<br \/>\n\tcharge of committing offence under section 85 (1)  (3) and 66 (1) B<br \/>\n\tof the Bombay Prohibition Act. The case of the prosecution before<br \/>\n\tthe Court was that the accused was caught on 5\/12\/1994 at 23.00<br \/>\n\thours in an inebriated condition and he did not possess the permit<br \/>\n\tfor consuming alcohol. As he appeared to be under the influence of<br \/>\n\talcohol, he was proceeded against for committing offence under<br \/>\n\tsection 85 (1) (3) and 66 (1) B of the Bombay Prohibition Act (<br \/>\n\t&#8216;Prohibition Act&#8217; for short). The court after recording evidence and<br \/>\n\tappreciating the same came to the conclusion that  there was serious<br \/>\n\tlapses noticed on the part of the doctor who collected blood and<br \/>\n\tsent it for examination. After recording lack of evidence with<br \/>\n\tregard to lack of complete compliance with provision of Rule 4 (1)<br \/>\n\tof the Bombay Prohibition (Medical Examination And Blood Test) Rules<br \/>\n\t1959 (hereinafter referred to as the &#8216;Prohibition Rules&#8217; for<br \/>\n\tbrevity), the court came to the conclusion that the accused deserved<br \/>\n\tto be given benefit of doubt, and accordingly accused was acquitted<br \/>\n\tof the charge of committing offence punishable under section 85 (1)<br \/>\n\t(3) and 66 (1) B of the Prohibition Act vide order dated 7\/5\/2004,<br \/>\n\twhich is impugned in this appeal under section 378 Cr.P.C.\n<\/p>\n<p>Learned<br \/>\n\tAPP Ms. Shah has taken this Court through the order impugned as well<br \/>\n\t as the original record that includes police report, the charge,<br \/>\n\ttestimony of the prosecution witnesses and accused statement<br \/>\n\trecorded under section 313 Cr.P.C.  She submitted that though<br \/>\n\tpanchas did not support entirely the case of the prosecution,<br \/>\n\tdoctor&#8217;s evidence could not have been treated to be an evidence<br \/>\n\tlacking veracity for establishing compliance with procedure for<br \/>\n\ttaking blood from the accused. However she could not controvert from<br \/>\n\tthe record the glaring discrepancies recorded in the testimony of<br \/>\n\tthe doctor, P.W. no.1.\n<\/p>\n<p>P.W.\n<\/p>\n<p>\tNo.1 the doctor, Exh. 11, has said that he had examined the accused<br \/>\n\tat 0.20 hrs on 6\/12\/1994 and he was smelling of alcohol and the<br \/>\n\tperson was steady and the eye condition was normal. This testimony<br \/>\n\tof doctor wold therefore naturally deal serious blow to the<br \/>\n\tallegation of committing offence under section 85 (1) (3) &amp; 66<br \/>\n\t(1) B of the Prohibition Act. The doctor has testified that the<br \/>\n\tblood sample was collected in the phial  containing anticoagulant<br \/>\n\tpreservative which  is available  in his locker and which was<br \/>\n\tprepared by himself. He also deposed with regard to affixing of seal<br \/>\n\tof the phial and applying of hospital seal thereof. In his cross<br \/>\n\texamination doctor has deposed that the phial was handed over to MNC<br \/>\n\tclerk in the morning. The phial was sent but in which content was<br \/>\n\tnot known to him. He also admits in his cross examination that<br \/>\n\tbefore taking the blood from the accused, 5 minutes ago he had taken<br \/>\n\tblood sample from someone else also. He also admitted in his cross<br \/>\n\texamination that he does not remember as to how many days ago the<br \/>\n\tphial was prepared. He also admitted in his cross examination that<br \/>\n\the has not kept any register nor does the hospital keep any register<br \/>\n\tin respect of preparation of phials nor does the phial is containing<br \/>\n\tits date of preparation. He admits that there is laboratory<br \/>\n\tdepartmental in Civil Hospital and technicians also. He also<br \/>\n\tadmitted that the anti coagulant and preservatives are kept in the<br \/>\n\tcustody of laboratory technician. He pleaded his ignorance with<br \/>\n\tregard to phial being prepared by laboratory technician. He admitted<br \/>\n\tthat he had asked the concerned nurse for getting into coagulant<br \/>\n\tpreservative. But he did not have any knowledge where from she<br \/>\n\tbrought the same. He admitted that preservatives are put in phial in<br \/>\n\ta prescribed manner and proportion and in the same  breath he admits<br \/>\n\tthat he did not have any instruments in his chamber for pouring<br \/>\n\tpotassium solvent and mercury chloride. He admits that pure<br \/>\n\tpreservatives are required to be added and he pleaded ignorance with<br \/>\n\tregard to they being refined or not.\n<\/p>\n<p>The<br \/>\n\trest of the testimony of the other witnesses would be of no<br \/>\n\timportance at this stage.\n<\/p>\n<p>Looking<br \/>\n\tto the testimony of the doctor and the discrepancies noticed herein<br \/>\n\tabove would go to show that the order of acquittal needs no<br \/>\n\tinterference under section 378 of Cr.P.C.  Hence the appeal fails<br \/>\n\tand is accordingly dismissed.  Bail bond shall stand cancelled.\n<\/p>\n<p>\t                                             [<br \/>\n\tS.R.
