PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\nis an application preferred by the accused-applicant praying for<br \/>\nmodification \/ deletion of conditions imposed by the High Court vide<br \/>\norder dated 19.6.2006 passed in Criminal Misc. Application No.4057 of<br \/>\n2006.  It appears that the accused- applicant was ordered to be<br \/>\nreleased on bail in connection with M. Case No.11 of 2006 registered<br \/>\nwith Dholka Police Station vide order dated 19.6.2006.  Amongst<br \/>\nvarious conditions imposed, condition no. 3(f) and 3(i) reads as<br \/>\nunder:-\n<\/p>\n<p>\t3(f):-\n<\/p>\n<p>mark<br \/>\npresence before the concerned police station once in a month i.e. on<br \/>\nany day between 1st and 10th<br \/>\nof every month, any time between 11:00 a.m. and 5:00 p.m. till<br \/>\ncommencement of trial:\n<\/p>\n<p>3(i):\n<\/p>\n<p>surrender<br \/>\nhis passport, if any, to the lower court within a week.\n<\/p>\n<p>\tIt<br \/>\nis submitted by the learned advocate Mr. Bukhari that the<br \/>\naccused-applicant has been scrupulously complying with the conditions<br \/>\nimposed upon him way back in the year 2006.  He has regularly marked<br \/>\nhis presence at the concerned police station once in a month as<br \/>\nordered earlier.  He has submitted that these conditions are now<br \/>\ngoing to be very harsh as five years have lapsed and he is regularly<br \/>\nattending the Trial Court on the date fixed for the purpose of trial.<br \/>\n He further submitted  that as on today, even charge is not framed.<br \/>\nHowever on each and every date which is being fixed by the Trial<br \/>\nCourt, he is remaining present and his presence is being marked<br \/>\nbefore the Trial Court. In this view of the matter, taking into<br \/>\nconsideration the fact that  since past five years, he has been<br \/>\nmarking his presence at the concerned police station and he is also<br \/>\nsimultaneously marking his presence before the Trial Court on the<br \/>\ndate fixed,  I am of the view that it would not be necessary now for<br \/>\nthe accused-applicant to mark his presence at the concerned police<br \/>\nstation once in a month as ordered early.  Hence condition no.3(f)<br \/>\nearlier imposed stands deleted on the condition that he shall<br \/>\nregularly appear before the Trial Court on the date fixed by the<br \/>\nTrial Court for the purpose of Trial.\n<\/p>\n<p>\tIt<br \/>\nis further submitted that his passport has also expired and he would<br \/>\nlike to get his passport renewed.  It is informed by learned advocate<br \/>\nMr. Bukhari that in another offence registered as CR. No. I-129 of<br \/>\n2003 with Dholka Police Station, same condition of surrender of<br \/>\npassport was ordered and so far as the second case is concerned,<br \/>\nlearned Single Judge of this Court vide order dated 13th<br \/>\nMay,2011, directed the Lower Court to return the passport to the<br \/>\naccused-applicant for the purpose of renewal \/ issuance of fresh<br \/>\npassport and on such passport being renewed \/ fresh passport being<br \/>\nissued, the same shall again be surrendered to the Trial Court.  It<br \/>\nis submitted that since the same condition has been imposed in the<br \/>\nother case, in the present case also same order may be passed.\n<\/p>\n<p>\tIn<br \/>\nthis view of the matter, the Lower Court is directed to return the<br \/>\npassport to the applicant for the purpose of renewal \/ issuance of<br \/>\nfresh passport.  On such passport being renewed \/ fresh passport<br \/>\nbeing issued, the same shall again be surrendered to the trial Court.\n<\/p>\n<p>\tThe<br \/>\napplication stands disposed of in the above terms.
