TOTLA\n\n\nMr. Sandeep Mehta, for Applicant (s).\nMr. S.K.Vyas, PP, for the State.\n\n      Heard learned counsel for the petitioner (s), as well as\nlearned Public Prosecutor for the State and also perused the\nimpugned order.\n      On behalf of the accused-petitioner, it is contended that\nthe petitioner    is in custody for more than two months and\ncharge-sheet presented in July, 2008 - all other accused are on\nbail and one accused has been released on bail vide order dated\n04.08.2008 passed by this Court and offence is said to be that of\nExcise Act.\n      Learned Public Prosecutor opposed the bail application.\n      Considering the rival contentions of the parties and taking\ninto consideration the entire facts and circumstances of the case,\nI am inclined to grant bail to the petitioner (s) under Section 439\nof the Code of Criminal Procedure.\n      It is, therefore, ordered that the accused - petitioner\nJabbar Singh s\/o. Jai Singh be released on bail, provided he\nfurnishes a personal bond in the sum of Rs.30,000\/- (Rupees\nthirty thousand only) with two sound sureties of Rs.15,000\/-\n(Rupees fifteen thousand only) each to the satisfaction of the\nconcerned trial Court, with the stipulation to appear in that Court\nas and when called upon to do so, during the pendency of the\ntrial against him in this case.\n                                              (C.
