Justice K.HEMA\n\n Dated :04\/02\/2009\n\n O R D E R\n                           K.HEMA, J.\n\n               -----------------------------------------\n                       B.A.No.269 of 2009\n               -----------------------------------------\n\n            Dated this the 4th February, 2009\n\n                            O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2. The alleged offence is under Section 498A of the<\/p>\n<p>Indian Penal Code. Petitioners are accused 2, 3 and 1, who are<\/p>\n<p>father-in-law,   mother-in-law      and     husband     of   de  facto<\/p>\n<p>complainant. According to prosecution,               petitioners were<\/p>\n<p>harassing de facto complainant ever since the marriage<\/p>\n<p>demanding      more     money       and     dowry,      after  already<\/p>\n<p>misappropriating money and gold given to her at the time of<\/p>\n<p>marriage.\n<\/p>\n<p>      3. Learned counsel for petitioner submitted that<\/p>\n<p>petitioners are innocent of the allegations                made. The<\/p>\n<p>marriage between first accused and de facto complainant took<\/p>\n<p>place on 16.3.2008. The first accused is a Manager of an<\/p>\n<p>Insurance Company. Thereafter, the parties were living hapily<\/p>\n<p>in the house. But, de facto complainant did not conceive.<\/p>\n<p>Therefore, she was taken to a doctor for consultation and as<\/p>\n<p>per Annexure-I dated 1.10.2008, both parties had consultation<\/p>\n<p><span class=\"hidden_text\">  BA.269\/09                     2<\/span><\/p>\n<p>with the doctor, when she was having urinary track infection<\/p>\n<p>and the medical record reveals that both of them expressed<\/p>\n<p>their desire to conceive. Just after one month, de facto<\/p>\n<p>complainant was taken away by her parents by force on<\/p>\n<p>8.12.2008 and she was detained in her parental house.<\/p>\n<p>     First accused moved a petition for habeas corpus and<\/p>\n<p>when de facto complainant appeared before the court, she<\/p>\n<p>stated that first accused is mad and that she was not detained<\/p>\n<p>by any person etc. She was therefore, allowed to go with the<\/p>\n<p>parents. Thereafter, first accused attempted to commit suicide<\/p>\n<p>on two occasions. Annexure-II is a document issued by the<\/p>\n<p>doctor relating to this, which shows that on 21.12.2008, she<\/p>\n<p>attempted to commit suicide by cutting the vein and thereafter<\/p>\n<p>by hanging and both attempts were futile. First accused was<\/p>\n<p>also reportedly found to be depressed.\n<\/p>\n<p>     4. Learned counsel for petitioners also submitted that the<\/p>\n<p>allegations that there was demand of dowry is absolutely<\/p>\n<p>incorrect. In fact, various amounts were deposited in the<\/p>\n<p>Insurance Company in the name of de facto complainant and<\/p>\n<p><span class=\"hidden_text\">  BA.269\/09                      3<\/span><\/p>\n<p>also in the name of first accused and also by showing de facto<\/p>\n<p>complainant as the nominee. Annexures 3 to 13 would prove<\/p>\n<p>this fact. But, after filing of the habeas corpus petition and<\/p>\n<p>disposal of the same, a private complaint is filed by de facto<\/p>\n<p>complainant making false allegation, it is submitted. According<\/p>\n<p>to petitioners, the only reason for the marital disharmony is<\/p>\n<p>that de facto complainant was not able to conceive after the<\/p>\n<p>marriage.\n<\/p>\n<p>      5. Learned Public Prosecutor submitted that as per the<\/p>\n<p>allegations in the complaint, de facto complainant was beaten<\/p>\n<p>up and was taken to her house on an earlier occasion and first<\/p>\n<p>accused is stated to be mentally sick and she cannot live with<\/p>\n<p>the first accused etc.<\/p>\n<p>      6. On hearing both sides, considering the various facts<\/p>\n<p>submitted by learned counsel for petitioner, which are<\/p>\n<p>supported by documents also, and on a prima facie satisfaction<\/p>\n<p>of the relevant facts, I find that anticipatory bail can be<\/p>\n<p>granted to petitioners and hence, the following order is<\/p>\n<p>passed:\n<\/p>\n<p><span class=\"hidden_text\"> BA.269\/09                       4<\/span><\/p>\n<blockquote><p>           Petitioners    shall   surrender   before    the<\/p>\n<p>     Magistrate Court concerned within seven days from<\/p>\n<p>     today and they shall be released on bail on their<\/p>\n<p>     executing     bond for Rs.25,000\/- each with two<\/p>\n<p>     solvent sureties each for the like sum to the<\/p>\n<p>     satisfaction of the Magistrate Court concerned, on<\/p>\n<p>     the following conditions:\n<\/p><\/blockquote>\n<blockquote><p>     i)    Petitioners shall report before the investigating<\/p>\n<p>           officer as and when directed.\n<\/p><\/blockquote>\n<blockquote><p>     iii).
