THE UNION OF INDIA,\n\n                For Petitioner  :SRI.K.M.FIROZ\n\n                For Respondent  :SRI.M.PATHROSE MATTHAI (SR.)\n\n\n Dated :19\/02\/2008\n\n O R D E R\n                          ANTONY DOMINIC, J.\n\n                         ===============\n\n                     W.P.(C) NO. 5732 OF 2008 G\n\n                    ====================\n\n\n               Dated this the 19th day of February, 2008\n\n\n                              J U D G M E N T\n<\/pre>\n<p>         Petitioner   against   whom   proceedings   have   been   initiated<\/p>\n<p>under   the   Securitisation   and   Reconstruction   of   Financial   Assets<\/p>\n<p>and   Enforcement   of   Security   Interest   Act   has   filed   this   writ<\/p>\n<p>petition   challenging   the   proceedings   which   have   reached   the<\/p>\n<p>stage of dispossession on the strength of an order passed under<\/p>\n<p>Section   14   of   the   Act.   Though   several   contentions   have   been<\/p>\n<p>raised   in   the   writ   petition,   learned   counsel   only   seeks   an<\/p>\n<p>instalment   facility   to   discharge   the   liability   within   a   reasonable<\/p>\n<p>time.\n<\/p>\n<\/p>\n<p>         2.    I heard the learned standing counsel for the Bank, who<\/p>\n<p>points out that there are two   loans availed of by the petitioner,<\/p>\n<p>one a housing loan and other a cash credit facility.  It is pointed<\/p>\n<p>out by the Bank that as far as the housing loan is concerned, the<\/p>\n<p>defaulted amount itself  comes  to  Rs.  2  lakhs  and  the petitioner<\/p>\n<p>WPC 5732\/08<\/p>\n<p><span class=\"hidden_text\">                                           :2 :<\/span><\/p>\n<p>should   clear   the   defaulted   amount   within   the   shortest   possible<\/p>\n<p>time.     It   is   also   suggested   that   the   default   towards   the   cash<\/p>\n<p>credit facility enjoyed by the petitioner should be cleared, if not in<\/p>\n<p>one lump,  atleast  in instalments.     This  suggestion   made  by the<\/p>\n<p>counsel   for   the   Bank   is   very   fair   and   is   acceptable   to   the<\/p>\n<p>petitioner.\n<\/p>\n<\/p>\n<p>      3.       Having   regard   to   the   aforesaid   submissions   made   by<\/p>\n<p>both   sides,   I   dispose   of   this   writ   petition   with   the   following<\/p>\n<p>directions.\n<\/p>\n<\/p>\n<p>      1)       That   the  amount  in  default   towards   the  housing  loan<\/p>\n<p>availed   of   by  the   petitioner   should   be  cleared   by   the   petitioner<\/p>\n<p>within one month from today.\n<\/p>\n<\/p>\n<p>      2)       Once   remittance   is   made   as   above,   Bank   will   permit<\/p>\n<p>the   petitioner   to   pay   the   balance   in   instalments   as   originally<\/p>\n<p>agreed in the loan agreement.\n<\/p>\n<\/p>\n<p>      3)       In   so   far   as   the   cash  credit   facility   availed   of   by  the<\/p>\n<p>petitioner   is   concerned,   arrears   should   be   cleared   by   the<\/p>\n<p>petitioner in 12 equal monthly instalments, first of which will be<\/p>\n<p>payable   on   the   15th  of   March,   2008   and   the   subsequent<\/p>\n<p>WPC 5732\/08<\/p>\n<p><span class=\"hidden_text\">                                        :3 :<\/span><\/p>\n<p>instalments   will   be   payable   on   the   15th  of   every   succeeding<\/p>\n<p>month.\n<\/p>\n<\/p>\n<p>      4)     Subject   to   payment   as   above,   the   proceedings<\/p>\n<p>initiated   against   the   petitioner   will   be   deferred   and   in   case   the<\/p>\n<p>petitioner commits default, the Bank will be free to continue the<\/p>\n<p>action that it has already initiated, without further notice.<\/p>\n<p>                                                ANTONY DOMINIC,JUDGE.\n<\/p>\n<p>Rp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Abdul Hassan vs The Authorised Officer on 19 February, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 5732 of 2008(G) 1.
